CRIME RESEARCH AND ANALYSIS CENTER | LECTURE: DIDM INVESTIGATION SOLUTIONS ENHANCED E-WARRANT SYSTEM ENHANCED E-WARRANT SYSTEM Enhanced E-Warrant System is a system where the courts electronically issue all arrest warrants to PNP units concerned for implementation. It also provides a real-time status of arrest warrants since the courts are the ones that issue the same and can be accessed and updated through the system by all police units nationwide. CRIME RESEARCH AND ANALYSIS CENTER | LECTURE: DIDM INVESTIGATION SOLUTIONS NATIONAL POLICE CLEARANCE SYSTEM (NPCS) SALIENT PROVISIONS The PNP shall design, implement, and continuously enhance the NPCS, which will henceforth issue the NPC with a validity of six months from the date of issuance. The NPC may be renewed without appearance for three years from the last appearance, provided that necessary requirements are provided. CRIME RESEARCH AND ANALYSIS CENTER | LECTURE: DIDM INVESTIGATION SOLUTIONS SALIENT PROVISIONS The records of applicants for police clearances shall be cross- referenced with the existing crime-related databases of the PNP; All PNP stations/units shall ensure the prompt encoding and updating of their respective entries in the crime-related databases. The Chiefs of Offices, immediate supervisors and Crime Registrars shall ensure the accuracy, completeness, and timeliness of the information encoded in the IS; CRIME RESEARCH AND ANALYSIS CENTER | LECTURE: DIDM INVESTIGATION SOLUTIONS SALIENT PROVISIONS All NPCS-enabled police stations shall strictly issue the NPC only and shall not collect any other fees aside from the authorized online payment through the system. CRIME RESEARCH AND ANALYSIS CENTER | LECTURE: DIDM INVESTIGATION SOLUTIONS SALIENT PROVISIONS All trained NPCS personnel shall not be removed from their post without just cause for a minimum period of three years. COPs shall also ensure that no concurrent designation/s will be given to all NPCS personnel under their supervision. Blotter records (CIRAS) will not be reflected for a certain period based on the date reported. Traffic incidents and violations, Reckless Imprudence Resulting to Damage to Property and Slight Physical Injuries, shall not be reflected in the NPCS but Reckless Imprudence Resulting to Serious Physical Injuries and Homicide shall be reflected CRIME RESEARCH AND ANALYSIS CENTER | LECTURE: DIDM INVESTIGATION SOLUTIONS SALIENT PROVISIONS The access to the information maintained and accessed by the NPCS shall only be limited to NPCS personnel. All NPCS personnel who have accessed the information from the NPCS and other related systems and databases shall maintain the confidentiality of all information therein and ensure that such are free from information leakage. CRIME RESEARCH AND ANALYSIS CENTER | LECTURE: DIDM INVESTIGATION SOLUTIONS NPCS TEAM COMPOSITION Every NPCS enabled police stations shall have the following trained NPCS personnel: Two Clearance PNCOs/NUP Two Verifiers (PNCOs) Two Help Desk PNCOs CRIME RESEARCH AND ANALYSIS CENTER | LECTURE: DIDM INVESTIGATION SOLUTIONS NPCS PERSONNEL COMPETENCY All NPCS personnel shall have undergone NPCS User’s Training conducted by the DIDM and shall have corresponding certification signed by TDIDM. Personnel who are not NPCS User’s Training trained are not allowed to process or be designated as NPCS personnel. CRIME RESEARCH AND ANALYSIS CENTER | LECTURE: DIDM INVESTIGATION SOLUTIONS CASE INFORMATION DATABASE MANAGEMENT SYSTEM (CIDMS) CASE INFORMATION DATABASE MANAGEMENT SYSTEM (CIDMS) Case Information and Database Management System (CIDMS) is a web-based system designed to establish a central database system of pertinent information on all cases handled and investigated by Investigator On Case (IOCs) of the Philippine National Police (PNP). It aims to efficiently