  • Establishes common technical requirements and administrative procedures to ensure the continuing airworthiness of aircraft, components, and appliances
  • Covers aircraft registered in a Member State, unless regulatory oversight has been delegated to a third country, and those registered in a third country used by an EU operator

Definitions

  • Aircraft: any machine that can derive support in the atmosphere from the reactions of the air
  • Certifying staff: personnel responsible for releasing an aircraft or component after maintenance
  • Continuing airworthiness: all processes ensuring an aircraft complies with airworthiness requirements and is in a condition for safe operation
  • Maintenance: overhaul, repair, inspection, replacement, modification, or defect rectification of an aircraft or component

Continuing Airworthiness Requirements

  • Aircraft and components must comply with Annex I (Part-M) requirements, except for ELA2 aircraft, which comply with Annex Vb (Part-ML) requirements
  • Aircraft listed in the air operator certificate of an air carrier licensed in accordance with Regulation (EC) No 1008/2008 must comply with Annex I (Part-M) requirements

Approvals for Organisations Involved in Continuing Airworthiness

  • Organisations involved in continuing airworthiness of aircraft and components must be approved by the competent authority in accordance with Annex II (Part-145), Annex Vc (Part-CAMO), or Annex Vd (Part-CAO)
  • Approvals issued before 24 March 2020 may be valid until 24 March 2022

Transitional Provisions

  • Organisations holding a valid organisation approval certificate issued in accordance with Subpart F or Subpart G of Annex I (Part-M) shall be issued a Form 3-CAO as set out in Appendix I to Annex Vd (Part-CAO)
  • Organisations holding a valid continuing airworthiness management organisation approval certificate issued in accordance with Subpart G of Annex I (Part-M) shall be issued an EASA Form 14 approval certificate in accordance with Annex Vc (Part-CAMO)### Training Organisation Requirements
  • Organisations involved in personnel training must be approved in accordance with Annex IV (Part-147) to:
    • Conduct recognised basic training courses
    • Conduct recognised type training courses
    • Conduct examinations
    • Issue training certificates
  • Approvals issued or recognised by a Member State in accordance with JAA requirements and procedures before Regulation (EC) No 2042/2003 are deemed to have been issued in accordance with this Regulation

Entry into Force

  • Regulation (EU) 2021/700 enters into force on the twentieth day following its publication in the Official Journal of the European Union
  • By way of derogation, Member States may elect not to apply certain requirements until specific dates:
    • 28 September 2014 for piston-engine non-pressurised aeroplanes of 2000 kg MTOM and below
    • 25 August 2017 for aircraft registered in a third country and dry leased-in by air carriers

Certifying Staff

  • Certifying staff must be qualified in accordance with Annex III (Part-66), except for certain exemptions
  • Certifying staff holding a licence issued in accordance with Annex III (Part-66) are deemed to have the privileges described in point 66.A.20(a) of the same Annex
  • Certifying staff holding a licence including aircraft that do not require an individual type rating may continue to exercise their privileges until the first renewal or change

Approvals for Organisations

  • Approvals for organisations involved in continuing airworthiness must comply with Annex I (Part-M) or Annex Vb (Part-ML) provisions
  • Organisations must also consider additional requirements, including:
    • M.A.201(c) or ML.A.201(c) Responsibilities
    • M.A.403(b) or ML.A.403(b) Aircraft defects

Competent Authorities

  • Where a Member State designates more than one entity as competent authority, the areas of competence must be clearly defined and coordination established between authorities
  • Personnel of competent authorities must not perform certification and oversight activities when there are indications of conflict of interest
