www.kenyamodelun.or.ke [email protected] [email protected] Tel: (+254)-707-669-015 Tel: (+254)-111-940-192 KENYA MODEL UNITED NATIONS INTERNATIONAL LAW COMMISSION 24TH SESSION PROCESS OF CONSIDERATION PROCESS OF CONSIDERATION In the International Law Commission, the following shall be the Process of Consideration in the Plenary: (i) Preliminary Stage (ii) First Reading (iii) Second Reading (iv) Adpotion Stage (i) Preliminary Stage The Chair of the International Law Commission shall delegate members of the Bureau a Rapporteurship role, and assign thematic areas from which, through extensive research, study and consultation, would prepare their findings in the form of a report and formulate a background guide that would be used for the respective mock debates or conference. This report is presented orally by the Rapporteur in the Plenary. The research, findings, preparation of background guides and report and other preliminary issues would constitute the Preliminary Stage. It is on the basis of these findings, the background guide and report that the consideration and deliberation in the Plenary is tailored from. (ii) First Reading This shall form the gist of the Plenary, and the Rules of Procedure (as reviewed) shall be strictly followed, and commissioners shall be assessed as per the Oral Assessment Form. To ensure that the issue of time is addressed, and a quality Plenary is achieved, the Plenary shall be limited to persons who had submitted their Draft Articles. (iii) Second Reading Commissioners shall deeply discuss, in an informal set up and in five (5) working groups, on the recommendations from their Draft Articles and from the Plenary, and formulate the ILC Draft Principles based on the Guidelines on ILC Principles provided. The Rapporteurs shall consider and award commissioners on such recommendations and knowledge of the Guidelines on ILC Principles. (iv) Adoption Stage The ILC Draft Principles are presented before the Plenary and voted upon by commissioners. The Draft Principles shall require a simple majority vote to pass, and shall thereafter be adopted as ‘ILC Principles on…’ The ILC Principles as voted on and adopted shall be passed to the Codification Division and the Chair of the International Law Commission for final approval.