record and monitor case information, case status, evidence, evidence custodians, and PNP personnel who handled the cases as well as to provide statistical reports and case information needed by the higher management. CRIME RESEARCH AND ANALYSIS CENTER | LECTURE: DIDM INVESTIGATION SOLUTIONS CASE INFORMATION DATABASE MANAGEMENT SYSTEM (CIDMS) The system specifically helps IOCs to on the following: Efficiently record case information and details allowing easy retrieval of needed information and provide immediate response to queries of higher-level management. Easily determine and fast-track case status/progress from its filling date up to the promulgation of the court decision. Track and monitor the pieces of evidence, evidence custodians and PNP personnel who handle the case. CRIME RESEARCH AND ANALYSIS CENTER | LECTURE: DIDM INVESTIGATION SOLUTIONS CASE INFORMATION DATABASE MANAGEMENT SYSTEM (CIDMS) Record digital copies of the case folders to serve as a backup in case of loss, fire, flood, natural calamity or disaster and to avoid the voluminous hard copy of records stored at the office. Provide easy access or viewing of information for Investigators for cross-referencing of various cases during investigations. Generate and print various statistical reports (by period, by case status, by crime committed, etc.) needed by the stakeholders. CRIME RESEARCH AND ANALYSIS CENTER | LECTURE: DIDM INVESTIGATION SOLUTIONS CRIME INFORMATION REPORTING AND ANALYSIS SYSTEM (CIRAS) CRIME STATISTICS PNP COUNTING MECHANISM REFERENCES: PNP MC NO. 2018-050 ENTITLED “GUIDELINES AND PROCEDURES IN REPORTING CRIME INCIDENTS” PNP MC NO. 2020-051 ENTITLED “AMENDMENT OF THE TERMINOLOGIES OF THE PNP MC NO. 2018-050 ENTITLED, “GUIDELINES AND PROCEDURES IN REPORTING CRIME INCIDENTS” AND ITS SUPPLEMENTAL GUIDELINES” PNP MC NO. 2021-141 ENTITLED “GUIDELINES AND PROCEDURES IN REPORTING, RECORDING, MONITORING AND DISPOSITION OF CYBERCRIME AND CYBER-RELATED INCIDENTS” DIDM Investigative Directive (ID) No. 2022-001 ENTITLED “ENCODING OF SUICIDE AND SELF-ACCIDENT IN THE CRIME INFORMATION, REPORTING AND ANALYSIS SYSTEM (CIRAS)” KATARUNGANG PAMBARANGAY CRIME RESEARCH AND ANALYSIS CENTER | LECTURE: DIDM INVESTIGATION SOLUTIONS CRIME STATISTICS Crime Statistics are numbers collected by the government to show how much crime is happening in a certain place and time. It helps in understanding what types of crimes are happening more often and where crime prevention strategies should be strengthened or intensified. Crime statistics can be a tool in helping criminal justice professionals anticipate increased risk of crime. This can be followed up by law enforcement intervention to prevent the predicted crimes from occurring. CRIME RESEARCH AND ANALYSIS CENTER | LECTURE: DIDM INVESTIGATION SOLUTIONS CRIME INFORMATION REPORTING AND ANALYSIS SYSTEM (CIRAS) CIRAS is a database that serves a repository of all crime incidents being recorded nationwide. It sets a standard procedure for the recording of crimes reported to the police stations, which enables the NHQ to access local data real time. Incident Report Form (IRF) is the output of CIRAS, which contains the information a certain case including data of complainant, victim, suspect, case details and narrative. CRIME RESEARCH AND ANALYSIS CENTER | LECTURE: DIDM INVESTIGATION SOLUTIONS RECORDING OF CRIME INCIDENTS As a general rule, the recording of crime incidents shall be per the provisions of the Revised Penal Code and Special Laws. It does not include city or municipality ordinances, Katarungang Pambarangay (KP) Cases (unless with CTF), and Other Law Enforcement Agencies (OLEA). CRIME RESEARCH AND ANALYSIS CENTER | LECTURE: DIDM INVESTIGATION SOLUTIONS Total Number of Crimes Peace and Order Public Safety Indicator (POI) Indicator (PSI) PEACE