THE PHILIPPINE MEDICAL TECHNOLOGY ACT OF 1969 R.A 5527 INTRODUCTION RA 5527 is the governing law for all medical technologists in the country. It embodies different provisions of the practice. Guidelines on licensure examination are also integrated. It contains 32 sections and has already amended three times by the following: RA 6138 (August 3 1,1970) - Sections: 16, 21, and 22 PD 498 (June 28, 1974) - Sections: 2, 3, 4, 7, 8, 11, 13, 16, 17, 21, 29, and 31 PD 1534 (June 11, 1978) - 3, 8, 11, 13, and 31 RA 5527 is an Act Requiring the Registration of Medical Technologist, defining their practice, and for other purposes. DEFINITION OF TERMS MEDICAL TECHNOLOGIST A person who engages in the work of medical technology under the supervision of a pathologist or licensed physician authorized by the Department of Health in places where there is no pathologist and who having passed the prescribed course (Bachelor of Science in Medical Technology/ Bachelor of Science in Hygiene) of training and examination is registered under the provision of this Act. MEDICAL LABORATORY TECHNICIANS A person certified and registered with the Board as qualified to assist a medical technologist and/ or qualified pathologist in the practice of medical technology as defined in this Act. DEFINITION OF TERMS PATHOLOGIST A duly registered physician who is specially trained in methods of laboratory medicine, or the gross and microscopic study and interpretation of tissues, secretion and excretions of the human body and its functions to diagnose disease, follow its course, determine the effectivity of treatment, ascertain cause of death and advance medicine by means of research. ACCREDITED MEDICAL TECHNOLOGY TRAINING LABORATORY A clinical laboratory, office, agency, clinic, hospital or sanitarium duly approved by the Department of Health or its authorized agency. DEFINITION OF TERMS RECOGNIZED SCHOOL OF MEDICAL TECHNOLOGY Any school, college, or university which offers a course in Medical Technology approved by the Department of Education under the requirements under this Act, upon recommendation of the council of medical technology education. COUNCIL The council of medical technology education established under this Act. BOARD 1he Board of Examiners for Medical Technologyestablished under this Act. SECTION 3: COUNCIL OF MEDICAL TECHNOLOGY EDUCATION, ITS COMPOSITION Composed of the : Director of Higher Education as Chairman; Chairman of the Professional Regulation Commission as Vice-Chairman; Director of the Bureau of Research and Laboratories of the Department of Health Chairman and two (2) members of the Board of Medical Technology, Representative of the Deans of Schools of Medical Technology and Public Health Presidents of the Philippine Society of Pathologists and the Philippine Association of Medical Technologists, as members. SECTION 4: COMPENSATION AND TRAVELING EXPENSES OF COUNCIL MEMBERS Compensation per Meeting: The Chairman will receive a per diem (daily allowance) of fifty pesos (P50.00) for each meeting they actually attend. Each member will receive a per diem of twenty-five pesos (P25.00) for each meeting they attend. Independence from Regular Salaries: This per diem is provided regardless of whether the Chairman or the members receive regular salaries from the government. In other words, this allowance is an additional compensation specifically for attending meetings and is not affected by their regular government salaries. SECTION 5. FUNCTIONS OF THE COUNCIL OF MEDICAL TECHNOLOGY EDUCATION The Council of Medical Technology Education is responsible for: 1. Curriculum Recommendation 2. Student Admission Regulation 3. School Approval and Closure 4. Annual Reporting 5. School Inspections 6. Internship Certification 7. Refresher Courses 8. Rule Enforcement SECTION 6. MINIMUM REQUIRED COURSE The medical technology course shall be at least four years, including a 12- month satisfactory internship in accredited laboratories. The Council is hereby authorized, subject to the approval of the Secretary of Education to change, remove from, or add to the subjects listed above as the needs and demands of progress in the science of medical technology may require. SECTION 7. MEDICAL TECHNOLOGY BOARD. A Medical Technology Board is established under the Professional Regulation Commission, referred to as the Board. It consists of: Composition: One Chairman, who is a pathologist, and two members who are registered medical technologists. Appointment: Members are appointed by the President of the Republic