SHERIFF’S POLICY MANUAL 4.5 OVERTIME/COMPENSATORY TIME: [CALEA-C 3.2.1E, CALEA-C 3.2.1F] 4.5.1 General: This procedure governs overtime and compensatory time for employees in eligible job positions not governed by existing bargaining unit agreements. 4.5.2 Policy: A. Nonexempt (FLSA status) employees authorized and working in excess of 40 hours during the period starting Saturday at 12:00 a.m. and ending Friday at 11:59 p.m. will be compensated at the rate of time and one half or receive compensatory time at the rate of time and one half for the time worked in excess of 40 hours. The following pre-approved hours are computed as hours worked for the purposes of computing eligibility for overtime rates: 1. Hours actually worked 2. Annual leave time 3. Holiday leave time 4. Compensatory time 5. Bonus day 6. Personal day 7. Jury duty 8. Court appearances pertaining to BSO B. Scheduled overtime and compensatory time must be assigned and approved by a supervisor and supervisor's director or designee. C. Control of overtime and compensatory time will be the command's responsibility. D. All overtime and compensatory time will be documented on an Overtime Authorization Form (BSO AP#25). Employees can accumulate up to 100 hours of compensatory time. Excess hours will be compensated at employees' current hourly rate. G. Compensatory time may be used in the same manner as annual and holiday leave. H. Employees will be paid out for compensatory time earned upon placement into an exempt job classification. I. Upon separation, employees will be paid for all compensatory time accrued. This payment will be at employees' current hourly rate. J. Court-related overtime is detailed in Chapter 11, sub-section 11.10 of the Sheriff’s Policy Manual. K. Employees will not work overtime or compensatory time while on Restricted Administrative Assignment, Administrative Investigative Leave, when relieved of duty pending an investigation, or other administrative action. L. Employees will not be authorized to work overtime or compensatory time within the same pay period that a Disciplinary Suspension without Pay was served.
