(Revised January 2020) PREAMBLE These rules and regulations are intended to be general in character. As a supplement thereto, standard operating procedures will contain details by order, practice, interpretation, clarification, illustration, or explanation, necessary to standardize applications and operations. Orders, instructions, notices, and other information of a temporary concern will be circulated by Special Orders, properly coded for disposition and filing purposes. These rules and regulations are not intended to supersede applicable Civil Service Rules or contractual obligations. NAME OF MEMBER This book of Rules and Regulations is the property of the Waukegan Fire Department. A copy shall be issued to each member of the Department. Each member shall read and become familiar with the Rules and Regulations of the Fire Department. SPECIAL ORDERS: Orders, instructions, notices and other information of a temporary nature, or of current concern, circulated and properly coded for disposition and filing purposes. FIRE INCIDENT: An occurrence or incident suggesting or requiring Fire Department action or service by members. SHIFT: A twenty-four (24) hour tour of duty. COMPANY: A crew of members assigned to a station with fire fighting apparatus and whose work is performed under the immediate supervision of a Company Officer. DETAIL (COMPANY): An assignment from one company to another for a limited period to time. DETAIL (SPECIAL): An assignment of one or more members by the Chief of the Department to such special services or hours of work as he may deem necessary. CHAPTER II COMMAND AND SUPERVISORY RESPONSIBILITIES AND AUTHORITY A. FIRE CHIEF: The Fire Chief is the Chief Executive Officer of the Department and the final Departmental authority in all matters of policy, operations, and discipline. He exercises all lawful powers of his office and issues such lawful orders as are necessary to assure the effective performance of the Department. 1. RESPONSIBILITY: Through the Fire Chief, the Department is responsible for the protection of life and property within its legal jurisdiction. The Fire Chief is responsible for planning, directing, coordinating, controlling, and staffing all activities of the Department; for its continuous and efficient operations; for the enforcement of rules and regulations within the Department; for the completion and forwarding of such reports as may be required by competent authority; and for the Department's relations with the citizens of Waukegan, City Government, and other agencies. B. DEPUTY CHIEF: AUTHORITYAND RESPONSIBLITIES Subject to direction from higher command, the Deputy Chief shall have charge of all apparatus, stations, personnel, and in the absence of the Chief, the responsibility for the operations of the force. C. BATTALION CHIEF, ALSO KNOWN AS COMMANDING OFFICER: AUTHORITY AND RESPONSIBILITIES Subject to direction from higher command, a Commanding Officer has direct control over all members within his command. In addition to the general and individual responsibilities of all members and supervisory officers, a Commanding Officer is responsible for the following: 1. COMMAND: The direction and control of personnel under his command to assure the proper performance of duties and adherence to established rules, regulations, policies, and procedures. Providing for continuation of command and/or supervision in his absence. 2. LOYALTY AND ESPRIT DE CORPS: The development and maintenance of Esprit de Corps and loyalty to the Department. 3. DISCIPLINE AND MORALE: The maintenance of discipline and morale within the command and the investigation of personnel complaints not assigned elsewhere. 4. INTER-DIVISIONAL ACTION: The promotion of harmony and cooperation with other units of the Department. Initiation of proper action in cases not regularly assigned to his command, when delay, because of the necessity to inform the proper unit, might result in a failure to perform a fire duty. 5. ORGANIZATION AND ASSIGNMENT: Proper organization and assignment of duties within his unit to assure proper performance of Department functions and those of his command. 6. REPORTS AND RECORDS: Preparation of required correspondence, reports, and maintenance of records relating to the activities of his command. Assurance that information is communicated up and down the chain of command as required. 7. MAINTENANCE: Assurance that stations, equipment, supplies, and material assigned to his command are correctly used and maintained. 8. GRIEVANCES: Commanding Officer will receive all grievances (1st step) as outlined in the Collective Bargaining Agreement. D. CAPTAIN, ALSO KNOWN AS OFFICER IN CHARGE: AUTHORITY AND RESPONSIBILITIES The Officer in charge during his tour of duty exercises the same authority and has the same responsibilities as his Commanding Officer, subject to higher authority. In the absence of the Officer in charge, the senior available Lieutenant of the shift is in charge unless otherwise provided. In addition to the general and individual responsibilities of all members, the Officer in charge is specifically responsible for the following: 1. GOOD ORDERS: The good order of his command during his tour of duty to include proper discipline, conduct, welfare, field training, record keeping, and efficiency. 2. ROLL CALL: Conduct of prescribed roll calls, communications of all orders or other information at roll call and inspection, and correction of his command as necessary. 3. REPORTING: Reporting as required by a Commanding Officer. 4. PERSONNEL COMPLAINTS: Inquiry into personnel complaints against members under his command in accordance with the provisions of this manual. 5. GRIEVANCES: If designated by the Commanding Officer, the Officer in Charge will receive all grievances (1st step) as outlined in the Collective Bargaining Agreement. E. LIEUTENANTS: AUTHORITY AND RESPONSIBILITIES: A Lieutenant may be assigned to Station Officer duties. During his tour of duty he must closely oversee the activities of his subordinates, making corrections where necessary and commending where appropriate. 