9/7-00.00 REPORTS & RECORDS/PROCEDURES A 04-21 REPRIMAND F-1105 FORM NAME: REPRIMAND INITATED BY: Professional Standards Division NUMBER OF COPIES: Three PERIOD RETAINED: Permanently FORWARD: As needed REFERENCE: Manual of Operation, Vol. 2, 3/2-20.20 ROUTING: Part 1 – Member Part 2 – THROUGH CHANNELS to Professional Standards Division (PSD) Part 3 – THROUGH CHANNELS to PSD, then forwarded for inclusion in member’s personnel file at Personnel Services Section. APPLICATION: The Reprimand is to be used in case of serious or repeated violations that necessitate appropriate action and proper documentation. All Reprimands shall be written by PSD if, after a complete investigation into the violation, including any mitigating factors, PSD determines that a Reprimand is the most appropriate course of action. PSD will email the Reprimand to the member’s Bureau Commander with instructions for forwarding through channels to the member’s immediate supervisor. The member’s immediate supervisor shall print and sign three originals of the Reprimand and issue them to the member. The immediate supervisor shall discuss the violation, the Reprimand and any other corrective action being taken. The member will be allowed to have an employee representative present during the issuance of a Reprimand, if requested. The member shall be allowed a reasonable amount of time to secure such representation. The member shall sign, date and indicate concurrence and return two of the originals to the immediate supervisor. If the member refuses to sign the document, and/or refuses to check the concurrence or non-concurrence box, the supervisor shall sign two originals of the Reprimand in the member's presence (with date and time), documenting the member's refusal. 9/7-00.00 REPORTS & RECORDS / PROCEDURES A 04-21 PAGE 2 F-1105 The two signed originals are forwarded without delay, through channels, to PSD. PSD will retain one of the originals and forward the other to Personnel Services Section for insertion into the member’s personnel file. Per the Firefighters Procedural Bill of Rights Act, a member who does not concur with a Reprimand may request an administrative appeal challenging the Reprimand. In accordance with an agreement between the Department and UFLAC, the Grievance Procedure, as defined in Article 2.1 of MOU 23, shall be the method by which a member may appeal the Reprimand. The 15-calendar day period identified in Step 1 of the Grievance Procedure begins on the day following the day the Reprimand was presented to the member. During the period of time in which the appeal is proceeding through the Grievance Procedure, the two originals of the Reprimand shall be retained by PSD. If the appeal is approved, the two originals shall be returned to the member. If the member’s appeal is denied, the member shall have 30 calendar days to file a written response to the Reprimand. The written response shall be attached to, and shall accompany, the Reprimand into the member’s personnel file.
