violation. Additionally, companies can be charged a penalty of no less than $601, per employee, per day, for not providing hazmat training for employees. PHMSA may also issue fines against those who willingly hinder a PHMSA inspection. Reporting Requirement: An immediate telephone report ts required whenever any of the following occurs during the course of transpor- tation In commerce (including loading, unloading, and temporary storage): 1. A person ts killed; 2. A person is injured, requiring hospitalization; 3. The public is evacuated for one hour or more; 4. A major transportation artery or facility is shut down for one hour or more; 5. The operational flight pattern or routine of an aircraft is altered; Fire, breakage, spillage or suspected contamination from a es ship- ment of radioactive material; 7. Fire, breakage, spillage or suspected contamination occurs involy- ing an infectious substance other than a diagnostic specimen or regulated medical waste; 8. A release of a marine pollutant occurs in a quantity exceeding 119 gallons for a liquid or 882 pounds for a solid; or, 9. In the judgment of the carrier, the incident 1s of a nature that should be reported immediately by telephone even if it does not meet any of the above criteria. Incidents meeting the above listed criteria must be reported immedi- ately to the National Response Center (NRC) at (800) 424-8802. In addition, EPA requires carriers to report any release of a hazardous substance in a quantity equal to or greater than its reportable quanti- ty, as soon as that person has knowledge of the release. Written incident reports may also be required within 30 days of the discovery of the incident under the following circumstances: 1. ‘The circumstances for an immediate report are met; 2. An unintentional release of an HM or the discharge of any quan- tity of hazardous waste; 3. A specification cargo tank with a capacity of at least 1,000 64