1. DIRECTION: Lieutenants must exercise direct command in a manner that assures the good order, conduct, discipline, and efficiency of subordinates. Exercise of command may extend to Lieutenant outside his usual sphere of supervision if the fire objective or reputation of the Department so requires or if no other provision is made for personnel temporarily unassigned. This authority shall not be exercised unnecessarily. If a Lieutenant requires a subordinate other than his own to leave a regular assignment, the Lieutenant so directing will inform the subordinate's own Lieutenant as soon as possible. 2. ENFORCEMENT OF RULES, ETC.: Lieutenant must enforce department rules and regulations and ensure compliance with departmental policies and procedures. 3. INSPECTION: Lieutenants are responsible for inspection of activities, personnel, and equipment under their command and initiation of suitable action in the event of a failure, error, violation, misconduct, or neglect of duty by a subordinate. 4. ASSISTING SUBORDINATES: A Lieutenant shall have a working knowledge of the duties and responsibilities of his subordinates. He shall observe contacts made with the public by his subordinates and be available for assistance or instruction as may be required. Lieutenants should observe the conduct of the assigned personnel and take active charge when necessary. 5. GRIEVANCES: The Lieutenant shall inform his/her Captain of any union grievance issue immediately. F. STATION OFFICERS: AUTHORITY AND RESPONSIBILITIES: Station Officers shall be strictly accountable for the oversight of Fire Department personnel and conservation of property under their control, and the proper administration and execution of the duties, practices, and procedures herein delegated to them to perform in the control and extinguishment of fire. 1. STATION JOURNALS: The Station Officer shall maintain a Journal in the quarters of each Station which shall contain an accurate and complete history of the operations of each day, including entries in respect to special duties, orders received (written or verbal), collisions, accidents to men or apparatus, unusual occurrences, drills, tests, inspections, assignments of duty and manpower, complaints and all matters pertaining to the administration of the Station or its members, or to the interest of the Department. 2. OTHER DUTIES AS ASSIGNED: Station Officers shall also carry out any other duties assigned to them by the Chief or other supervisory officers of the Fire Department. CHAPTER III RULES AND REGULATIONS FOR ALL MEMBERS A. PROFESSIONAL CONDUCT AND RESPONSIBILITIES: 1. STANDARD OF CONDUCT: Members and employees shall lead professional lives in such a manner as to avoid bringing the Department into disrepute. 2. LOYALTY: Loyalty to the Department and to its associates is an important factor in departmental morale and efficiency. 3. COOPERATION: Cooperation between the ranks and units of the Departments is essential to effective firefighting; therefore, all members are strictly charged with establishing and maintaining a high spirit of cooperation within the Department. 4. ASSISTANCE: All members are required to take appropriate action toward aiding a fellow firefighter exposed to danger. 5. DUTY RESPONSIBILITIES: Firefighters shall perform all duties delegated to them, in the manner prescribed by law or ordinance, or by rules and regulations, practices and procedures contained herein. Firefighters shall acquire the knowledge of operation of all the various types of apparatus, tools, and equipment in use in the Department and, under the direction of their superior officers, maintain such apparatus, tools, and equipment (in their care or possession) in a clean condition and in readiness for operation at all times. Firefighters shall observe and study the principles of modern firefighting, fire prevention, rescue work, resuscitation, first aid, ventilation, and salvage operations. Firefighters shall constantly promote their physical and mental welfare. 6. INSUBORDINATION: Failure or deliberate refusal of any member or employee to obey a lawful order given by a superior officer shall be insubordination. Ridiculing a superior officer or his orders, whether in or out of his presence, is also insubordination. 7. QUESTIONS REGARDING ASSIGNMENT: Members in doubt as to the nature or detail of their assignment shall seek such information from their Officers going through the chain of command. Circumventing the Chain of Command can lead to disciplinary action. 8. KNOWLEDGE OF LAWS AND REGULATIONS: Every member is required to establish and maintain a working knowledge of laws and regulations in force in the City, the rules and policies of the Department, and the orders of the Department and Divisions thereof. In the event of improper action or breach of discipline, it will be presumed that the member was familiar with the law, rule, or policy in question. 9. PERFORMANCE OF DUTY: All members shall perform their duties as required or directed by law, department rule, policy, or order of a superior officer. All lawful duties required by competent authority shall be performed promptly as directed, notwithstanding the general assignment of duties and responsibilities. 10. ESTABLISHING ELEMENTS OF VIOLATION: Existence of facts establishing a violation of a law, ordinance, or rule is all that is necessary to support any allegation of such as basis for a charge under this section. 11. CONDUCT TOWARD SUPERIOR AND SUBORDINATE OFFICERS AND ASSOCIATES: Members and employees shall treat superior officers, subordinates, and associates with respect. They shall be courteous and civil at all times in their relationships with one another. When on duty and particularly in the presence of other members, employees, or the public, officers should be referred to by rank. 12. ORDERS: a. CRITICISM OF ORDERS: Members and employees shall not publicly criticize instructions or orders they have received. b. MANNER OF ISSUING ORDERS: Orders from an Officer to a subordinate shall be reasonable and in clear and understandable language, civil in tone, and issued in pursuit of departmental business. c. UNLAWFUL ORDERS: No Commanding Officer shall knowingly issue an order which is in violation of any law, ordinance, or departmental rules. d. OBEDIENCE TO UNLAWFUL ORDERS: Obedience to an unlawful order is never a defense for an unlawful action; therefore, no member or employee is required to obey any order which