Among other things, the insolvency administrator assigns all rights in connection with defects to the construction company's contractual partners. They turn against the engineer employed by the building contractor, who had been in charge of site supervision and had also exercised the function of "public" site manager in accordance with state building regulations. They demand that he pay the costs of remedying the defects on the basis of the assigned right. They do not succeed in this claim. As an employee, the engineer was merely a vicarious agent of his employer, the construction company. The engineer can therefore invoke the relief from liability that an employee benefits from in the case of hazardous work according to the case law of the Federal Labour Court. According to this, the engineer would have to prove gross negligence or intent. It is irrelevant in this context that the engineer also held the position of "public" site manager. The regulation does not regularly lead to protection of the client. In this respect, it is also irrelevant whether the engineer, as an employee of the building contractor, was authorised to be the site manager within the meaning of the public law regulations. 170 Ingolstadt University of Technology | V01 Construction management/project management Site management Liability Special offence of endangering buildings Criminal Code (StGB) § 319 Building hazard (1) Anyone who violates the generally recognised rules of engineering in the planning, management or execution of a building or the demolition of a building and thereby endangers the life or limb of another person shall be liable to a custodial sentence not exceeding five years or to a monetary penalty. (2) Likewise, anyone who, in the exercise of a profession or trade, violates the generally recognised rules of technology in the planning, management or execution of a project to install technical equipment in a building or to modify installed equipment of this type, thereby endangering the life or limb of another person, shall be punished. (3) Anyone who negligently causes the danger shall be liable to a custodial sentence not exceeding three years or to a monetary penalty.
