    Study Notes

ARTICLE 15 - DISCIPLINARY ACTION AND DISCHARGE

    • Disciplinary action may be taken for just cause.
    • Employees facing investigation will be notified within 10 business days of the incident.
    • Investigations must be completed within 9 months of the notification.
    • Management must inform employees of proposed discipline within 45 days of the investigation's completion.
    • Failure to meet these deadlines creates a presumption that prevents future disciplinary action.
    • Timeframes may be tolled (paused) if reasonably related to criminal investigations, certain leaves (military, workers' compensation), acts of God, or extended leave periods following Article 45.
    • Tolling periods are limited to 60 days for investigation completion and 30 days if the tolling period includes less than 30 days remaining to issue discipline.
    • Disciplinary actions are effective upon acknowledgment.

    ARTICLE 17 - PERFORMANCE REVIEW

    • Employees will receive annual and periodic evaluations from supervisors.
    • Employees can file grievances related to performance ratings (unacceptable/needs improvement), but not for arbitration unless involving a permanent employee.
    • Performance ratings must contain just cause.
    • Step increases are received on the anniversary date or effective date of promotion (provided within two pay periods).
    • Unacceptable or Needs Improvement ratings will reverse any step increase, and the employee must reimburse the Department for the received step increment during the same period.
    • Employees must work at least six months in any rating period to be eligible for step raises.
    • Probationary employees receive performance reviews according to service with the Department.

    ARTICLE 28 - VACATIONS

    • Employee vacation time is based on years of service in different work schedules (48-hour and 42-hour).
    • Different schedules have different vacation allowances (shifts or days).
    • All other employees have vacation benefits based on years of service in days (not shifts).
    • There are different vacation accrual rates for different work schedules.
    • Rules for pro-rated vacation accrual exist for employees who are not in pay status.
    • Employees on disability-related leave do not accrue vacation.

    Additional Notes

    • Grievance actions impact personnel file entries with regard to discipline.
    • Disciplinary material older than 2 years (or 1 year for reprimands/counseling) will not be considered during promotional evaluations.
    • Discharges are regarded as suspensions without pay during Step 3 of the grievance procedure.
    • If a grievance procedure is in place regarding discipline, written disciplinary action will not be placed in the personnel file until completed.
    • If discipline is rescinded, the action will be marked as such in the file.