is contrary to Federal or State law or local ordinance. Responsibility for refusal to obey rests with the member. He/she shall be strictly required to justify his/her action. e. OBEDIENCE TO UNJUST OR IMPROPER ORDERS: Members or employees who are given orders they feel to be unjust or contrary to rules and regulations, must first obey the order to the best of their ability and then may proceed to appeal as provided below. f. CONFLICTING ORDERS: Upon receipt of an order conflicting with any previous order or instruction, the member affected will advise the person issuing the second order of this fact. Responsibility for countermanding the original instruction then rests with the individual issuing the second order. If so directed, the latter command shall be obeyed first. Orders will be countermanded or conflicting orders will be issued only when reasonably necessary for the good of the Department. g. REPORTS AND APPEALS: (Unlawful, Unjust, Improper Orders) A member or employee receiving an unlawful, unjust, or improper order shall at first opportunity report in writing to the Fire Chief through the Chain of Command. This report shall contain the facts of the incident and the action taken. Appeals for relief from such orders may be made at the same time the requested appeal is submitted. Extra Department action regarding such an appeal shall be conducted through the office of the Fire Chief. 13. ACCEPTANCE OF GIFTS, GRATUITIES, FEES, LOANS, ETC.: Members and employees shall not accept either directly or indirectly any gift, gratuity, loan, fee or any other thing of value, the acceptance of which might tend to influence directly or indirectly the actions of said member or employee or any other member or employee in any matter of Fire Department business; or which might tend cast an adverse reflection on the Department or any member or employee thereof. No member or employee of the Department shall receive any gift or gratuity from other members or employees junior in rank without the express permission of the Fire Chief. 14. OTHER TRANSACTIONS: Every member and employee is prohibited from buying or selling anything of value from or to any persons involved in any situation which has come to his attention or which arose out of his Departmental employment, except as may be specifically authorized by the Fire Chief. 15. REWARDS: Members and employees shall not accept any gift, gratuity, or reward in money or other consideration for services rendered in the line of duty to the community or to any person, business, or agency, except lawful salary and that which may be authorized by law. 16. DISPOSITION OF UNAUTHORIZED GIFTS, GRATUITIES, ETC.: Any unauthorized gift, gratuity, loan fee, reward, or other thing falling into any of these categories coming into the possession of any member or employee shall be forwarded to the office of the Fire Chief together with a written report explaining the circumstances connected therewith. 17. FREE ADMISSIONS AND PASSES: Members and employees shall not solicit or accept free admission to theaters and other places for amusement for themselves or others except in the line of duty. 18. DEBTS INCURRING AND PAYMENT: Members shall pay all just debts and legal liabilities incurred by them. 19. COMPENSATION FOR OTHER DAMAGES SUSTAINED ON DUTY: Members shall not seek, in any way, nor shall they accept from any person, money, or other compensation for damages sustained, or expenses incurred by them, in the line of duty, without first notifying the Fire Chief in writing. Any offer will be referred to the Fire Chief, in writing. 20. COMPENSATION FOR DAMAGES OFF DUTY: Members who have received regular sick leave, or injured off-duty salary from the City, shall notify the City, in writing, of any intent to seek suit, solicit, or accept compensation as damages, for such illness, or injury. This notice shall be filed before any action is taken. It shall include the fact of the claim and the name of the respondent. 21. MISPLACED EQUIPMENT: If, after returning from a fire, it is discovered that any article of equipment has been lost, or misplaced, or equipment belonging to another Station is in their possession, the Station Officer shall, without delay, notify the Station to which the equipment belongs. B. GENERAL CONDUCT ON DUTY: 1. LOITERING: All members on duty in uniform shall not enter taverns, theaters, or other public places except to perform an assigned task. Loitering and unnecessary conversation in such locations is forbidden. Members off duty and not on an official standby shall not loiter in Fire Department stations. 2. MILITARY COURTESY: When meeting in public, officers shall conform to normal courtesy standards and refer to each other by rank. 3. NATIONAL COLORS AND ANTHEM: Uniformed members will render full military honors to the national colors and anthem at appropriate times. Members in civilian dress shall render proper civilian honors to the national colors and anthem at appropriate times. 4. ROLL CALL: Unless otherwise directed, members shall report to roll call at the time and place specified, properly uniformed and equipped. They shall give careful attention to orders and instructions. 5. RELIEF: All members are to remain at their assignment on duty until properly relieved by another member or until dismissed by competent authority. 6. REPORTING: Members shall promptly submit such reports as are required by the performance of their duties or by competent authority. 7. ABSENCE FROM DUTY: Every member who fails to appear for duty at the date, time and place specified is "absent without leave". In the event a member is absent from duty, Headquarters Station 1, shall be notified immediately. Members unable to report for duty or those who will be late in reporting for duty, shall notify the Station Officer at their assigned station and the Commanding Officer one (1) hour prior to their scheduled duty time. 8. INSPECTIONS: The Fire Chief or Commanding Officer may call for an inspection of turn out gear and/or station uniforms. Members shall report in the uniform prescribed, carrying the equipment specified. Unauthorized absence from such inspections is chargeable as "absent without leave". 