AND ORDER INDICATOR (POI) POI incidents are crime incidents that reflect the true picture of crime, and the peace and order situation of a particular community. CRIME RESEARCH AND ANALYSIS CENTER | LECTURE: DIDM INVESTIGATION SOLUTIONS INDEX CRIME Refers to the CONSUMMATED Eight (8) Focus Crimes and Special Complex Crimes as defined by the Revised Penal Code. A. 8 Focus Crimes 1) Murder 2) Homicide 3) Physical Injuries - including Less and Serious Physical Injuries RPC 4) Rape 5) Robbery 6) Theft Special 7) Carnapping MV Laws 8) Carnapping MC B. Special Complex Crimes (Composite Crimes) CRIME RESEARCH AND ANALYSIS CENTER | LECTURE: DIDM INVESTIGATION SOLUTIONS TYPES OF COMPLEX CRIME Special Complex Crime (Composite Crime/Single Indivisible Crime) is composed of two or more crimes but is specifically defined, treated, and punished as a single indivisible offense. RPC-based Special Complex Crime includes: a) Rape with Homicide (5th para of Art 266-B of RPC) b) Kidnapping with Homicide (last para of Art 267 of RPC) c) Kidnapping with Rape (last para of Art 267 of RPC) d) Robbery with Homicide (Art 294 of RPC) e) Robbery with Serious Physical Injury (Art 294 of RPC) f) Robbery with Rape (Art 294 of RPC) g) Robbery with Arson (Art 294 of RPC) h) Arson with Homicide (Art 320 of RPC) CRIME RESEARCH AND ANALYSIS CENTER | LECTURE: DIDM INVESTIGATION SOLUTIONS ADDITIONAL CRIMES CATEGORIZED UNDER INDEX CRIMES As per PNP MC No. 2020-051, the following crimes shall be considered and included in the counting of index crimes: 1) Carnapping with Homicide; 2) Carnapping with Rape; and 3) Other violations of special laws with the same nature as special complex crimes. CRIME RESEARCH AND ANALYSIS CENTER | LECTURE: DIDM INVESTIGATION SOLUTIONS NON-INDEX CRIME Violation of Special Laws and RPC that are NOT categorized as Index Crimes are categorized as Non-Index Crimes. Also included under this category are Attempted and Frustrated stages of Index Crimes. CRIME RESEARCH AND ANALYSIS CENTER | LECTURE: DIDM INVESTIGATION SOLUTIONS PEACE AND ORDER INDICATOR (POI) INDEX NON-INDEX CRIMES CRIMES PUBLIC SAFETY INDICATOR (PSI) PSI are incidents and culpable felonies that reflect the public safety situation of a particular community. This comprises the totality of vehicular incidents and other quasi-offenses punishable under the RPC. CRIME RESEARCH AND ANALYSIS CENTER | LECTURE: DIDM INVESTIGATION SOLUTIONS TRAFFIC VIOLATIONS AND TRAFFIC INCIDENTS 1. All Traffic Violations under the Land Transportation and Traffic Code (RA No. 4136) and other Special Laws shall be recorded in the CIRAS. 2. Vehicular Incidents shall be recorded in CIRAS regardless of the resulting consequences and outcome (death, physical injuries, or damage to properties). 3. Traffic cases in violation of provincial, city, or municipal ordinances shall not be recorded in the CIRAS. CRIME RESEARCH AND ANALYSIS CENTER | LECTURE: DIDM INVESTIGATION SOLUTIONS OTHER QUASI-OFFENSES Culpable felonies as a product of negligence, imprudence, lack of skill and/or lack of foresight punishable under Art 365 of the RPC other than vehicular incidents. Article 365 of the Revised Penal Code (RPC) punishes the quasi-offenses of "imprudence" and "negligence." It defines reckless imprudence as voluntarily, but without malice, doing or failing to do an act from which material damage results by reason of inexcusable lack of precaution on the part of the person performing or failing to perform such act, taking into consideration his/her employment or occupation, degree of intelligence, physical condition and other circumstances regarding persons, time, and place. While chasing the snatcher in the presence of so many people, you fired your gun towards the snatcher, but you did not hit the snatcher. It hit a bystander and died. What