DRONE OPERATION POLICY PURPOSE This Drone Operation Policy (“Policy”) sets forth the Policy of Ozinga Bros., Inc. and each of its subsidiaries and affiliates (collectively “Ozinga”) with regard to compliance with applicable laws governing the operation of small unmanned aircraft systems, more commonly known as drones. SCOPE This Policy applies to Ozinga and all of its directors, officers, employees, contractors, subcontractors, consultants, agents and persons acting on behalf of Ozinga (collectively referred to as the “Company Representatives”). BACKGROUND Ozinga recognizes the many benefits that drones can bring to business operations when utilized responsibly and appropriately. A variety of laws and governmental agencies regulate the operation of drones. Of particular importance is the Federal Aviation Administration (“FAA”) which is tasked with regulating the operation of drones nation-wide. One of the applicable regulations enforced by the FAA is its Small Unmanned Aircraft Rule (found at 14 CFR Part 107). Noncompliance with applicable laws regulating the use and operation of drones can lead to very serious consequences including, but not limited to, substantial fines and even criminal prosecution. Finally, unsafe operation of drones can lead to property damage, serious injury, or even death. POLICY Ozinga is committed to conducting its business safely and with integrity; therefore, Company Representatives must observe all corporate safety policies and conduct themselves in accordance with applicable laws and regulations at all times. Specifically, Company Representatives who will be operating a drone for company business are required to comply with the letter and spirit of the FAA’s Small UAS Rule (14 CFR Part 107), which can be found at this web address: https://www.ecfr.gov/current/title-14/chapter-I/subchapter-F/part-107. For purposes of this Policy, “company business” includes any operation of a drone for purposes other than personal enjoyment or recreation. Before operating a drone for company business, Company Representatives are required to meet the following qualifications: (1) must be at least 16 years old; (2) must pass an initial aeronautical knowledge test at an FAA-approved knowledge testing center; (3) must be vetted by the Transportation Safety Administration; (4) must be knowledgeable about all applicable federal, state, and local laws governing the operation of the drone for company business; and (5) must notify Ozinga’s Director of Safety of their intention to operate a drone for company business. Prior to being flown for company business: (1) all drones must be registered with the FAA (https://faadronezone.faa.gov/#/); and (2) Ozinga’s Director of Safety must be notified of the existence of the drone. Revised 06-09-22 Ozinga Drone Operation Policy Page 1 of 2 When a drone is being flown for company business, the qualified Company Representative operating the drone must abide by all applicable federal, state, and local laws governing the operation of the drone including, but not limited to, the following FAA operating rules: Must only be flown in Class G airspace; Must keep the drone in sight (visual line-of-sight); Must be flown under 400 feet; Must be flown during the day; Must be flown at or below 100 mph; Must yield right of way to manned aircraft; Must NOT be flown over people; and Must NOT be operated from a moving vehicle. Finally, should a drone being flown for company business crash, or cause any personal injury or property damage, Ozinga’s Director of Safety must be notified immediately. Failure to abide by this Policy may result in discipline up to, and possibly including, termination.