9. TRAINING: All members shall attend in-service training at the direction of the Fire Chief or Commanding Officer. Such attendance is considered a duty assignment. 10. CONSUMPTION OF INTOXICANTS OR SUBSTANCES: Members shall not consume intoxicants while off duty to the extent that the ability to perform on duty is impaired. Members shall not report for duty while under the influence of alcohol, canabis, narcotics or other illegal substances. 11. SUBSTANCE ABUSE: Members shall not at any time, on or off duty, be under the influence of canabis, narcotics or other illegal substances. Members shall not at any time, on or off duty, be intoxicated in public view. 12. INTOXICANTS OR SUBSTANCES ON DEPARTMENTAL PREMISES: Members shall not bring into or keep any alcohol, canabis, illegal drug or controlled substances on departmental premises. 13. POSSESSION OF KEYS: No member, unless authorized by his Commanding Officer or the Fire Chief, shall possess Fire Department related keys including, but not limited to; alarm keys, station keys, and apparatus keys. 14. ADDRESS AND TELEPHONE NUMBER: Immediately upon reporting for duty in a new unit, members shall record their correct residence addresses and telephone numbers with the Commanding Officer and the Fire Chief's secretary. Members are required to have telephones in the places where they reside. Changes in address or telephone shall be reported to the Commanding Officer, within 72-hours of the change. This shall be done in writing on the appropriate form, and within the specified time, whether the member is working or on leave. 15. SMOKING PROHIBITED: A member shall not smoke/vape at any time or place, where smoking is prohibited by law; nor shall they smoke/vape in fire apparatus, fire stations, or at any emergency call. The above shall also apply to the use of all tobacco products. Reasonable exceptions may be made by the Commanding Officer, when the emergency no longer exists, but shall not extend to permitting smoking on firefighting apparatus at any time. 16. PUBLIC COURTESY: A member shall be courteous and respectful in their contacts with the public. 17. VISITORS: Members shall not allow visitors, not on Department business; to enter the station before 8:00 A.M. or remain after 9:00 P.M. Children shall not be permitted in stations unless accompanied by an adult. C. UNIFORMS: 1. WORK UNIFORM FOR FIREFIGHTERS, LIEUTENANTS AND CAPTAINS: All uniform wear shall be worn in accordance with the Waukegan Fire Department's SOG's. All uniforms shall be maintained and kept in a neat appearance. 2. DRESS UNIFORM FOR LIEUTENANTS AND CAPTAINS: All uniform wear shall be worn in accordance with the Waukegan Fire Department's SOG's. All uniforms shall be maintained and kept in a neat appearance. 3. CHIEF, DEPUTY CHIEF, BATTALION CHIEF AND FIRE MARSHAL: All uniform wear shall be worn in accordance with the Waukegan Fire Department's SOG's. All uniforms shall be maintained and kept in a neat appearance. 4. SEASONAL UNIFORM CHANGE: All uniform wear shall be worn in accordance with the Waukegan Fire Department's SOG's. All uniforms shall be maintained and kept in a neat appearance. 5. UNIFORMS AND EQUIPMENT: All members of the Department shall maintain, in good order, a regulation uniform. All articles of uniform shall conform to the department uniform regulations. Civilian clothing will not be worn with any distinguishable part of the uniform. Members will not wear Fire Department issue clothing off duty except where authorized by the Fire Chief. 6. WEARING THE UNIFORM: a. Uniforms shall be kept neat, clean, and well-pressed at all times. b. The uniform cap shall be worn on dress occasions, unless otherwise directed by the Fire Chief. 7. WEARING OF UNIFORM WHEN SUSPENDED: Members shall not wear their uniforms, while under suspension. 8. MANNER OF DRESS ON DUTY: Normally, members will wear the duty uniform on a tour of duty; however, Commanding Officers may prescribe other clothing as required by the nature of the duty of which a particular member is assigned. Civilian members will wear and maintain an employee uniform, when so directed by the Fire Chief. 9. CIVILIAN CLOTHING – MANNER OF DRESS: Male members permitted to wear civilian clothing, during a tour of duty, shall wear a business suit, sport coat and slacks, or other dress, as approved by the Fire Chief. A dress type shirt shall be worn. Commanding Officers may prescribe for suppression personnel, other types of clothing when necessary, to meet a particular objective. D. EQUIPMENT-SUPPRESSION: 1. All equipment must be clean, in good working order, and conform to specifications of the Department. All firefighting personnel shall have the following equipment available, when on duty: a) Fire helmet e) Mask b) Fire coat f) At least one (1) pair of gloves c) Bunker pants and boots g) Nomex hood d) Flash light h) Utility belt 2. Other personal equipment, such as small forcible entry tools, etc. is optional. Firefighters shall not use turnout gear, other than their own. All personal firefighting apparel and equipment purchased for use with this Department shall conform to the following specifications: a) HELMETS: Fire Helmet - Cairns Model 880 or 1010 with helmet liner and appropriate shield. Helmet shields must include the prominent central display of the appropriate seniority number and the shield shall be the appropriate primary color; black for firefighters and white for officers. Seniority numbers shall be of a solid color and void of any design, but may be reflective. Seniority numbers shall be; white for Firefighters, black for Lieutneants and Captains, and gold for Chief level officers. Officers shields must include a rank insignia. Either the current sticker or a medallion/helmet badge will be allowed to meet the rank insignia requirement. In addition, the title of the appropriate rank (e.g. FIREFIGHTER, LIEUTENANT, CAPTAIN) and the words, "WAUKEGAN", "WAUKEGAN FIRE" OR "WAUKEGAN FIRE DEPARTMENT" may be added to the shield in a manner that is consistant with the old shields these have replaced. These banners, if desired, should be of the same color as your seniority number with contrasting type-face of white or black, matching the primary color of the shield. b) COATS: Fire Fighters, Lieutenants, Captains, and Battalion Chiefs: standard tan per department specifications firefighting coat, constructed of NOMEX, NAUGA THERM or HYPALON. All coats shall have standard, Scotch light trim, and be a minimum of 40". c) BOOTS: Standard firefighting boots with steel toes, steel insole protection, insulation, and shin protection, unless otherwise directed by competent authority. 