SHERIFF’S POLICY MANUAL 3.7 TRANSFER: The transfer or movement of employees from one component to another will be conducted in the most effective manner possible. Transfers will be made with appropriate notification, evaluation, and debriefing. Employees may transfer only to the same classification. This policy does not preclude the Sheriff or his designee from making assignments in the best interest of the agency. 3.7.1 Procedure: A. Employees transferred from one component to another will receive at least five working days notice before the transfer's effective date, absent extraordinary circumstances or in accordance with applicable collective bargaining agreements. B. Transfers usually will be made effective on the first day of a pay period. C. Transfer Request and Specialized Unit Application (BSO AP#15): 1. Transfer Request Forms will be used by employees voluntarily requesting transfers to different job positions. 2. Employees requesting transfers will complete the applicable areas of the Transfer Request Form and submit it to their immediate supervisor. 3. Supervisors will offer concurrence or non-concurrence with Transfer Request Forms received from their employees and send the form through the chain of command to the Department Executive Director. 4. Supervisors who do not concur with a transfer request will attach justification supporting the non-concurrence onto the Transfer Request Form. 5. Department of Detention and Community Programs supervisors will send copies of all Transfer Request Forms to their supervisors. 6. Completed original Transfer Request Forms, the most recent performance evaluation, and any support justification for Department of Law Enforcement transfers will be sent to the Department of Law Enforcement Executive Director. D. Requests for transfers, job postings, and assignments within the Department of Law Enforcement (sworn or civilian) will be coordinated by DLE administration. 3.7.2 Promotional Transfer: Employees who are promoted may be transferred to another assignment before the promotion, subject to the final determination of the Sheriff or his designee. 3.7.3 Specialized Area Transfer: The following applies to employees requesting or receiving transfers or memberships to specialized areas or teams: A. Specialized assignment openings will be advertised throughout BSO via written announcements. Announcements will specify the employee selection criteria for advertised assignments. [CALEA 16.2.2] B. Employees will be governed by applicable bargaining unit agreements regarding specialized assignments. Civilian employees not covered by bargaining unit agreements may not request a voluntary transfer during their initial probationary period. C. Requests for transfers or appointments into Department of Law Enforcement specialized areas or teams will be sent to the DLE Executive Director. D. Requests for transfer into specialized areas or teams will be considered upon successful completion of probation and written supervisory recommendation. E. It is expected that deputies who requested and obtained transfers into specialized units will remain in the unit for at least two years before requesting another specialized unit transfer. F. This policy does not alter administration's right to transfer employees for reasons of promotion, meritorious service, or not meeting performance standards. 3.7.4 Notification: A. The department/division/unit receiving the request may also post a list of transfer requests received to the BSO Informant, if applicable. B. Once a selection has been made, all applicants on the list will be notified via email by the department/division/unit making the selection that a selection has been made. 3.7.5 Cross-Certified Deputies: A. Basic Cross-Certification Classes: Basic cross-certification classes will be taken on deputies own time and at their own expense. B. FDLE Registration: BSO will activate the certification with FDLE upon successful completion of the class. C. Probation: 1. Cross-certified deputies transferred from one discipline to another will serve a one-year probationary period commencing on the transfer date. 2. Cross-certified deputies returning to their original discipline will not be required to serve a probationary period; however, they may be required to successfully complete a field training period. D. Field Training: 1. Cross-certified deputies will successfully complete a field training program upon transferring to the other discipline. 2. Field training will not be provided to cross-certified deputies until the deputy is transferred to the other discipline. E. Mandatory Retraining: Cross-certified deputies must take all mandatory retraining requirements as mandated by FDLE to maintain respective certifications. F. Transfers: Cross-certified deputies transferring from one discipline to another will relinquish their right to transfer back to their original discipline. Seniority: 1. Seniority within disciplines will be determined by the transfer date as a deputy into each discipline. 2. Cross-certified deputies transferred from one discipline to another will not be classified as promoted employees; they will be re-assigned to the other discipline. 3. Cross-certified deputies transferred from one discipline to another will receive a new anniversary date.