of the Philippines based on recommendations from the Professional Regulation Commission. Term: The Chairman and members serve a three-year term or until their successors are appointed and qualified. Continuation: Current members will serve until their terms expire. Succession: In the event of death, disability, or removal, a successor will serve only the remainder of the original term. CURRENT MEDICAL TECHNOLOGY BOARD The current members of the Board of Medical Technology: 1. Dr. Marilyn A. Cabal-Barza - Chairman; 2. Dr. Leila Lany M. Florento - Member. SECTION 8. QUALIFICATIONS OF EXAMINERS To be appointed as a member of the Board of Examiners for Medical Technology, a person must meet the following criteria: 1. Citizenship: Must be a Filipino citizen. 2. Character: Must be of good moral character. 3. Qualification: Must be a qualified Pathologist or a registered medical technologist with a degree in Medical Technology, Hygiene, or Public Health. 4. Experience: Must have practiced laboratory medicine or medical technology for at least ten years prior to appointment. However, for the first three years after the Act's approval, this requirement is reduced to five years. 5. Non-affiliation: Must not have been a faculty member of any medical technology school for at least two years prior to appointment and must not have any financial interest in such institutions. SECTION 9. EXECUTIVE OFFICER OF THE BOARD The Commissioner of Civil Service shall be the Executive Officer of the Board, and shall conduct the examinations given by it. SECTION 10. COMPENSATION OF MEMBERS OF THE BOARD OF EXAMINERS FOR MEDICAL TECHNOLOGY Each member of the Board will receive: Ten pesos for each applicant they examine. Five pesos for each applicant granted a certificate of registration without examination. SECTION 11. FUNCTIONS AND DUTIES OF THE BOARD Administer the Act: Ensure the provisions of the Act are implemented. Administer Oaths: Conduct oaths related to the administration of the Act. Manage Certificates: Issue, suspend, and revoke certificates of registration for medical technologists and medical laboratory technicians. Maintain Standards: Monitor and improve the practice conditions, ethics, and standards of medical technology in the Philippines. Investigate Violations: Investigate violations of the Act and itsAregulations, with the authority to issue subpoenas for witnesses and documents. SECTION 11. FUNCTIONS AND DUTIES OF THE BOARD Investigate Violations: Investigate violations of the Act and its regulations, with the authority to issue subpoenas for witnesses and documents. Draft Regulations: Create necessary rules and regulations, subject to approval by the President of the Philippines. Assess Technical Staff: Evaluate the adequacy of technical staff in clinical laboratories and blood banks before they can be licensed by the Department of Health. Set Qualifications and Training: Define qualifications and training for medical technologists in specialized fields and oversee their specialty examinations. Classify Technical Staff: Classify and set qualifications and training for various technical roles within clinical laboratories, including Medical Technologists and Medical Laboratory Technicians. SECTION 12. REMOVAL OF BOARD MEMBERS Any member of the Board may be removed by the President of the Philippines for: neglect of duty, incompetency, malpractice unprofessional, unethical, immoral or dishonorable conduct After having been given the opportunity to defend himself in a proper and administrative investigation: Provided, that during the process of investigation, the President shall have the power to suspend such member under investigation and appoint a temporary member in his place. SECTION 14. INHIBITION AGAINST THE PRACTICE OF MEDICAL TECHNOLOGY No person shall practice or offer to practice medical technology as defined in this Act without having previously obtained a valid certificate of registration from the Board provided that registration shall not be required of the following: a. Duly registered physicians. b. Medical technologist from other countries called in for consultation or as visiting or exchange professors to colleges or universities: Provided, they are only practicing the said function. c. Medical technologists in the service of the United States Armed Forces stationed in the Philippines rendering services as such for members of the said forces only. SECTION 15: EXAMINATION All applicants for registration as medical technologist shall be required to undergo