3. UNIFORM AND EQUIPMENT DAMAGE CLAIM: Any claim for damage to clothing and equipment caused by performance of duty shall be made in accordance with current department directives. 4. DEPARTMENT PROPERTY AND EQUIPMENT: Members are responsible for the proper care of department property and equipment assigned to them. Damaged or lost property may subject the responsible individual to reimbursement charges and appropriate disciplinary action. The department will provide necessary firefighting turn-out gear cleaning. 5. DAMAGED INOPERATIVE PROPERTY OR EQUIPMENT: Members shall immediately report to their Station Officer, on designated forms, any loss of, or damage to departmental property assigned to, or used by them. The member's Station Officer, will be notified of any defects or hazardous conditions existing in any departmental equipment or property. 6. DISPLAY OF MATERIALS: Lieutenants, Captains, or Chief Officers shall permit no lewd, suggestive, or other undesirable printed matter to be displayed in or about the station or on bulletin boards. Advertisements, communications, posters, circulars, etc., shall have authorization by the Fire Chief before being displayed. E. DEPARTMENT BUILDINGS: 1. CARE OF BUILDINGS: Members shall not mar, mark, or deface, any surface in any Departmental buildings. No materials shall be affixed, in any way, to any wall in Departmental buildings without specific authorization from a Commanding Officer. 2. NOTICES: Members shall not mark, alter, or deface any posted notice of the Department. Notices, or announcements, shall not be posted on bulletin boards (except Union bulletin board), without permission of a Commanding Officer or Fire Chief. No notices of a derogatory nature will be posted at any time. Union bulletin boards shall be maintained in a neat and orderly manner by Union representatives. 3. SURRENDER OF DEPARTMENT PROPERTY: Members are required to surrender all Department property in their possession, upon separation from the service. Failure to return non-expendable items may cause the person to reimburse the Department for the fair market value of the article(s). 4. CARE OF FIRE STATION – INTERIOR: Fire Stations shall be kept clean, orderly, and aired each day, weather permitting. Bed linen and beds shall be maintained in a clean and sanitary condition. Members shall remove their linen when going off duty and members reporting for duty shall provide their linen and make their bed at the prescribed time. 5. CARE OF FIRE STATION – EXTERIOR: Sidewalks shall be kept clear of ice and snow and all other obstructions at all times. Windows shall be washed on prescribed days, lawns properly maintained, and the general exterior area kept clean at all times. F. DEPARTMENT VEHICLES: 1. USE: Members shall not use a Department vehicle, without the permission of a Station Officer. Department vehicles shall never be used for personal business or pleasure. 2. CARE AND CLEANING OF APPARATUS AND EQUIPMENT: All apparatus shall be thoroughly cleaned, at least once each day; weather permitting, kept in good condition and repair for immediate use. Other equipment shall be maintained in the same prescribed manner. 3. CARE OF SPARE APPARATUS AND EQUIPMENT: All apparatus or equipment delivered to a Fire Station shall be carefully safeguarded and in a clean condition, when delivered and returned. Lieutenants, Captains, and Commanding Officers shall be held strictly responsible for the preservation of all such properties. 4. TRANSPORTING CITIZENS: Citizens will be transported in Departmental vehicles only when necessary to accomplish a Fire Department purpose. Such transportation will be done in conformance with Departmental policy or at the discretion of a Commanding Officer. 5. REPORTING ACCIDENTS: Accidents involving City personnel, property and/or equipment shall be reported on designated forms to the Commanding Officer immediately. The Commanding Officer shall immediately contact the Fire Chief when practical. 6. RADIO DISCIPLINE: All members of the Department operating fire radios from a mobile unit or on a portable shall strictly observe regulations for such operations as set forth in Departmental orders and by the Federal Communications Commission. 7. RADIO COMMUNICATIONS: All apparatus with a radio installation shall put radio equipment into operation immediately upon leaving the Fire Station and notify Communications. Radio equipped apparatus responding to, or returning from assignments, shall be available for reassignment by the Communications Center. G. DEATH AND INJURY NOTIFICATIONS: 1. DEATH OR SERIOUS INJURY: When a member is killed or seriously injured on, or off duty, Immediate verbal notification will be made to the Fire Chief or to the on duty Commanding Officer. This will be followed by a written report (form 45) no later than the following work day. Information shall include the date, location, cause: extent of injury in this instance means an injury which could result in death or disability. Additional documentation may be required by all members who witnessed or were involved in the incident. 2. NON-SERIOUS INJURY: In cases where injuries are other than of a serious nature, the injury log maintained in the "commander log" maybe utilized for such injury without the submission of a Form 45. Otherwise, a written report (Form 45) will be submitted on the first work day following the incident including all the information required above. These reports are in addition to those accident and sick reports otherwise required. 