WHEN TO REQUEST IT? ASAP!!!! FOR ALL PREMISES CASES!! WHY? DELAYS CAN LEAD TO CHANGES OR REPAIRS, INTENTIONALLY OR UNINTENTIONALLY, WHICH MIGHT ALTER THE SCENE AND EVIDENCE. ALSO, WEATHER CONDITIONS, DAILY WEAR AND TEAR, OR OTHER ENVIRONMENTAL FACTORS CAN ALTER THE SITE AND POTENTIALLY ERASE CRUCIAL EVIDENCE. HOW DO PREMISE INSPECTIONS AFFECT THE CASE? IDENTIFY CODE VIOLATIONS SLIP TEST Experts have specialized knowledge of the codes, standards, and regulations that apply to properties. They can identify violations or lapses in maintenance that are not apparent to the untrained eye. In a slip and fall case, demonstrating that the floor did not meet the required safety standards for slip resistance can be pivotal in proving negligence on the part of the property owner or occupier. The slip coefficient is a number.5 it is considered an unsafe condition. CAUSATION DETERMINING NEGLIGENCE Demonstrating the link between the hazardous condition and the incident is easier when the evidence is collected and analyzed quickly. Their assessments can help establish whether the property owner failed to meet the standard of care required, which is central to proving negligence. PROFESSIONAL TESTIMONY DETAILED DAMAGE ASSESSMENTS An expert’s testimony is often seen as more credible and knowledgable. This can significantly influence the court's or jury's perception of the facts. Experts can provide a detailed analysis of the premises and the injuries sustained, potentially uncovering additional damages that can be claimed. THE CASE IS INSIDE A PREMISE THAT REQUIRES A SUBPOENA TO ALLOW INSPECTION ISSUES THAT MAY ARISE REQUEST THE EXPERT TO TRY AND GO DO THE INSPECTION AS NON OFFICIAL IF THE PREMISE DENNIES THE INSPECTION OR THROWS THE EXPERT OUT, WE SHOULD REQUEST FOR AN OFFICIAL INSPECTION IF THE OFFICIAL INSPECTION IS DENIED, DEFENSE SHOULD SEND A WRITEN DENIAL THANK YOU QUESTIONS?
