SHERIFF’S POLICY MANUAL 3.8 ANTI-NEPOTISM POLICY: 3.8.1 Purpose: To establish a policy governing the assignments of family members and other relationships in BSO. This policy attempts to ensure employees' judgments and decisions are not influenced by family members or other relationships and unqualified applicants are not hired or favored based upon their status as an employee's family member or other relationship. 3.8.2 Definitions: For this policy's purpose the following definitions apply: A. Employees: Persons hired by BSO or in the service of another under contract with BSO. B. Family Members: Persons related to an employee such as an employee's grandparents or parents; spouses or children; brothers or sisters; aunts or uncles; first cousins; nephews or nieces; half brothers or sisters; in laws such as father-in-law, mother-in-law, son-in-law, daughter-in-law, brother-in-law, or sister- in-law; step fathers or mothers; step children; step brothers or sisters; or other family-type relationship. C. Other Relationships: Physical or romantic relationships interfering with BSO's operation. D. Supervise: A function including, but not limited to hiring, transferring, suspending, promoting, assigning, or evaluating other employees. 3.8.3 Policy: A. Employees will not appoint, employ, promote, advance, or advocate for appointment, employment, promotion, or advancement any of their family members or other relationships. B. Employees will not influence BSO to hire any of their family members or other relationships. C. Employees will advise their director, via chain of command, of any family member or other relationship who is or may be assigned to their area. D. Employees will not serve or be appointed, promoted, or transferred to any position in BSO where they would directly or indirectly supervise a family member or other relationship. 3.8 10/01/2008 SHERIFF’S POLICY MANUAL E. Conflicts of Interest: 1. Decisions involving appointments, promotions, or transfers will not be made by employees whose family members or other relationships are under consideration. This would otherwise be deemed a conflict of interest. 2. If a conflict of interest occurs, the involved decision-making employee will request the next employee in the chain of command to render the decision. 3. Employees hired by BSO before this policy's effective date with family members or other relationships in the same area may be allowed to remain in BSO, subject to being transferred and/or reclassified if a conflict of interest exists. F. Employment decisions will not be entirely based on if an employee has a family member or other relationship employed with BSO. BSO may refuse to hire or transfer employees or applicants if a family member or other relationship will directly or indirectly supervise them, unless the hiring or transferring is in BSO's best interest. G. Employees with family members or other relationships where an employee is working under the direct or indirect supervision of another family member or other relationship may be transferred and/or reclassified. Transfers and/or reclassification will occur within 30 days upon notification or when practical. H. BSO may transfer and/or reclassify non-supervisory employees if a family member or other relationship is employed in the same area. I. If a reclassification is required to accommodate the transfer, the reclassified employee will be offered a position with a similar salary. J. The Sheriff or designee will make the final decision concerning an affected employee's transfer and/or reclassification. K. BSO will give affected employees the option of which employee is transferred. If affected employees cannot agree on which employee is transferred, the applicable supervisor will make this determination. 3.8 10/01/2008 SHERIFF’S POLICY MANUAL L.