3. DEATH OF MEMBER: Any member receiving notice of the death of any member or retired member during regular business hours shall notify the Fire Chief and the Commanding Officer of the deceased. a) NOTIFICATION OF THE FAMILY: (1) The family of a member injured or dying on duty shall be notified immediately by the Fire Chief or senior available member of the division to which the injured or deceased member was assigned. H. PROCEDURE AT SCENE OF FIRE: 1. GENERAL RESPONSIBILITIES OF MEMBERS AT FIRE SCENE: The first company to arrive at the scene of a fire is responsible for the following actions as they may relate to the situation: a. Summoning of medical assistance and the administration of first aid as required, preventing further injury or loss of life. b. Containment of the fire. c. Extinguishment of the fire. 2. REPORTING TO COMMANDING OFFICER AT THE SCENE: Officers in command of companies shall report immediately upon arrival to the Commanding Officer in charge at the fire scene. 3. RELIEVING COMPANIES AT FIRES: Companies operating at fires shall remain on duty until relieved by the shifts reporting, and then such relief from duty shall be affected only by permission of the Chief Officer in charge. 4. RESPONDING TO FIRES: Upon receiving an alarm, all members scheduled to respond, shall report immediately for duty. 5. TRAVEL IN RESPONSE TO ALARMS: Scenes of fire or other emergencies shall be reached with the utmost efficiency, consistent with safety. Drivers of apparatus shall be instructed to use the most direct route (condition of pavement permitting), and to drive and control the speed of apparatus with a degree of care commensurate with the proper protection of life and property. As a deterrent against collisions and accidents, Officers and drivers will be held responsible for reckless or negligent driving, according to all applicable laws. 6. SPEED OF APPARATUS – CONTROL: Apparatus signal lights and headlights shall be lighted when responding to alarms. In the interest of safety, apparatus responding to alarms shall be brought to a full stop, when necessary. When returning to quarters or not responding to alarms, Fire Department apparatus shall strictly observe all traffic and speed regulations. 7. USE OF SIRENS: Sirens shall be operated when "apparatus are responding to alarms, especially when approaching street crossings, as a safeguard against collisions and accidents. Excessive use of sirens should be avoided when possible in the vicinity of hospitals or zones of quiet. I. STATION PROCEDURES: 1. MORNING CALL: Members on duty in quarters shall rise at 7:00 AM. Members coming on duty shall report by 8:00 AM. An entry shall be made in the Station Journal of all members reporting for duty or absent. 2. CHANGING TOURS OR TRADING TOURS OF DUTY:: Changing or trading tours of duty shall be permitted only with the consent and approval of the Commanding Officer or Fire Chief in accordance with the provisions of the union contract. Time trades shall be documented on approved department forms. 3. MAINTENANCE OF SUFFICIENT FORCE: A force sufficient to properly perform the duties for a company or unit shall be maintained at all times. In the event manpower is reduced beyond the quota necessary to perform these duties, Headquarters Fire Station shall be notified immediately. 4. DUTY TO ANSWER ALARMS:: All members of the department, when on duty, shall attend all fire or alarms in the districts to which they may be assigned, detailed, or called, unless excused by a superior officer. Fatigue from previous duty shall not be an excuse for failure to answer an alarm. At the time of a serious emergency, all members of the department shall answer an alarm. At the time of a serious emergency, all members of the department shall answer alarms at the command of their Officers. 5. DUTY TO NOTIFY POLICE: All members are strictly charged to see that, when noticing any violation of City Ordinance relative to Fire Safety, the Waukegan Police Department is notified. This notification shall be made through the Shift Commander. This shall include ordinances relative to: Fire Lane parking, fire hydrant obstructions, or tampering with sprinkler connection obstructions, juvenile or adult fire setters, fires in the rooms of motels, hotels or rooming houses, damage to any city property, suspicion of individual sounding false alarms, vehicles which drive over fire hose, etc. 6. PAYCHECKS: The Commanding Officer shall be responsible for distribution of all paychecks to personnel on duty and off duty. 7. AVAILABLITY WHEN ON DUTY: Members on duty shall not conceal themselves except for some Fire Department purpose. They shall be immediately and readily available to the public during duty hours. 8. RESPONDING TO CALLS: Members of the department shall respond without delay to all calls for emergency assistance from citizens or other members. Emergency calls take precedence; however, all calls shall be answered as soon as possible, consistent with normal safety precautions and vehicle laws. Failure to answer a call for Fire Department assistance promptly, without justification, is misconduct. Except under the most extraordinary circumstances, or when otherwise directed by competent authority, no member shall fail to answer any emergency telephone or radio call directed to him. The Communication's Center will be informed when leaving the air upon returning to the Fire Station. J. PUBLIC ACTIVITIES: 1. PUBLIC APPEARANCE REQUESTS: All requests for public speeches, demonstrations, etc., will be routed to the Fire Chief or his designee for approval and processing. Members directly approached for this purpose shall suggest that the party submit his request to the Fire Chief or his designee. 2. MEMBERSHIP IN ORGANIZATIONS: Except for the Armed Forces Reserve components, members shall not affiliate themselves with any organization or group, the constitution or by-laws of which, in any way, exacts prior consideration or which would prevent its members from rendering proper and efficient service to the department. 3. CONDUCT TOWARD THE PUBLIC: Members and employees shall be courteous and orderly in their dealing with the public. They shall perform their duties quietly, avoiding harsh, violent, profane, or insolent language and always remain calm, regardless of provocation to do otherwise. Upon request, they are required to supply their names in a gentlemanly manner. They shall attend to requests from the public quickly and accurately, avoiding unnecessary referral to other parts of the department. 