Covered Active Duty

  • A member of the Regular Armed Forces on deployment in a foreign country
  • A member of the Reserve components (National Guard and Reserves) on deployment in a foreign country under a call or order to active duty in support of a contingency operation

Covered Service Member

  • A current member of the Armed Forces (including National Guard and Reserves) undergoing medical treatment, recuperation, or therapy
  • A current member of the Armed Forces on outpatient status or on the temporary disability retired list for a serious injury or illness
  • A veteran of the Armed Forces (including National Guard and Reserves) discharged within the five-year period before the family member first takes military caregiver leave to care for the veteran
  • A veteran undergoing medical treatment, recuperation, or therapy for a qualifying serious injury or illness
  • Excludes veterans dishonorably discharged

Son or Daughter

  • A biological, adopted, or foster child
  • A stepchild
  • A legal ward
  • A child of a person standing in loco parentis (in place of a parent)
  • Must be under 18 years of age, or if 18 years of age or older, be incapable of self-care because of a mental or physical disability
  • Sons-in-law and daughters-in-law are not included

Parent

  • A biological parent of an employee
  • An individual who stands or stood in loco parentis to an employee when the employee was under 18 years of age or incapable of self-care
  • Excludes parents-in-law

Eligible Employees

  • Must have been employed at the ECSO for at least one full year before taking FMLA leave
  • Must have worked at least 1250 hours in the previous 12 calendar months preceding the beginning of FMLA leave

Twelve Month Period

  • Measured backward from each date an employee's FMLA leave commences
