OFFICE OF TBS CHIEF OF POLICE ADMINISTRATIVE ORDER NO. 7 SUBJECT: July 1, 2011 INCREASED COMPENSATORY TIME OFF BANK FOR SHORN PERSONNEL In a continuing effort to address the budget deficit, the City, the Los Angeles Police Protective League, and Department members ratified a new Memorandum Of Understanding {MOU) , which increased the Compensatory Time Off (CTO) bank for sworn employees from 400 hours to 800 hours for both straight time and time and one-half. The MOU also gives the Department the discretion to require sworn personnel to use CTO time in excess of 600 hours in order to maintain a CTO bank at or below 600 hours. It is essential that commanding officers (C/O) actively monitor overtime balances and reduce balances over 600 hours. PURPOSE: Note: Special grants and reimbursable overtime activities are not included in the 800-hour CTO bank. In addition, the Department will continue to comply with all Fair Labor Standards Act (FLSA) provisions PROCEDURE : - I. SHORN PERSONNEL RESPONSIBILITY. Sworn personnel are reminded that managing overtime is the responsibility of all employees The new Memorandum of Understanding has increased the CTO bank limit from 400 hours to 800 hours for both straight time and time and one-half. Sworn personnel are encouraged to work with their C/Os to maintain a CTO bank at or below 600 hours and shall take mandatory time off when directed by a C/O when their CTO bank exceeds 600 hours. . - RESPONSIBILITY. Each C/O shall be responsible for managing the overtime of their employees, while also ensuring that operational needs are met. Due to the change in the CTO bank and the requirement to direct mandatory time off once a sworn employee's CTO bank exceeds 600 hours, C/Os shall: II. COMMANDING OFFICER * Monitor sworn employees' overtime balances on a weekly basis ,- ADMINISTRATIVE ORDER NO. 7 -2- July 1, 2011 The Department currently provides C/Os with bi-weekly Sworn Overtime Monitoring Reports by division and individual employee, and divisional timekeepers are able to print reports as needed regarding employees' balances for each C/O's review. Note: * * Identify any sworn employee at or above 600 hours in their CTO bank; and Direct any employee whose CTO bank exceeds 600 hours to take mandatory time off while considering deployment and operational needs. Whenever possible, the Department should include the mandated time off in the days off and may schedule those days in lieu of or in conjunction with vacation time. Nevertheless, the Department shall provide the employee with at least 24 hours notice prior to the start of the shift for which the employee is required to use CTO time.
