SHERIFF’S POLICY MANUAL 4.6 WORKPLACE LACTATION POLICY 4.6.1 General: Administered pursuant to The Patient Protection and Affordable Care Act of 2010 (“PPACA”) amending section 7 of the Fair Labor Standards Act of 1938 (29 U.S.C. 207) (“FLSA”) the PPACA requires employers to provide reasonable break time for nursing mothers to express breast milk as needed after the birth of her child for a period of one year from the time of the birth. 4.6.2 Policy: A. The Broward Sheriff’s Office will provide reasonable time in a private, sanitary place, other than a bathroom for nursing employees to express milk as frequently as needed. B. The use of break times for expressing breast milk is completely at the discretion of the employee. No manager will impose a time or frequency for breaks. 4.6.3 Compensation: Pursuant to the PPACA, “an employer shall not be required to compensate an employee receiving reasonable break time for any work time spent for such purposes.” A. Non-exempt employees will not be compensated for any additional break time but may choose to utilize their approved break and/or lunch time. B. Employees have the option of using their leave accruals, (e.g. annual leave, administrative leave, compensatory time, etc). Leave must be taken in quarter hour increments. Sick leave accruals are not permitted for this type of leave. C. Employees who do not have leave accruals and choose not to use approved break time will fall into a no pay status. 4.6.4 Procedure: A. Employees must meet the criteria set forth under the “The Patient Protection and Affordable Care Act” B. Employees will inform their supervisor of the intent to avail themselves of the facilities available for lactation breaks and advise when break times 4.6 01/13/2014 SHERIFF’S POLICY MANUAL will be taken. This will allow supervisors to arrange for coverage during the employee’s shift. C. Employees will complete leave slips as appropriate. D. Time and leave for lactation breaks must be documented by the employee’s command in order to show compliance with federal law. 4.6 01/13/2014
