OVIEDO POLICE DEPARTMENT GENERAL ORDER EFFECTIVE DATE: 07-12-2021 SUBJECT: City Administrative Citations AMENDS: None I. II. III. PURPOSE POLICY PROCEDURES FOR ISSUANCE I. PURPOSE APPROVAL: NUMBER: Dale Coleman Chief of Police GO 4-17.0 REFERENCE: City of Oviedo Code of Ordinances RESCINDS: None The purpose of this order is to provide guidelines to officers regarding enforcement of violations of the City of Oviedo Code of Ordinances and/or the Land Development Code to ensure the option of a resolution of such code violations by a special magistrate. II. POLICY It shall be the policy of the Oviedo Police Department to enforce those public safety-related portions of the City of Oviedo Code of Ordinances and/or the Land Development Code. As directed by City of Oviedo Ordinances, all law enforcement officers of the City of Oviedo are deemed to have the powers of a code enforcement officer. III. PROCEDURES FOR ISSUANCE A. Upon observation of a violation of a city code or ordinance under the provisions of the Code of Ordinances or the Land Development Code, the officer shall make contact with the violator and determine their identity. B. A Code Enforcement (CE) Number is to be obtained from Cafe; and prior to the end of the officer’s shift, the below information shall be entered by the issuing officer into the Code Enforcement (CE) Report: Oviedo Police Department GO 4-17.0 City Administrative Citations C. Page 2 of 3 1. Date the violation occurred/was observed; 2. Time of violation; 3. Address of violation/incident address; 4. Violator identifiers to include full name; date of birth; sex; race; and complete residential address; and 5. The narrative field for the Code Enforcement (CE) Report shall be completed to document all details of the incident to include any aggravating or mitigating circumstances (i.e. irate person/violator, refusal to sign, torn up citation, threats, etc.). Officers are encouraged to include other pertinent information in narratives when such details would assist them during subsequent special magistrate hearings that may be requested by violators. An Administrative Citation shall be completed for the violation and the following shall be entered on each citation: 1. “Case Number” which is the Code Enforcement (CE) number obtained from Café. 2. The date and time the violation occurred. 3. Violator identifiers for the individual being issued the Administrative Citation, to include: full name; date of birth; sex; race; residence address; and driver license number/other identification presented. 4. The complete address of where the violation occurred. 5. “Check” the appropriate violation box or specify the violation observed in the space provided. 6. A brief synopsis of the facts of the violation. 7. The fine amount shall be entered as outlined in the City of Oviedo Code of Ordinances Article IV. Code Enforcement. 8. The date of issue. 9. Page 3 of 3 Signature of the individual receiving the Administrative Citation. When the individual refuses or fails to sign, the refusal to sign shall not affect the validity of the citation, but shall be noted by the issuing officer in the Code Enforcement (CE) Report narrative in Café. D. The issuing officer shall explain to the violator that they have fifteen (15) days from the date of issuance to either pay the fine in full or to request a hearing before a special magistrate. The issuing officer shall inform the violator that those instructions are listed on the reverse side of the Administrative Citation. E. The issuing officer shall distribute the copies as listed on the Administrative Citation: Canary – Violator; Pink – Officer; White – Records. F. The Records Specialist shall scan the Administrative Citation into Cafe using the white original, as well as any other supporting documentation related to the violation which were submitted by the issuing officer. Once all related documentation has been scanned into Café, the Records Specialist shall forward the white original of the Administrative Citation, along with the originals of any supporting documentation to the City of Oviedo Code Enforcement for processing and availability for any special magistrate hearing. G.
