Also, the department may collect fees for the OSH fund. 7 LCP Article 128 Visitorial and Enforcement Power “…labor regulation officers, shall have access to employer’s records and premises at any time of the day or night whenever work is being undertaken therein, and the right to copy there from, to question any employee and investigate any fact… 8 Presidential Decree 626: Ammending Labor Code of the Philippines Presidential Decree 856: Code on Sanitation of the Philippines Republic Act 8504: Philippine AIDS Prevention and Control Act of 1998 Republic Act 9165: Comprehensive Dangerous Drugs Act of 2002 9 Republic Act 6969: Toxic Substances and Hazardous and Nuclear Wastes Control Act of 1990 Local Government Act Executive Order 307: Establishing the Occupational Safety and Health Center in the Employees' Compensation Commission 10 The Occupational Safety and Health Standards (OSHS) “OSHS is actually a codification of all safety and health rules and regulations, including safety orders then in existence at the time. 11 Selected OSHS Provisions Significant and Major Provisions of OSHS Rule 1001: Purpose and Scope “to protect every workingman against the dangers of injury, sickness or death through safe and healthful working conditions, thereby assuring the conservation of valuable manpower resources…” 13 Rule 1005: Duties of Employers, Workers and other Persons This rule states that the employer must give workers a hazard free environment. Workers must report to his supervisor regarding to any hazard encountered and they must follow all standards and proper using of safety equipment and PPE 14 Rule 1012.02: Abatement of Imminent Danger This rule states that when a danger exists in a workplace, it must be informed immediately to his employer and workers. The order shall require specific measure in avoiding and removing the danger. 15 Rule 1013: Hazardous Workplaces Considerations under this rule are: ▹ Exposure to dangerous hazards ▹ Works related to construction, mining ▹ Handling explosive materials ▹ Exposure to different biological agents. 16 Rule 1043.01: Health and Safety Committee This rules states that HS Committee must be established for planning and policy making in all matters regarding safety and health. 17 Rule 1050: Notification and Keeping of Records of Accidents and/or Occupational Illnesses States that all occupational illness and accidents must be reported by the employer to the Regional Labor Office. This is for the office to investigate. 18 Rule 1070: Occupational Health and Environmental Control This rule is the basis for conducting work environment measures by OSH committee.
