HARDWICK, SHERIFF No Expectation of Privacy Policy 26.10 Effective Date: 06/30/2006 Amended Date: 11/04/2022 Reviewed Date: 05/10/2023 ACCREDITATION STANDARDS CALEA: CFA: FCAC: FLA-TAC: FMJS: Discussion: This policy applies to all St. Johns County Sheriff’s Office personnel and establishes policy for the agency’s protection program as it relates to different types of civil claims which may be brought against the Sheriff and agency employees. DEFINITIONS Agency – Refers to St. Johns County Sheriff’s Office Containers – Any box, drawer, purse, computer file, bag, backpack, duffle bag, gym bag or any other container, whether open or locked / sealed, stored on or carried into the Sheriff’s Office facilities / property or Sheriff’s Office vehicles. Communications – Oral, written correspondence or notes and any electronic communications. Expectation of Privacy – The expectation of an individual that their possessions are secure from search or disclosure by unauthorized persons. Inspection – To examine in detail which includes searching. Facilities – Means any area, office, vehicle, locker, desk or equipment under the control of the Sheriff or provided to the agency in order to perform an employee’s assignment such as in a school or private office. No Expectation of Privacy 26.10 Page 1 of 2 GENERAL.1 The Sheriff is responsible for the integrity of the agency’s facilities and equipment. Therefore, the Sheriff reserves the right to inspect, with or without notice, any area, facility or equipment / containers being kept in or on Sheriff’s Office property, vehicles or equipment. EMPLOYEE EXPECTATION OF PRIVACY.2 Employees have no expectation to privacy regarding any of their verbal, written or electronic communications while utilizing Sheriff’s Office facilities, vehicles or equipment..3 All written and recorded communications are considered public records as defined in FS 119..4 The Sheriff reserves the right to monitor all verbal, written and electronic communications coming into or originating out of or from the Sheriff’s Office telephones, radio, computers or other electronic equipment..5 Any employee refusing access to, or to open / unlock any office, desk, cabinet, locker, container, vehicle, computer or other equipment after being requested or ordered to do so, shall be subject to disciplinary action for refusing to obey a lawful command. ____________________ Robert A.
