PUBLIC HEALTH LAWS — LEARNING OBJECTIVES — 1. Relate the application of the PHC key principles in the implementation of public health programs. 2. Create importance of the Philippine health laws in the status of the community 01 Magna Carta for Health Workers - Also known as Magna Carta for Public Health Workers Definition. - For purposes of this Act, "health workers" shall mean all persons who are engaged in health and health-related work, and all persons employed in all hospitals, sanitaria, health infirmaries, health centers, rural health units, barangay health stations, clinics and other health-related establishments owned and operated by the Government or its political subdivisions with original charters and shall include medical, allied health professional, administrative and support personnel employed regardless of their employment status. 02 Sanitation Code - Presidential Decree No. 856 CODE ON SANITATION WHEREAS, the health of the people, being of paramount importance, all efforts of public services should be directed towards the protection and promotion of health; and WHEREAS, with the advance in the field of sanitation in recent years, there arises the need for updating and codifying our scattered sanitary laws to ensure that they are in keeping with modern standards of sanitation and provide a handy reference and guide for their enforcement. 03 Clean Air Act - The Philippines Clean Air Act of 1999 (Republic Act No. 8749) It outlines the government’s measures to reduce air pollution and incorporate environmental protection into its development plans. It relies heavily on the polluter pays principle and other market-based instruments to promote self- regulation among the population. It sets emission standards for all motor vehicles and issues pollutant limitations for industry. Emission limit values are laid down by The Department of Environment and Natural Resources, Philippines as ‘Implementing Rules and Regulations for Philippine Clean Air Act of 1999’. These rules and regulations shall apply to all industrial emissions and other establishments which are potential sources of air pollution. 04 Generic Act D. REPUBLIC ACT NO. 6675 An Act to promote, require and ensure the production of an adequate supply, distribution, use and acceptance of drugs and medicines identified by their Generic Names. — This Act shall be known as the “Generics Act of 1988”. 05 National Health Insurance Act REPUBLIC ACT NO. 10606 AN ACT AMENDING REPUBLIC ACT NO. 7875, OTHERWISE KNOWN AS THE “NATIONAL HEALTH INSURANCE ACT OF 1995″, AS AMENDED, AND FOR OTHER PURPOSES Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled: Section 1 of Republic Act No. 7875, as amended, is hereby amended to read as follows: National Health Insurance Act of 2013′.” 06 National Blood Services Act Republic Act No. 7719 Also known as the National Blood Services Act of 1994, promotes voluntary blood donation to provide sufficient supply of safe blood 07 Laws on Notifiable Diseases The Department of Health (DOH) today urged all private and public health workers, especially at the municipal, provincial and barangay levels, to report all public health threats and emergencies to the DOH to continuously promote the welfare of the people as mandated under newly signed law, RA 11332 otherwise known as the “Mandatory Reporting of Notifiable Diseases and Health Events of Public Health Concern Act”. Senior Citizen 08 Laws REPUBLIC ACT NO. 9994 An act granting additional; benefits and privileges to Senior Citizens, further amending Republic Act No. 7432, as amended, otherwise known as “AN ACT TO MAXIMIZE THE CONTRIBUTION OF SENIOR CITIZENS TO NATION BUILDING, GRANT BENEFITS AND SPECIAL PRIVILEGES AND FOR OTHER PURPOSES “This Act Shall be known as the “Expanded Senior Citizens Act of 2010.” 09 Revised Dangerous Drugs Law REPUBLIC ACT NO. 9165 An Act Instituting the comprehensive dangerous drugs act of 2002, repealing Republic Act No. 6425, otherwise known as the dangerous Drugs Act of 1972, as amended, providing funds therefor, and for other purposes. This Act shall be known and cited as the “Comprehensive Dangerous Drugs Act of 2002”. Act on Cheaper 10 Medicine RA 9502 The Law intends to achieve better health outcomes for the Filipino people by ensuring that quality medicines are accessible and affordable to as many Filipinos especially the poor. There are a number of factors to be considered and a variety of issues and concerns to address when facing the problem of access to medicines. Among the major and critical issues include those of rational drug use, public perception on generics, health professional behavior on prescribing and dispensing medicines, information asymmetry and exercising informed choice, pricing, supply and distribution, and procurement systems’ transparency, respect for patent rights vis- à-vis access by the poor, quality assurance, and many others. Save the Children-Implementing Rules and 11 Regulations (IRR) of the Special Protection of Children in Situations of Armed Conflict Act (CSAC) Law or Republic Act 11188 Seeks to protect children from all forms of abuse, violence, cruelty and discrimination during armed conflict 12 Violence Against Women- Violence Against Women Act of gender-based violence that results or is likely to result in physical, sexual or psychological harm or suffering to women including threats or such acts, coercion or arbitrary deprivation of liberty whether occurring in public or private life. Gender-based violence is any violence inflicted on women because of their sex. Republic Act 9262.Anti-Violence Against Women and Their Children Act of 2004 republic_act_9262_"THE ANTI-VIOLENCE AGAINST WOMEN AND THEIR CHILDREN ACT OF 2004" This Act shall be known as the "Anti- Violence Against Women and Their Children Act of 2004. Disaster Risk Reduction 13 Management REPUBLIC ACT No. 10121 An act strengthening the Philippine Disaster risk Reduction and management system, providing for the National Disaster Risk reduction and management framework and institutionalizing the national disaster risk reduction and management plan, appropriating funds therefore and for other purposes Rooming-in and 14 Breastfeeding Act of 1992 (Milk Code)- Executive Order No. 51 National Code of Marketing of Breastmilk Substitutes, Breastmilk Supplement and Other Related Products Responsible Parenthood 15 and Reproductive Health Law of 2012 The Responsible Parenthood and Reproductive Health Act of 2012, also known as the Reproductive Health Law or RH Law, and officially designated as Republic Act No. 10354, is a law in the Philippines, which guarantees universal access to methods on contraception, fertility control, sexual education, and maternal care Mandatory Infants and 16 Children Health Immunization Act of 2011 REPUBLIC ACT 10152 An act providing for mandatory basic immunization services for infants and children, repealing for the purpose of presidential decree no. 996 17 Children Safety on Motorcycles Act of 2015 Republic Act No. 10666 AN ACT PROVIDING FOR THE SAFETY OF CHILDREN ABOARD MOTORCYLES. Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled: – This Act shall be known as “Children’s Safety on Motorcycles Act of 2015”. Children’s Emergency 18 Relief and Protection Act of 2016 REPUBLIC ACT NO. 10821 An act mandating the provision of emergency relief and protection for children before, during and after disasters and other emergency situations. Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled: This Act shall be known as the “Children’s Emergency Relief and Protection Act”. Child and Youth 19 Welfare Code of the Philippines Presidential Decree No. 603 The Code shall be known as the "Child and Youth Welfare Code". It shall apply to persons below twenty-one years of age except those emancipated in accordance with law. October 17, 1958 Presidential Decree 651 – All births and deaths must be registered 30 days after delivery. Presidential Decree 856 – Code of Sanitation Presidential Decree 996 – Provides for compulsory basic immunization for children and infants below 8 years of age.
