SOP was first published in the year 1998 followed ollowed by a number of corrections from time to time in order to bring it in line with the prevailing requirement in accordance to the present requirements on various matters, related to Project, O&M, PD, PB etc. SOP SO was updated and issued in August 2019. Review of SOP has become necessary to update the delegation of powers, deletion of obsolete provision and updating the designation of various executive prevailing in the corporation. A committee comprising Directors namely Sh. Ajit Sharma, Director / Finance and Sh. Amit Kumar Jain, Jain Director (O&S) is constituted to review the various issue of SOP. The SOP has been framed after detailed deliberation by the committee with HODs of Project and O&M. I wish to place on record the technical input by Directors& D effective co-ordination by Planning Cell. Schedule of Powers should be considered as a sacrosanct document designed to confer organizational dynamism through quick decision-making process. It should be clearly understood along with delegation of powers, there is accountability also at every level. 2. While exercising these powers, safeguarding the interest of the corporation is more important than simple observance of rules and procedures. 3. This schedule of powers covers delegation in respect of Project, Property Development, O&M, Earning, Store Indenting, Financial, Establishment, Store and Miscellaneous Matters. 4. It should be ensured that the powers mentioned herein are viewed in their correct perspective and exercised judiciously by the officers concerned. The sanctioning authorities shall pay due regard to the Canons of Financial Propriety. It should be clearly understood that the powers for sanctioning incurring of expenditure are distinct from the powers of the actual mode of incurring expenditure. Unless specifically mentioned to the contrary in the Schedule of powers, all acceptance letters will require to be vetted by finance before issue. Any instance of misuse of powers shall be treated as misconduct. 5. Concurrence with Associate Finance will be necessary wherever indicated herein against the respective items. Where there is a difference in opinion between the executive and the Associate Finance, the case should be considered at the next higher level and if the difference still persists, the case should be put up to MD. 6. Clarifications with regard to the interpretation of the items detailed herein should be referred to the Corporate Office. 7. The delegation of powers has the approval of the Managing Director. Variation under Lump Sum Schedule of Contract: For variation under Lump Sum Schedule of Contract where method of derivation of rate is not provided in the Contract itself, the following procedure shall be followed. (a) The variation shall be approved in two stages viz Stage-I: Administrative Approval and Stage-II: Financial Approval. (b) The variation at each stage shall be examined in detail by a committee one level below the acceptance level except in cases where acceptance is at MD level. (ii) For variation under the power of Director, a Committee of three HoDs, including one from Finance, shall examine and put up the recommendations to Director. (c) For variation under acceptance of MD, the procedure shall be as under: i. Variation shall be examined by a Committee of three HoDs including one from Finance. The Committee’s recommendation justifying the variation shall be put up to MD along with approximate financial implication through Director concerned for Stage-I : Administrative Approval. ii. Once Stage-I (Administrative Approval) is given by MD, Stage-II (Financial Approval) shall be given by the Director concerned after satisfying himself/herself of the reasonableness of the rates and method adopted for quantification of variation. (d) If method of derivation of rate for increase / decrease in the Lump Sum scope of work is provided in the contract itself, then the Page 16 of 76 SOP - MARCH 2024 Sl.No. Nature of Power Director ED/HoD Dy.HoD Remarks committee is not required for deliberating such variations and the variation shall be put up to the Competent Authority for approval after concurrence of associate finance. 4. Variation in Item Rate Schedule of Contract: As per General Conditions of Contract (GCC) clause 12.5 A (i) (b), in case the variation in individual items (except for items covered under Para (c), (d) and (e) of the said clause) is more than 25% on plus side, the rate for the varied quantity beyond 25% shall be negotiated between the Engineer and the Contractor and mutually agreed rates arrived at before execution of the extra quantity. Hence, the negotiation is Pre-requisite to finalization of the rates beyond 25% of the original BOQ of item. The negotiation shall be conducted by a committee before putting the same to Accepting Authority for approval. The constitution of committee shall be as follows: (a) The variation proposal within the accepting powers of MD: A committee of two HoDs, including one from Finance, shall examine, negotiate and put up the recommendations to MD through concerned director. (d) The variation proposal within the power of Dy. HoD: A committee of two Executives, including one from Finance, shall examine, negotiate and put up the recommendations to concerned Dy. HoD. The committee will conduct the negotiation meeting with the contractor and negotiate the rates of items under variation which shall be put up for approval of accepting authority. In case of disagreement with Contractor, the executive department will examine the feasibility of engaging other agency for execution of quantities of items beyond 25%. 5.