is the crime committed? reckless imprudence resulting in homicide. you are reckless in firing your gun in the presence of many people. CRIME RESEARCH AND ANALYSIS CENTER | LECTURE: DIDM INVESTIGATION SOLUTIONS PUBLIC SAFETY INDICATOR (PSI) VEHICULAR TRAFFIC OTHER INCIDENTS QUASI-OFFENSES CRIMES CLEARED, CRIMES SOLVED, AND CRIME RATE CRIME CLEARED A crime shall be considered cleared when: a. At least one of the offender(s) has been identified; b. There is sufficient evidence to charge him; and c. He has been charged before the prosecutor’s office or any other court of appropriate jurisdiction. CRIME RESEARCH AND ANALYSIS CENTER | LECTURE: DIDM INVESTIGATION SOLUTIONS CLEARANCE EFFICIENCY (CE) Clearance Efficiency (CE) is the efficiency of the police expressed in percentage as to the number of crimes cleared by the police out of the total number of crime incidents that are recorded into the police blotter for a given period. The offender has been identified; 2. There is sufficient evidence to charge him; 3. The offender has been taken into custody; and 4. The offender has been charged before the prosecutor’s office or court of appropriate jurisdiction. When the victim refuses to prosecute after the offender is identified; b. The offender dies; or c. The offender absconds. CRIME RESEARCH AND ANALYSIS CENTER | LECTURE: DIDM INVESTIGATION SOLUTIONS PARAMETERS TO CONSIDER A CYBERCRIME AND CYBER-RELATED CASE “SOLVED” A case shall be considered solved under the criteria of “beyond police control” when the following circumstances are present: 1) Failure of the complainant to submit evidentiary requirements; 2) Complainant declines to prosecute cases; 3) Complainant merely requests to record the incident; 4) Complainant only requests to deactivate a fake/dummy account or delete pornographic video/picture and/or video in websites; and 5) Complainant cannot be found despite diligent and reasonable efforts of the PNP. RAPE Multiple counts of rape reported in a single blotter entry shall be recorded and counted as one offense of rape, but the number of counts the rape was committed shall be indicated. Example: Dennis raped Rosario on February 14, 18, and March 22. Rosario reported to WCPD on March 23 to narrate the incident and file a complaint. It shall be counted as one offense of rape, but the number of counts the rape was committed shall be reflected in CIRAS CRIME RESEARCH AND ANALYSIS CENTER | LECTURE: DIDM INVESTIGATION SOLUTIONS RAPE Incident committed by several perpetrators on single occasion, shall be recorded and counted as one offense of rape indicating the number of counts the rape was committed and name of perpetrators. Example: Mario, Carlo, and Ron gang raped Rona on February 14. Rona reported the incident to WCPD. It shall be counted as one offense of rape, but the number of counts the rape was committed and the number or perpetrators shall be reflected in CIRAS. CRIME RESEARCH AND ANALYSIS CENTER | LECTURE: DIDM INVESTIGATION SOLUTIONS RAPE Rape committed in several places with different territorial jurisdiction and reported in a single blotter entry shall be recorded by the territorial unit which first took cognizance of the complaint. Example: Mark raped Lily on February 22 in Tagaytay City, and on March 22 in Sta Rosa City. Lily reported to WCPD of Sta Rosa CPS on March 23 to narrate the series of incidents and file a complaint. It shall be counted as one offense of rape by Sta Rosa CPS which first took cognizance of the complaint. CRIME RESEARCH AND ANALYSIS CENTER | LECTURE: DIDM INVESTIGATION SOLUTIONS ABANDONED AND FOUND CONTRABAND The crime established based on the result of investigation in relation to abandoned and found lumber, illegal drugs, firearms and other contrabands shall be counted as such. Example: Violation of