II. III. IV. V. VI. VII. PURPOSE POLICY DEFINITIONS CALL-OUT RESPONSIBILITIES CIRCUMSTANCES WARRANTING CALL-OUT REQUESTS FOR SPECIALIZED MEMBERS (NOT ON-CALL) CALL-BACK OF DEPARTMENT MEMBERS I. PURPOSE The purpose of this order is to establish procedures for the call-out or call-back of detectives, traffic homicide investigators, and other members of the department for certain serious crimes and/or exigent circumstances or events outside of normal duty hours. II. POLICY The Oviedo Police Department recognizes that certain crimes and circumstances require the expertise of specially trained members; therefore, it is the policy of the Oviedo Police Department to maintain rotation lists of members who are compensated in order to be deemed on-call and who are prepared to respond during their designated on-call period. Members designated to be on-call are responsible for ensuring they may be contacted by a supervisor to respond as their assignment/position requires. On-Call: A member who is compensated to ensure a prompt response in the event of a call-out for any operational needs which may occur outside of regular duty hours. B. Call-Out: To summon an “on-call” member to respond to an on-duty status. C. Call-Back: To call a member back to an on-duty status or to be subject to a schedule change with minimal notice in the event of a natural disaster, public safety emergency, or other critical public safety situation. All operational and support members, both sworn and civilian, are subject to call-back. CALL-OUT RESPONSIBILITIES A. Responsibilities of Members in an On-Call Status: 1. Members compensated to be on-call during a specified period of time shall be prepared and available to respond in a timely manner to a call-out when notified. 2. While on-call, members shall: a. Be immediately available by telephone; b. Comply with all requirements to be prepared to report for scheduled work hours, including refraining from the use of alcoholic beverages; and c. When away from home, have all equipment available to allow a timely response; and not travel farther than would allow the member to respond to the City of Oviedo within one (1) hour. Shift supervisors will make the notification call. Officers may make telephone contact with supervisors of on-call members only when authorized to do so by the on-duty shift supervisor. 2. After normal business hours, officers are authorized to contact detectives who have previously requested to be notified at any time about new information or events that may pertain to a case. The shift supervisor is to be advised when such after-hours contacts are made. 3. Contact with supervisors of on-call members (for the purpose of determining response) should not be made until the on-duty shift supervisor has sufficient information to assess the situation and authorize the call. 4. When on-call members have been notified and are responding, suspects/arrestees should only be questioned or advised of constitutional rights by patrol officers when authorized by the responding detective or Criminal Investigations supervisor. 5. The initial responding officer(s) assigned to a major crime scene shall not be released prior to the detective’s arrival unless such relief is authorized by the detective or a supervisor. Responsibilities of Shift Supervisors: 1. When a request to call-out members is made by an officer, prior to initiating the call-out, the shift supervisor shall when possible, respond to the incident scene to assess the situation. The shift supervisor shall be responsible for determining whether the situation complies with the guidelines established in this general order. 2. The shift supervisor shall contact the unit supervisor of the on-call member(s) and inform them of the situation. Once approval is granted from the unit supervisor, the on-call member(s) may be contacted. 3. Whenever a search warrant is required, Criminal Investigations personnel and/or Community Response Team personnel must be contacted prior to the seeking of the warrant. Appropriate members shall respond to assist in obtaining the warrant. GO 6-2.0 Call-Outs/Call-Backs Oviedo Police Department GO 6-2.0 Call-Outs/Call-Backs D. Responsibilities of Supervisors of Specialty Positions/Units: 1. 2. V. Page 4 of 8 Appropriate specialty unit supervisors are responsible for maintaining a current schedule of members assigned to specialized positions/units, to include, but not be limited to: a. Detectives – Lieutenant; b. Traffic Homicide Investigators – provided by Traffic Sergeant; and c. Special Response Team (SRT) Members – provided by SRT Commander. provided by Criminal Investigations SCSO Communications maintains contact numbers for other local jurisdictions’ tactical teams and crisis negotiators, for incidents when requests for those services may be made to other jurisdictions with which Oviedo Police Department has a signed mutual aid agreement. Homicides; Serious injury from criminal offense(s) (other than traffic) where hospitalization is required and death is possible; Suspicious death; Accidental death/Unattended death; Suspected suicides; Missing endangered adult or juvenile; Home invasion robberies; Shootings involving injury; Officer involved shootings resulting in an injury; Robberies involving a weapon; Domestic or dating violence when the suspect cannot be located and there is a high probability of victim lethality unless apprehended; Aggravated stalking when the suspect cannot be located and there is a high probability of victim lethality unless apprehended; Burglaries with a suspect in custody, except domestic disputes; Abduction/kidnapping; Sexual or aggravated physical child abuse; Child pornography cases; Elderly abuse cases involving serious neglect or endangerment; Sexual battery or attempted sexual battery; GO 6-2.0 Call-Outs/Call-Backs Oviedo Police Department GO 6-2.0 Call-Outs/Call-Backs 19. 