Islamic Jurisprudence (Fiqh) Presented by:Laiba Habibullah(3782-2024), Areeba Moin(3781-2024),Muskan Shuja(2565-2024) Islamic Jurisprudence Islamic jurisprudence (Fiqh) is a vital part of Islamic practice, dealing with the application of Islamic law to everyday life. While the principle of the Quran and the Sunnah are permanent, it is the nature of is lslamic Jurisprudence to facilitate of human being and application of those principle to their activities of dealings. Having the knowledge of the ruling Shariah (Islamic law ) which are exracted from the legislative source. The basic principles of fiqh are protection of life, protection of wealth and property, preservation of honor, preservation of religion, promotion of good, and preservation of rights. These principles are derived from the Quran, Sunnah, and Hadith The four branches of fiqh are Hanafi, Maliki, Shafi'i, and Hanbali. The four branches are distinguished from one another by their distinct emphases on varying parts of usul al-fiqh, or the common body of Islamic legal theory. Islamic Law Fiqh is a body of knowledge that defines the Islamic legal framework, guiding Muslims in their beliefs and actions. What Is Islamic Practical Application Jurispudence (Fiqh) Fiqh provides practical guidance on matters like prayer, fasting, charity, and marriage, making Islam a lived religion. Scholarly Interpretation Islamic scholars meticulously study and interpret primary Fundamental Sources Of Islamic Jurispudence O-THE QURAN THE PRIMARY SOURCE OF ISLAMIC LAW, CONTAINING DIVINE REVELATIONS RECEIVED BY PROPHET MUHAMMAD. QURAN IS THE LAST AND ONLY BOOK OF ALLAH WHICH HAS NOT BEEN BEEN DISORTED. O- THE SUNNAH THE QURAN SAYS , “ FOR YOU THE LIFE OF PROPHET IS A MODEL OF BEHAVIOR”(AL- QURAN 33.21) O-IJMA. IJMA IS CONSIDERED A SUFFICIENT EVIDENCE FOR ACTION BECAUSE THE PROPHET OF ISLAM SAID; “MUSLIM WILL NEVER AGREE ON A WRONG MATTER” O-QIYAS The Quran : The Primary Source Of Islamic Law Divine Revelation: The Quran, revealed by God to Prophet Muhammad, provides the foundation for Islamic law. Core Principle: The Quran outlines fundamental principles of faith, worship, social justice, and ethics, guiding Muslim life. Legal Rulings: The Quran directly addresses many legal issues, including inheritance, contracts, and criminal offenses. The Sunnah: The teachings and practices of Prophet Muhammad PRACTICAL GUIDANCE : THE SUNNAH DEMONSTRATES HOW TO APPLY QURANIC PRINCIPLES TO DAILY LIFE, PROVIDING PRACTICAL EXAMPLES HADITH COLLECTION :THE SUNNAH IS DOCUMENTED IN HADITH, COLLECTIONS OF NARRATIONS ABOUT THE PROPHET'S WORDS AND ACTIONS MODEL FOR GUIDANCE: THE SUNNAH SERVES AS A MODEL FOR MUSLIMS, ENCOURAGING THEM TO FOLLOW THE PROPHET'S EXAMPLE IN THEIR FAITH AND CONDUCT Ijma(The consensus of Islamic scholars) 1. Collective Wisdom: Ijma is a legal source based on the consensus of qualified Islamic scholars on a specific issue. 2. Scholarly Debate: Scholars thoroughly debate and discuss Islamic issues, reaching a consensus based on evidence and reason 3. Binding Authority : Once a consensus is reached, it becomes a binding legal principle for Muslims, reinforcing Islamic unity QIYAS: Analogical Reasoning In Islamic Law Reasoning by Deriving new legal rulings based on analogy existing rulings by identifying similarities between situations. Established Precedents Qiyas relies on established rulings in the Quran, Sunnah, or Ijma as the basis for comparison. Interpretative Tool Qiyas is a flexible tool used to address new situations not explicitly mentioned in primary sources. Major Schools of Islamic Jurisprudence CHARACTERISTICS AND GEOGRAPHIC DISTRIBUTION OF THE SCHOOLS The major schools of Islamic jurisprudence (Sunni): Hanafi: THIS SCHOOL IS THE MOST POPULAR AND IS FOLLOWED IN MANY COUNTRIES, INCLUDING PAKISTAN, TURKEY, AND INDIA. IT EMPHASIZES FLEXIBILITY AND RATIONALITY IN LEGAL REASONING Shafi’i: It emphasizes textual evidence from the Quran and Sunnah, as well as principles of analogy and juristic preference. Maliki: Founded by Malik ibn Anas in the 8th century, this school relies on the Quran and hadiths as primary sources Hanbali Based on the interpretation of Ahmad ibn Hanbal and is influential in Saudi Arabia. These schools are associated with Sunni Islam, which is based on the sayings and actions of the Prophet Muhammad. The name Sunni Islam comes from Ahl al-Sunna wal-Jammah , The major schools of Islamic jurisprudence(Shia): Ja’fari Twelver: the most dominant school of Shia Islam, with followers in Iran , Azerbaijan, Iraq ,and Lebanon. Ja’fari Isma’ili: A minority community in India , Central Asia , the Levant , Yemen , and Pakistan.
