S18 LFN, 2004** ### **GUIDELINES FOR THE CONDUCT OF SURVEY PRACTICE IN NIGERIA, 2020** ### **[16th Day of July, 2020]** **WHEREAS:** 1. The Surveyors Council of Nigeria ("the Council") has observed some cases of noncompliance with the minimum standard of survey practice by many Registered Surveyors, private and public entities certified by the Council to practice the profession of Survey and Geo-informatics in Nigeria and these developments, left unchecked, lead to production of inaccurate plans, maps, charts and unreliable geospatial information with the resultant increase in land conflicts and attendant loss of lives and property in our dear country; 2. The Council partly attributes these unwelcome developments to unilateral and uncoordinated promulgations of policies, laws and regulations on Surveying and Geo-informatics by various actors including States Government, corporate bodies and other interested individuals in the country. The situation is further accentuated by these actors engaging, as surveyors, services of persons not registered to practice the profession. Both cases are contrary to the provisions and intendments of Surveyors Registration Council of Nigeria Act, CAP S18 Laws of the Federation of Nigeria, 2004 (the Act) and items 25 and 26, Part II of the Second Schedule to the Constitution of the Federal Republic of Nigeria, 1999 as amended ; and 3. There is need to ensure that, standards of the practice are maintained; the interest of Nigeria's general public is well served and protected; the development aspiration of governments at Federal, States and Local Government levels are based on reliable and accurate geospatial data; public revenue are saved through provision of cost effective spatial data infrastructure; and that our national security is further protected and enhanced. **NOW THEREFORE, in exercise of its function under section 4 (d) of the Act, the Council issues guidelines for the conduct of Survey Practice in Nigeria as follows-** **(1) Only Surveyors, Pupil Surveyors, Survey Technologists and Survey Technicians duly registered by Surveyors Council of Nigeria are eligible to practice survey profession and are qualified to be engaged for any survey work in public or private establishments throughout the Federal Republic of Nigeria.** **(2) The details of those qualified to practice shall be published in the Council's annual publication on List of Surveyors Eligible to Practice in Nigeria.** **(3) A Registered Surveyor is entitled to practice as a surveyor throughout the Federal Republic of Nigeria without any hindrance, except those placed on suspension by the Council and the provisions of the Act.** **(4) A Registered Surveyor shall not be subjected to any further post registration compulsory mentorship outside the pupillage period specified by the Act.** **(5) A Surveyor is entitled and shall be allowed to carry out survey works on public and private parcels of land in Nigeria without hindrance whatsoever except those specified by the Council and the Act.** **(6) All public and private survey works throughout the Federal Republic of Nigeria shall bear pillar/beacon numbers issued by Surveyors Council of Nigeria only and these shall comply with specifications contained in the Rules and Regulations for the Control of Survey Practice in Nigeria.** **(7) Only Registered Surveyors shall prepare plans in case of litigation on any parcel of land in Nigeria and are allowed to give expert evidence in connection with the plans so produced.** **(8) The Survey components of any civil engineering work and survey works for the purposes of registration of title in respect of any parcel of land throughout the Federal Republic of Nigeria shall be exclusive to Surveyors eligible to practice.** **2. Survey Records, including all cadastral, engineering, hydrographic, GIS survey works, carried out on any parcel of land on behalf of public or private entities in any State of the Federation and the Federal Capital Territory shall be lodged in the Office of the Surveyor-General of the Federation or of the relevant State or the Director of Surveys, in the case of the Federal Capital Territory, within one month from the date of the completion of the survey work.** **(1) For the purpose of assurances in quality, integrity, accuracy and cost effectiveness of geospatial data infrastructure, Offices of Surveyors General of the Federation and of the States are to henceforth disengage from involvement in practicalities of survey works.** **(2) The offices referred to in sub section (1) of this guideline shall revert to their natural functions within the ambit of the law as policy and regulatory offices through the Council's State Committee on Ethics, as-** **(a) offices co-ordinating the professional practice;** **(b) spatial data depositories;** **(c) clearing houses; and** **(d) quality control offices within their respective States.** **(1) The person in charge of each university or other institution of higher learning in the Federation having a faculty by whatever name called at which there is held a course of training intended for persons who are seeking to become registered as members of the profession shall furnish to the Registrar, not later than 31st day of March in every year, a list of the names of all persons who attended any such course at the institution in question or anytime during the last preceding year.** **(2) Failure to comply with subsection (1) of this guideline shall lead to withdrawal of accreditation of the institution and their graduates will be denied registration by the Council.** **(3) An institution of higher learning in Nigeria offering the Council's approved courses of training by whatever name called, shall furnish to the Registrar their training timetable and course contents at the beginning of each academic year.** **(4) The Council may pay unscheduled visits to the institutions for the purpose of supervision of the nature of instructions given and for monitoring of examinations taken by persons attending the courses of training leading to approved qualifications.** **(1) It is incumbent on all persons whose names are entered in the Register of Surveyors to constantly update their knowledge and skill, and to also attend the Council's organised annual Mandatory Continuous Professional Development Courses (MCPD).** **(2) These courses shall be among the yardsticks for eligibility to practice the profession in the Federation.** **(1) The following are the approved offices, namely-** **(a) the Surveyor-General of the Federation;** **(b) the Surveyor - General of a State;** **(c) the Survey Department of the Federal Capital Territory;** **(d) the Department of Survey in each university or school engaged in training of persons seeking to become surveyors ;** **(e) the office of the Head of Survey Regiment Corps of Engineers of the Nigerian Army;** **(f) the office of the Hydrographer of the Nigerian Navy;** **(g) the Office of the Head of Aerial Photographic Units of the Nigerian Air force; and** **(h) any registered surveyor in Nigeria.** **(2) This guidelines shall be implemented by the Council and the Council may periodically review the guidelines, consistent with its functions and in line with the profession.** **(1) The Council shall send monitoring teams to each State of the Federation, the Federal Capital Territory and the approved offices to ensure compliance with these guidelines and shall take appropriate measures to ensure strict compliance with the content of the guidelines.** **(2) The general public and in particular offices of the Surveyors-General of the Federation and that of the States, the Survey Department of the Federal Capital Territory, other approved offices and all employers of labour whether public or private entities in Nigeria are to note and comply with these guidelines.** **8. These Guidelines may be cited as the Guidelines for the Conduct of Survey Practice in Nigeria, 2020.** **ISSUED at Abuja this 16th day of July, 2020.** **KABIR, M. M.