written examination which shall be given by the Board annually in the greater Manila area, Cebu, and Davao during the month of August or September on such days and places as the Board may designate. Written notices of such examination shall be published in at least three newspapers of national circulation by the Secretary of the Board at least thirty days prior to the date of examination. Venues: Manila, Cebu, Davao and Baguio Schedule: August/ September, March SECTION 16: QUALIFICATION FOR EXAMINATION Every applicant examination under this Act, shall, prior to the date thereof, furnish the Board satisfactory proof that he or she: a. Is in good health and is of good moral character; b. Has completed a course of at least four (4) years leading to the degree of Bachelor of Science in Medical Technology or Bachelor of Science in Public Health 1. Philippine Statistics Authority (PSA) Birth Certificate 2. PSA Marriage Contract/Certificate (for married female applicants) 3. Transcript of Records (TOR) with scanned picture and remarks “for Board Examination Purposes” SECTION 17. SCOPE OF EXAMINATION SECTION 18. REPORT OF RATING The Board shall, within one hundred and twenty days after the date of completion of the examination, report the result thereof to the Commissioner of Civil Service,who shall submit such result to the President of the Philippines for approval. Currently, results are release within 3-5 working days. SECTION 19. RATING IN THE EXAMINATION In order to pass the examination, a candidate must obtain a general average of at least seventy-five percent in the written test, with no rating below fifty percent in any of the major subjects No further examination will be given an applicant who has not qualified after three examinations, unless and until he shall have completed 12 months refresher course in an accredited medical technology school or 12-month postgraduate training in an accredited laboratory SECTION 19. RATING IN THE EXAMINATION How to compute your board rating? Here’s an example: Clinical Chemistry - 79 79 * 0.20 = 15.8 FINAL RATING: 80.6 Hematology - 85 85*0.20= 17 ISBB - 76 76*0.20=15.2 Microbiology & Parasitology - 80 80*0.20=16 Clinical Microscopy - 82 82*0.10=8.2 Histopath & MTLBE - 84 84*0.10=8.4 SECTION 19. RATING IN THE EXAMINATION How to compute your board rating? Here’s an example: Clinical Chemistry - 79 Hematology - 85 ISBB - 48 FAILED because ISBB rating is below 50 Microbiology & Parasitology - 80 Clinical Microscopy - 82 Histopath & MTLBE - 84 SECTION 21. ISSUANCE OF CERTIFICATE OF REGISTRATION Certificate Issuance Successful applicants who pass the medical technologist examination will receive a certificate of registration, provided they are at least 21 years old. The certificate must be signed by Board members and the Commissioner of the Professional Regulation Commission. Registered medical technologists must display their certificates at their workplace. SECTION 21. ISSUANCE OF CERTIFICATE OF REGISTRATION Registration Without Examination: For Graduates: Applicants with a Bachelor’s degree in Medical Technology or Public Health from recognized institutions, who have at least three years of practice in accredited laboratories, can receive a certificate without examination for a fee of P115.00. This also applies to those who have practiced medical technology for eight years if their practice began before June 21, 1969. SECTION 21. ISSUANCE OF CERTIFICATE OF REGISTRATION For Medical Laboratory Technicians: Applicants with ten years of experience as medical laboratory technicians as of the decree's approval date, regardless of academic attainment, may qualify for registration without examination. Individuals who failed the board exam for medical technology but scored at least 70% can also be certified. Government Employment: Registered medical laboratory technicians employed in the government must have civil service eligibility equivalent to at least a second grade. SECTION 22. FEES Examination and Registration: Each applicant for examination and registration is charged fifty pesos for each certificate of registration issued without prior examination. Replacement Certificates: A fee of ten pesos is charged for issuing a new certificate to replace one that is lost, destroyed, or mutilated. *For first timer and repeater you have to pay nine hundred (900) pesos. After three (3) unsuccessful exam, the applicant is required to submit a Certificate of Completion of refresher course from school of medical technology accredited by CHED.