20. 21. 22. 23. Fraud and forgery cases when a suspect has been detained or is in custody; When a suspicious device, explosive, or incendiary device is discovered; Suspected arson; When a search warrant is required; or Other incidents as determined by the shift supervisor. Traffic Homicide Investigators: 1. 2. 3. 4. VI. Page 5 of 8 Traffic fatalities; Traffic accidents with serious bodily injuries when there is a substantial risk of death occurring as a result of those injuries; Traffic accidents involving city vehicles when fault cannot be determined and/or serious personal injury to any occupant is reported; or Hit and run traffic accidents resulting in serious injury. REQUESTS FOR SPECIALIZED MEMBERS (NOT ON-CALL) A. Special Teams The on-duty shift supervisor may request the call-out of the Special Response Team (SRT) depending on the incident. B. The following circumstances warrant a call-out of SRT by an on-duty shift supervisor: 1. When a barricaded subject is holding or is suspected of holding one or more person(s) against their will and/or is threatening the lives or safety of others; 2. When a barricaded subject is believed to be or claims to be armed and refuses to surrender; 3. When a barricaded subject who refuses to surrender is armed, is threatening to take their own life, and has the apparent ability to do so; 4. When a sniper or terrorist is suspected or involved in an incident; or 5. When a command officer believes an SRT response is in the best interest of the department or the public. In the event SRT team members are not available to respond, the on-duty shift supervisor may request the assistance of special teams from other jurisdictions with which the Oviedo Police Department has a signed mutual aid agreement. D. K-9 Units: E. F. 1. K-9 unit(s) response may be necessary to help track a missing person or lost child; to track/capture a felony suspect; or to locate evidence in a felony crime; or other incidents as determined by the on-duty shift supervisor. 2. K-9 units may be called out with the approval of the shift supervisor or higher authority when no other K-9 unit(s) are on-duty and available at other nearby jurisdictions with whom the department has a signed mutual aid agreement. Technical Services Assistance: 1. The Criminal Investigations Section Lieutenant or designee may direct the call-back of the Oviedo Police Department Evidence Specialist or alternate for major investigations or to empty the evidence lockers when necessary. 2. The Criminal Investigations Section Lieutenant or designee may authorize a request for technical assistance from the Seminole County Sheriff’s Office and/or the Florida Department of Law Enforcement if the situation warrants such assistance necessary. Professional Standards Notification: 1. Professional Standards, along with the chain of command must be notified of the details of an incident as soon as possible when any of the following occurs: a. The discharge of a firearm by any department member (except approved target shooting or approved euthanizing of an animal; b. A vehicle pursuit involving a member when it results in serious injury or the death of any person; c. A use of force incident involving a member when it results in serious injury or the death of any person; GO 6-2.0 Call-Outs/Call-Backs Oviedo Police Department GO 6-2.0 Call-Outs/Call-Backs 2. G. Page 7 of 8 d. Any in-custody death of a person when it occurs while a subject is detained or under arrest by any member; or e. Any incident involving allegations of serious criminal acts on the part of a department member. (A serious allegation may require the involved member to be relieved from duty immediately pending an investigation). The type of response required by Professional Standards shall be determined by the Chief of Police or designee. Public Information Officer (PIO): The Public Information Officer, along with the chain of command must be notified of the details of an incident as soon as possible when any of the following occurs: H. VII. 1. When a situation involves heavy media exposure and/or members on scene of an incident need assistance with handling the media; and/or 2. Any situation where the presence of the PIO would be in the best interest of the department or the public. Police Chaplains: 1. A Police Chaplain may be requested for any situation where their presence is necessary to assist with consultation or a death notification. 2. A Police Chaplain may be requested through SCSO Communications with prior approval from the on-duty shift supervisor or higher authority. CALL-BACK OF DEPARTMENT MEMBERS A. Operational and support members, sworn and civilian, are on notice that every member of the police department is subject to call-back or subject to a schedule change with minimal notice in the event of a natural disaster, public safety emergency, or other critical situation as determined by the Chief of Police or designee. B. Department members contacted and called back to work or re-scheduled are to respond in a timely manner.
