Policy Des Plaines Police Department 506 Des Plaines PD Policy Manual Notice of Parking Violation Appeal Procedure 506.1 PURPOSE AND SCOPE This policy outlines the procedure for processing the parking violation notice appeals. Disposition of notice of parking violation appeals is conducted pursuant to Illinois state law. 506.2 RESPONSIBILITIES The Support Services Manager shall be responsible for all parking violation notice appeals and hearings. 506.3 APPEAL STAGES Appeals may be pursued sequentially at three different levels: (a) Administrative reviews are conducted by the Support Services Manager or his/her designee, who will review written/documentary data. Requests for administrative reviews are available at the front desk or the Records Section of the Des Plaines Police Department. Requests for administrative reviews are available for specific parking violations. If an administrative review cannot be conducted for a parking violation, the party may request a date to attend an administrative hearing. Copies of documentation relating to the notice of parking violation and the request for dismissal must be attached to the request for an administrative review and will be retained by the Police Department. (b) If the appellant wishes to pursue the matter beyond administrative review, an administrative hearing may be conducted in person at the election of the appellant. (c) After an administrative hearing, any party may appeal the order to the Circuit Court of Cook County within thirty five (35) days of the entry of the order. 506.4 TIME REQUIREMENTS Administrative review or appearance before a hearing officer will not be provided if the mandated time limits are not adhered to by the violator. (a) Requests for an administrative review must be completed at the Police Department within twenty one (21) days of issuance of the notice of parking violation. (b) Requests for administrative hearings must be made in writing and are available at the front desk or the Records Section of the Des Plaines Police Department. If a date has already been assigned to the parking violation, the party will be notified.. (c) Requests for appeal to the Circuit Court of Cook County must be made within thirty five (35) days of the entry of the order. (d) Registered owners of leased or rented vehicles may transfer responsibility for the violation to the lessee or renter of the vehicle at the time of the violation if the name, Copyright Lexipol, LLC 2024/02/13, All Rights Reserved.
