Military Leave Policy
- Spring Fire Department is committed to protecting the job rights of employees absent on military leave
- The policy applies to all employees in various military duties, including Reservists, National Guard members, active military service, attending examinations for military service, and funeral honors duty.
- Benefits are generally limited to five years of leave of absence, within exceptions of applicable laws.
- Employees should provide notice of leave as far in advance as possible, written preferred but not required.
- A Request for Leave of Absence Form is generally required but not legally necessary.
- Human Resources will review the form, process insurance premiums and generate other applicable documents.
- Employees receive base salary for the first 31 days of leave, and have the option to use any accrued paid vacation or personal leave.
- When returning to work, the employee must make an application for reemployment within a specific time frame.
Benefits During Military Leave
- Extended military leave employees may elect to continue health insurance for themselves and their dependents for up to 31 days, with the employee covering the premium.
- After 31 days, the employee and dependents can continue insurance for up to 24 months, at COBRA rates.
- Group life/AD&D insurance terminates when the employee becomes active military.
- The group long-term disability insurance terminates when the employee becomes active military.
- Employees do not accrue vacation, personal or sick leave while on military leave.
- Voluntary supplemental life/AD&D insurance terminates when the employee becomes active military. Dependents may convert to individual policies with a written application and premium payment within 31 days of termination.
Reemployment Upon Military Leave
- Employees are reinstated based on their period of military service, aiming to position them in the job they would have held if not for the leave.
- Employees with less than 91 days of service are re-employed in their prior position or a "like" position, if they are unable to perform duties of the original role.
- Employees with more than 90 days and less than 5 years of service are placed in a position they would have attained or a position of like seniority, status, pay, and duties, if they are qualified. If not qualified, the employee is placed in their original position or a "like" position.
- Employees with service-connected disabilities are employed in a similar position, or the nearest approximation if no such position exists, following reasonable accommodation efforts.
Application for Reemployment
- Employees with less than 31 days of service must report for reemployment on the first full working day after the expiration of 8 hours after a time of safe transportation back to the employee's residence.
- Employees with 31 days to 180 days of service must submit an application for reemployment within 14 days of completion of service.
- Employees with over 180 days of service must submit an application within 90 days of completion of service.
- Employees hospitalized or convalescing from a service-connected injury have up to 2 years after completion of service to apply for reemployment.
Exceptions to Reemployment
- An employee may not be reinstated if:
- Spring Fire Department's circumstances have significantly changed making reemployment impossible.
- Reemployment would create an undue hardship for Spring Fire Department.
- The employee's original employment was for a brief, non-recurrent period with no expectation of continuation.
- The employee did not receive an honorable discharge from military service.
General Benefits Upon Reemployment
