Reprimand Procedure Overview
- Reprimand form (F-1105) is initiated by the Professional Standards Division (PSD).
- Issued in cases of serious or repeated violations requiring documentation.
- Three copies are created: one for the member, one for PSD, and one for the Personnel Services Section.
Document Routing Process
- Part 1: Member receives a copy.
- Part 2: Original routed through channels to PSD.
- Part 3: Another original sent to Personnel Services Section for personnel file retention.
Reprimand Issuance Steps
- PSD conducts a complete investigation before determining if a Reprimand is appropriate.
- Reprimand email sent to the Bureau Commander for further action.
- Immediate supervisor must print and sign three originals and discuss the violation with the member present.
- Members can have an employee representative during the Reprimand discussion, with reasonable time provided for securing representation.
Signing and Documentation
- Member signs two originals, either indicating concurrence or non-concurrence.
- If a member refuses to sign, the supervisor will document the refusal by signing in their presence, including date and time.
- Signed originals are then forwarded to PSD without delay.
Personnel File and Appeal Rights
- One original retained by PSD, the other goes to the Personnel Services Section to be added to the member’s file.
- Per the Firefighters Procedural Bill of Rights Act, members may request an administrative appeal if they do not concur with the Reprimand.
- Appeals processed through the Grievance Procedure outlined in Article 2.1 of MOU 23.
Grievance Procedure Timeline
- The 15-calendar day appeal period begins the day after the Reprimand is presented.
- During this appeal process, PSD retains the two originals of the Reprimand.
- If an appeal is granted, originals are returned to the member; if denied, the member has 30 days to submit a written response.
- The written response is attached to the Reprimand in the member’s personnel file.