Presidential Decree No. 705 “The Forestry Reform Code of the Philippines” CRIME RESEARCH AND ANALYSIS CENTER | LECTURE: DIDM INVESTIGATION SOLUTIONS RA 9165 RA No. 9165 otherwise known as “Comprehensive Dangerous Drugs Act of 2002” shall be treated and included under the Non-Index Crime category, as provided in the definition of Non-Index Crimes. CRIME RESEARCH AND ANALYSIS CENTER | LECTURE: DIDM INVESTIGATION SOLUTIONS COMPOUND CRIME The grave and less grave felonies as the result of the single act shall be recorded Example of compound crime: Murder and Frustrated Murder Mr. Yap with intent to kill threw a hand grenade to Mr. Cruz and Mr. Lee who were attending a meeting. As a result, Mr. Cruz died on the spot while Mr. Lee survived despite sustaining fatal injuries. The crime of Murder and Frustrated Murder shall be recorded. CRIME RESEARCH AND ANALYSIS CENTER | LECTURE: DIDM INVESTIGATION SOLUTIONS COMPLEX CRIME PROPER The crime to be recorded shall be the one primarily intended by the suspect to commit , and not the crime which was used as a means to commit the other. Example of complex crime proper: Forcible Abduction with Rape – the victim was abducted as a means for the commission of the crime of rape. The crime of rape which is the one primarily intended by the suspect to commit shall be recorded. Estafa thru Falsification – the suspect committed falsification as a means to commit estafa. The crime of estafa which is the one primarily intended by the suspect to commit shall be recorded. CRIME RESEARCH AND ANALYSIS CENTER | LECTURE: DIDM INVESTIGATION SOLUTIONS MULTIPLE CRIMES The number of crimes to be recorded shall be based on the separate and distinct crimes committed and several victims offended. Example: Cardo robbed a convenience store. In order to facilitate his escape, he carnapped a car at the parking lot. While being chased by a mobile car, he ran over a crossing pedestrian who died on the spot. The next day, Cardo was cornered by the police in an abandoned warehouse thus, held hostage an elderly woman inside. As such, he committed the following crimes: robbery, reckless imprudence resulting in homicide, carnapping and serious illegal detention. CRIME RESEARCH AND ANALYSIS CENTER | LECTURE: DIDM INVESTIGATION SOLUTIONS CONTINUING CRIME The incident should be recorded as a single crime by the Police Unit with the territorial jurisdiction that first took cognizance of the crime. Example: Robbery of a Bus – A robbery incident transpired inside a bus while traversing Mandaluyong, San Juan and Quezon City. As a continuing crime, the said robbery incident shall be recorded by the Police Unit with the territorial jurisdiction which first took cognizance of the case. If by any cause the Quezon City Police first took cognizance of the crime, then the same shall acquire jurisdiction and record the incident. CRIME RESEARCH AND ANALYSIS CENTER | LECTURE: DIDM INVESTIGATION SOLUTIONS ACT VIOLATES MORE THAN ONE LAW In case an act violates more than one law, all the laws violated shall be recorded Example: Jorgia is a pick-pocket. As a punishment for the several thefts committed by Jorgia, she was beaten heavily by Van, a law enforcer. Jorgia was hospitalized for 3 months because of the beating she suffered. As a result, Van violated Article 263 of the RPC (Serious Physical Injuries) and the Anti-Torture Law. Thus, Physical Injury and violation of the Anti-Torture law will be recorded. CRIME RESEARCH AND ANALYSIS CENTER | LECTURE: DIDM INVESTIGATION SOLUTIONS VIOLATIONS OF LOCAL ORDINANCES Violation of provincial, city, municipal and barangay ordinances shall not be counted due to its non-applicability nationwide and the same is not considered as crime. CRIME RESEARCH AND ANALYSIS CENTER | LECTURE: DIDM INVESTIGATION SOLUTIONS FRUSTRATED AND ATTEMPTED