4. IMPARTIAL ATTITUDE: All members must remain completely impartial toward all persons coming to the attention of the department. All citizens are guaranteed equal protection under the law. Exhibiting partiality for or against a person because of race, creed, or influence is not firefighter like conduct. Similarly, unwarranted interference in the private business of others, when not in the interest of justice, is not firefighter like conduct. K. JUDICIAL AND INVESTIGATIVE ACTIONS APPEARANCES AND TESTIFYING: 1. COURT APPEARANCES: Attendance at a court or quasi-judicial hearing as required by subpoena is an official duty assignment. Permission to omit this duty must be obtained from the prosecuting attorney handling the case or other competent court official. When appearing in court, the official uniform shall be worn. Members shall present a neat appearance avoiding any mannerism which might imply disrespect to the court, such as gum chewing and smoking. 2. TESTIFYING FOR THE DEFENDANT: Any member subpoenaed to testify for the defense in any trial or hearing, or against the City or Department in any hearing or trial shall notify the Fire Chief and their Battalion Chief upon receipt of the subpoena. He/she shall also notify the City's governmental attorney. 3. DEPARTMENTAL INVESTIGATIONS - TESTIFYING: Member or employees are required to answer questions by or render material and relevant statements to a competent authority in a departmental personnel investigation when so directed. 4. CIVIL ACTION INTERVIEWS: Civil action interviews involving members which arise out of departmental employment shall be conducted according to current departmental directives. 5. CIVIL ACTION COURT APPEARANCES SUBPOENAS: Members will accept all subpoenas legally served. If the subpoena arises out of departmental employment, or if the member is informed that he is a party to a civil action arising out of a departmental employment, he shall immediately notify his Battalion Chief of the testimony he is prepared to give. Any payment received for testifying under subpoena, arising out of department employment, shall be tendered to the Fire Department. Members shall not enter into any financial understanding for appearances as witnesses prior to any trial, except in accordance with current directives. 6. CIVIL DEPOSITIONS AND AFFIDAVITS: Members shall confer with their Battalion Chief before giving a deposition or affidavit on a civil case. If the Commander determines that the case is of importance to the City, he shall inform the Fire Chief before the deposition or affidavit is given. L. TRAINING: 1. CHIEF TO ESTABLISH PROGRAM: There shall be a training program established by the Chief of the Fire Department. The primary objective of the training programs shall be to increase the knowledge, experience, and efficiency of the members of the Fire Department through a standardized training and drilling program. The training program division shall consist of a Training Officer and all the officers and other personnel designated by the Chief of the Fire Department for this purpose. 2. The Training Officer is responsible for the training of firefighters on a company or shift; shall submit to the Chief a proposed training program for the members of the department assigned to him, on a monthly basis, showing schedules of training classes and subject matter to be covered. After approval by the Chief, said program shall be adhered to, unless otherwise ordered by the Chief. 3. Training sessions are to start and end on time, and strict obedience to be given to the instructor. Work at drills is to be done in a quick, orderly, and quiet manner. Instructors and participants are to refrain from smoking and the use of profane language. 4. All members are to avail themselves of scheduled training sessions and are to be excused from same only on receipt of valid reason. Any member not fulfilling training requirements shall be subject to penalties as set out in other sections of the rule book. 5. All members shall avail themselves of such other training schools and programs as necessary in order to maintain the necessary knowledge required to fulfill their positions in the Fire Department. Attendance at outside schools shall be with the consent of the Chief of the Fire Department. 6. The Chief of the Fire Department or his designee shall conduct tests and examinations as required to determine the level of knowledge and capabilities of all members. 7. All records pertaining to attendance at drills, outside schools and tests shall be maintained in accordance with the Office of the State Fire Marshal. M. SAFETY: All personnel shall be responsible for adhering to the safety polices that from time are established by the Fire Chief for the protection and well-being of department members. N. MISCELLANEOUS: 1. ISSUANCE OF A WORK PERMIT: The decision of the Fire Chief to issue or deny a permit to work outside of the department is final. Departmental General Orders will govern the issuance or denial of the permit and its use. CHAPTER IV DEPARTMENTAL DISCIPLINE A. EMPLOYEE CONDUCT: The expected standard of conduct for all officers and employees in the service of the City of Waukegan shall be in the public interest as opposed to individual or personal interest. Therefore, in order to render the best possible service to the general public and to reflect credit to the municipal service, high standards of conduct are deemed essential. The tenure of every officer and employee shall be conditioned on good behavior and satisfactory performance of duties. B. IMPROPER EMPLOYEE CONDUCT: 1. Violation of Civil Service Rules. 2. Violation of Safety Rules of Department. 3. Violation of any of the Foregoing Rules and Regulations. C. DISCIPLINARY ACTION The principal objective of any disciplinary action shall be to improve the performance, efficiency and morale of the municipal fire service. Any action which reflects discredit on the municipal fire service is a direct hindrance to the effective performance of municipal government functions, or improper employee conduct shall be considered good cause for disciplinary action. The member being disciplined shall be informed of the charges and penalties at the time such action is taken. 1. WHO IS SUBJECT TO DISCIPLINARY ACTION: Any member or employee violating his oath and trust by committing an offense punishable under the laws or statutes of the United States, the State of Illinois, or local ordinances, or who violates any provision of the rules and regulations of the department, or who is incompetent to perform his duties, is subject to appropriate action (disciplinary). 