Unit 7 Inmates and Gender Lesson 2 Transgender Inmates Lesson Goal You will be able to monitor transgender inmates according to the Prison Rape Elimination Act (PREA) standards. Think About This Transgender inmates can be vulnerable to violence and harassment in a correctional facility; how- ever, PREA provides regulations to protect them. PREA requires every state to consider transgender inmates when making decisions regarding housing, supervising, searching, and medical and mental health care. Transgender Inmates ✅ CO772.1. Know the term transgender according to the American Psychological Association and the Prison Rape Elimination Act (PREA) PREA defines transgender as a person whose gender identity is different from the sex they were assigned at birth. The American Psychological Association notes that many transgender people live part time or full time as members of another gender. Anyone whose identity, appearance, or behavior falls outside of conventional gender norms can be described as transgender. However, not everyone who may appear or behave as another gender will identify as a transgender person. ✅ CO772.2. Know how PREA affects conducting searches of transgender inmates An inmate might be in the process of transitioning their gender or sex characteristics, and you may have difficulty determining their gender or sex. PREA states that officers cannot search or physi- cally examine a transgender inmate for the sole purpose of determining an inmate’s genital status. If an inmate’s genital status is unknown, it may be determined during conversations with them, by reviewing medical records, or, if necessary, by learning that information as part of a broader medical examination conducted in private by a medical practitioner. Conduct cross-gender pat- down searches, and searches of transgender inmates, in a professional and respectful way and in the least intrusive manner possible, while still applying officer safety. ✅ CO772.3. Know the housing, programming, and safety issues unique to transgender inmates Housing issues may arise with inmates who have changed their sex through treatment with hormones, surgery, or both, or who are in any stage of the transitioning process. When deciding whether to assign a transgender inmate to a facility for male or female inmates, and in making other housing Chapter 7 Supervising Special Populations / 239 and programming assignments, consider each on a case-by-case basis. Consider an inmate’s health and safety and if the placement would present management or security problems based upon the behaviors of other inmates. Transgender inmates should be able to shower separately from other inmates.
