KANSAS CITY MISSOURI POLICE DEPARTMENT PERSONNEL POLICY 03/05/2020 03/05/2020 826-1 SUBJECT AMENDS Policy Series 800: Member’s Health 826 – Smoke Free Environment REFERENCE RESCINDS City of Kansas City, Missouri Ordinance, Article XII, Sections 34-471 PPBM 826 through 34-480 *I. PURPOSE This directive establishes guidelines for members in compliance with the City of Kansas City, Missouri ordinance Article XII, Section 34-471 and 34-480, which regulates a smoke free work environment. II. TERMINOLOGY A. Lighted – Ignited, activated, illuminated or powered on. *B. Smoking Materials – Include but are not limited to cigarettes, cigars, pipes, electronic cigarettes (e-cigarettes), and other smoking devices (i.e., personal vaporizer), designed for the consumption or distribution of tobacco or substances. *C. Department Vehicle – Any assigned marked or unmarked police vehicle/motorcycle utilized for related police business. III. POLICY A. Members shall not possess lighted smoking materials: 1. in any enclosed facility including garages. *2. in/on any department vehicles/motorcycles. B. Possession of lighted smoking materials in any form as listed above is prohibited: 1. in a manner that impedes the entrance or exit of any building owned by the City of Kansas City, Missouri (City). * 2. within twenty (20) feet of any entrance, exit, open window, overhead garage door or ventilation intake system of any building utilized by the Department and/or owned by the City. C. Various assignments may be required to allow the use of smoking materials due to the nature of their assignments. *D. Members that chew tobacco will expel any chewed tobacco into a clearly sealable container. *E. Members are prohibited from spitting tobacco spit into Department trash receptacles. F. Members may report violations of this directive by submitting an email message or memorandum through their chain of command to the offending member’s bureau for disposition. *G. The member reporting the violation will notate the date, time, location, and identity of the violator if known. *H. If the identity of the violator is unknown, the sergeant/commander may contact the Digital Technology Section to pull the video in an attempt to identify the violator. I. Enforcement of the ordinances regarding smoking materials will be at the discretion of the Director of Health or their authorized representative.