2. PENALTIES: The following penalties may be assessed against any member or employee of the department as disciplinary action: (a) Golden Rod (b) Oral reprimand (c) Written reprimand (d) Suspension (e) Dismissal from service D. DEPARTMENTAL AUTHORITY TO DISCIPLINE: 1. Final departmental discipline authority and responsibility rests with the Fire Chief. For disciplinary purposes, Deputy Chief, Battalion Chief, and Captains have full power and authority to reprimand or to suspend up to two (2) shift days. Immediate written notice of any reprimand or suspension must be given to the Fire Chief. 2. No subordinate shall be suspended more than three (3) times without formal charges being preferred against him, the charges to be considered by the Fire Chief and Civil Service Commission. Other supervisory personnel may take the following disciplinary action: (a) Oral reprimand (b) Written reprimand (subject to Fire Chiefs approval) (c) Emergency suspension (d) Written recommendations for other penalties 3. EMERGENCY SUSPENSION: The following personnel have the authority to impose emergency suspension until the next business day against a member or employee, when it appears that such action is in the best interests of the department: (a) Any Command Officer, Deputy Chief, Battalion Chief, and Fire Marshal or Captain. 4. EMERGENCY INTERDIVISIONAL DISCIPLINARY ACTION: When the improper conduct of a member or employee of one unit is of such a nature that immediate or emergency disciplinary action is required of a Command Officer of another unit, such action may be taken at once, within the following limitations: (a) Oral reprimand (b) Written reprimand (c) Emergency suspension, until the next business day 5. INTERDIVISION ORAL REPRIMAND: When the Command Officer of one unit orally reprimands a member or employee of another unit, he shall notify the Battalion Chief or Captain of the member so disciplined, as soon as possible. He shall also submit a written report of this. 6. FOLLOW-UPACTION ON EMERGENCY SUSPENSIONS: A member or employee receiving an emergency suspension shall be required to report to the Fire Chief on the next business day no later than 10:00 am, unless otherwise directed by competent authority. The Command Officer imposing or recommending the suspension shall also report to the Fire Chief at the same time. E. REPORTS OF DISCIPLINARY ACTION TAKEN OR RECOMMENDED: 1. Whenever disciplinary action is taken or recommended, a written report must be submitted immediately containing the following information: (a) The name, rank, and present assignment of the person being disciplined. (b) The dates and time(s) of the misconduct and location. (c) The section number(s) of this manual violated or common name of the infraction. (d) A complete statement of the facts of the misconduct. (e) The punishment imposed or recommended. (f) The written signature and rank of the preparing officer and his position in relation to the member being disciplined. 2. THE REPORT SHALL BE DISTRIBUTED AS FOLLOWS BY THE OFFICER IMPOSING OR RECOMMENDING DISCIPLINARY ACTION: (a) Original to the Chief via the complete chain of command. (b) A copy to subject's Commanding Officer. (c) A copy retained by officer imposing or recommending the action. (d) A copy to individual being disciplined. 3. MISCONDUCT OBSERVED BY FIRE PERSONNEL: Whenever any Command Officer observes or is informed of the misconduct of another member which indicates the need for disciplinary action, he shall take authorized and necessary action and render a complete report of the incident and his actions to his Commanding Officer. F. CITIZENS COMPLAINTS AGAINST FIRE PERSONNEL: 1. Complaints by citizens against members of this department shall be processed in the following manner: (a) During normal business hours: Refer such complaints to the Chief. (b) Other Times: Notify the Officer Commanding who will take the following actions: (1) Instruct an Officer to receive and investigate the complaint. (2) Receive and investigate the complaint himself. 2. SERIOUS COMPLAINTS OR ALLEGATIONS: If, in the opinion of the Commanding Officer, the incident is of sufficient gravity, he shall notify the Deputy Chief or the Fire Chief regardless of the hour. In addition, he shall take any immediate action necessary to preserve the integrity of the department until the arrival of a Deputy Chief or Fire Chief. 3. INVESTIGATIONS OF ALLEGED MISCONDUCT: The officer assigned the investigation of an alleged act of misconduct on the part of a member of the Department shall conduct a thorough and accurate investigation. Such investigation shall include formal statements from all parties concerned, when necessary and pertinent, the gathering and preservation of physical evidence pertaining to the case, and all other information bearing on the matter. 4. REPORTS OF INVESTIGATION OF ALLEGED ACTS OF MISCONDUCT: Alleged acts of misconduct must be investigated and the results of the investigation must be reduced to a written report. The investigating officer shall summarize the pertinent facts including: (a) An abstract (summary) of the complaint of the alleged act of misconduct. (b) Pertinent portions of the statements of all parties to the incident. (c) A description of the incident, physical evidence, and other evidence important to the case. (d) The observations and conclusions of the investigating Officer. 5. FINDINGS: One of the findings listed below will be included in the report of investigation of an alleged act of misconduct: (a) Unfounded: The investigation indicates that the act or acts complained of did not occur or failed to involve fire personnel. (b) Exonerated: Acts did occur, but were justified, lawful, and proper. (c) Not Sustained: Investigation fails to discover sufficient evidence to clearly prove or disprove the allegations made in the complaint. (d) Sustained: The investigation disclosed sufficient evidence or clearly prove the allegations made in the complaint. (e) Not Involved: Investigation established that the individual receiving this "Report of Findings" was not involved in the alleged incident.