STAGES Shall be recorded as it is, i.e. Attempted Murder shall be recorded as Attempted Murder and Frustrated Murder shall be recorded as Frustrated Murder based on the Revised Penal Code (RPC). CRIME RESEARCH AND ANALYSIS CENTER | LECTURE: DIDM INVESTIGATION SOLUTIONS FOUND CADAVER In cases of found dead body of a person as possible result of a crime, the incident shall be initially treated either murder or homicide based on the presence of pieces of evidence and/or elements indicating the crime committed, to be updated later as murder, homicide or non-crime incident through the result of the final investigation. CRIME RESEARCH AND ANALYSIS CENTER | LECTURE: DIDM INVESTIGATION SOLUTIONS REPORTED MISSING PERSON Incident of reported missing person who was not located after 24 hours and missing children shall be recorded initially as non-crime. However, if such missing person or missing child is believed to be a victim of violence and crime like kidnapping, abduction, enforced disappearance, human trafficking and others, then it shall be recorded accordingly. CRIME RESEARCH AND ANALYSIS CENTER | LECTURE: DIDM INVESTIGATION SOLUTIONS CATTLE RUSTLING Cattle Rustling under LOI UCPER 02/09 shall now be delisted from the category of Index Crime and shall be treated as Non- Index Crime. Owing to the advancement in technology and with the introduction of various modern farm implements, the carabao/cattle has ceased to become an indispensable “beast of burden” among farmers which is now considered as mere livestock used as source of meat in the cattle industry. As observed, the number of theft committed on cattle has decreased for the past years CRIME RESEARCH AND ANALYSIS CENTER | LECTURE: DIDM INVESTIGATION SOLUTIONS SUICIDE, PARRICIDE & INFANTICIDE Suicide and Self Accident incidents shall be recorded but categorized as non-crime, due to its potentiality to be considered as a crime as a case progresses. (Reference: Investigative Directive No. 2022-02) Parricide and Infanticide shall be recorded as it is and be counted in the category of murder. CRIME RESEARCH AND ANALYSIS CENTER | LECTURE: DIDM INVESTIGATION SOLUTIONS SERVICE OF WARRANT Should not be counted as a crime but instead an update of that specific case and the same shall be reflected in the CIDMS and e-Wanted Person Information System (e-Warrant). By updating the status of the arrested suspect, the subject crime of the warrant of arrest will be updated/ counted as solved. CRIME RESEARCH AND ANALYSIS CENTER | LECTURE: DIDM INVESTIGATION SOLUTIONS POLICE/MILITARY OR ANY LAW ENFORCEMENT AGENCIES OPERATIONS In an operation wherein government troops/personnel were killed in action (KIA) by enemy forces, a Homicide or Murder case could be counted against the identified perpetrators depending on the result of the investigation. If an enemy force attacked police/military or government troops and the member of the latter was/were killed, a murder case shall be counted against them. Further if the suspect died during an armed encounter, it shall be recorded but not be counted in the CIRAS on the ground of the presumption of regularity in the performance of duty. CRIME RESEARCH AND ANALYSIS CENTER | LECTURE: DIDM INVESTIGATION SOLUTIONS KATARUNGANG PAMBARANGAY (KP) CASES Incidents initially reported to the police station but referable and within the jurisdiction of the Katarungang Pambarangay for conciliation and arbitration shall not be recorded in the CIRAS. However, if the parties failed to settle at the barangay and were referred back to the Police with a Certificate to File Action, the Police Station shall then take cognizance of the case and include it in the CIRAS of the station. The crime registrar shall advise the designated liaison officer to delist the case from the record of the Barangay.
