SHERIFF’S POLICY MANUAL 7.15 RED LIGHT CAMERA/TOLL POLICY: Employees of the Broward Sheriff's Office are expected to obey all Florida laws and agency policies regarding vehicle operations pursuant to Florida Statutes Chapter 316 (Florida Uniform Traffic Control Law). 7.15.1 Red Light Camera Violations A. Pursuant to Florida Statutes 316.072, except when responding to an emergency call, in pursuit, or responding to a fire alarm, sworn Law Enforcement personnel and Fire Rescue and Emergency Services personnel are not exempt from these violations and are expected to operate a BSO vehicle in compliance with state and local/municipal traffic laws. (Certain exceptions apply to SID and CID operations.) B. All BSO personnel driving a BSO-assigned vehicle whether on or off duty who are identified as violating Red Light Camera traffic laws will have their case forwarded to Internal Affairs for review. Employees may contest the violation with the issuing authority and if not dismissed, will notify I.A. and their command of the outcome. C. All BSO personnel who are found to be in violation of Red Light Cameras laws while driving a BSO-assigned vehicle will be responsible for paying any and all required fines. D. Internal Affairs will request that the issuing authority have the violation dismissed pursuant to an internal administrative review. E. If the violation is dismissed, it will be forwarded to the vehicle’s assigned command. A supervisor will immediately identify who was in the care, custody and control of the assigned vehicle on the date and time reflected on the notice of violation. The supervisor will review all supporting documentation to determine whether the vehicle’s operations were consistent with BSO policy. F. If the issuing authority does not agree to dismiss the violation pursuant to an internal administrative review, the notice of violation will be forwarded to the vehicle’s assigned command. The supervisor, not the employee, will perform due diligence to ascertain who was driving at the time of the violation and complete a Post Uniform Traffic Citation (UTC) Issuance Affidavit and transfer responsibility Reviewed: 09/05/2018 Revised: 03/02/2020 Rescinds: 09/01/2015 Effective: 06/15/2020 7.15 Page 1 of 3 SHERIFF’S POLICY MANUAL from BSO to the employee identified as the vehicle’s operator at the date and time posted on the notice of violation. G. Violations of policy will be handled in accordance with the employee complaint and disciplinary process (SPM Chapter 9). H. Internal Affairs will maintain a record of all notice of violations and their respective outcomes. 7.15.2 Toll-Way Procedures A. Any employee operating an agency owned vehicle is exempt from toll payment when on official business. These exemptions apply to both toll roads and express lanes. B. Official business includes any approved vehicle usage outlined in the Broward Sheriff’s Office Policy Manual within the employee’s functions, e.g., law enforcement, detention and fire rescue to include commuting to and from work. C. Types of SunPass/Transponder Accounts: 1. Non-Revenue: Transponder that identifies user as an authorized toll-free user. (SunPass non-removable decal only.) 2. Commercial: For companies or businesses with corporate owned, leased or rented vehicles. 3. Personal: For personal, non-commercial users. D. In order to be exempt from paying tolls, personnel must utilize a department- issued non-revenue SunPass decal affixed to the vehicles’ windshield. The agency will issue non-revenue SunPass decals for all marked and unmarked law enforcement and fire rescue vehicles. Each authorized vehicle will receive a SunPass decal that will be installed by Fleet Control. SunPass transponders are not to be removed or transferred from their assigned vehicle. E. There may be a need for employees to utilize commercial SunPasses for specialized functions (e.g investigations, etc.) Commercial SunPasses may be Reviewed: 09/05/2018 Revised: 03/02/2020 Rescinds: 09/01/2015 Effective: 06/15/2020 7.15 Page 2 of 3 SHERIFF’S POLICY MANUAL issued to employees at the discretion of the Sheriff or his designee. All commercial SunPasses will be funded by the respective employee’s division. Commercial SunPasses will only be used for official business. Commercial SunPasses will not be used to commute to and from work. F. Any employee in need of an agency commercial SunPass will fill out a SunPass Authorization Request/Renewal Form (BSO A#182) and submit it to the Fleet Division through their chain of command.
