Omaha Police Department Overtime Procedures
- Policy: The Omaha Police Department (OPD) complies with Federal, State, and local laws, including the Fair Labor Standards Act (FLSA), Omaha Municipal Code, and Collective Bargaining Agreements (CBA).
- Non-exempt employees: Must be paid for worked time during the pay period.
- Employee responsibility: Non-exempt OPD employees must submit Overtime Forms and record overtime in the OPD timekeeping system.
- Supervisor/Timekeeper review: Supervisors and timekeepers review and approve or deny overtime requests promptly.
- Fraudulent requests: Fraudulent overtime requests may result in disciplinary actions up to termination.
- Overtime definition: Work exceeding normal workday or work week.
- Sworn employee overtime rate: One and one-half (1.5) times the hourly rate for hours over 8 hours per day (or 8.5 hours for those working a card system) or 10/12-hour days.
- Non-sworn employee overtime rate: One and one-half (1.5) times the hourly rate for hours over 8 hours per day. Special rate for Functional or CMPTEC group assigned to 10-hour days: 1.5 times the rate for hours over 10 hours.
- Holiday work: Considered work for overtime purposes under OPOA CBA.
- Paid time off: Annual leave, sick leave, funeral leave, or compensatory time do not count as hours worked for overtime calculations under OPOA CBA.
- Court Attendance: Court attendance during the employee's scheduled work hours will not be considered a leave of absence and will be paid at the regular rate under OPOA CBA. Court attendance during off-duty hours is compensated at a minimum of three hours at the overtime rate, or the actual hours present, whichever is higher.
- Call-In definition: Work called in during off-duty hours.
- Call-In compensation (sworn employees): Minimum 4 hours at the overtime rate. Or the actual hours worked, whichever is higher.
- Call-In compensation (non-sworn employees): Based on Local CBA or City codes, and non-sworn employee's normal schedule.
- Non-sworn Employee Overtime Compensation: Paid at overtime rate for hours exceeding their normal schedule.
- Specific rates under Local 251: Overtime rates are defined by the Local 251 CBA.
- Other overtime types: Compensation is determined by the respective CBA and/or City of Omaha Municipal Code Chapter 23.
- OPD Overtime Form (OPD Form 158): Employees must submit filled-out forms promptly after the overtime work.
- Form submission: Submitted to supervisors within their respective units.
- Form Approval: If a supervisor is unavailable, a co-worker can submit the form.
- Additional Information: Designated timekeepers responsible to input the overtime hours. Timekeeping error explanation required.
