Columbus Fire Division Authority
- Columbus Fire Division's authority stems from the City Charter and Codes (sections 200.02-200.06, adopted 1914, amended 1996).
- The Charter grants broad powers, including those provided by Ohio state laws.
- Implied powers exist beyond enumerated powers, adhering to Ohio constitutional and legal limits.
- City council can create an administrative code superseding ordinances and resolutions (except procedure exemptions, requiring a two-thirds vote, with exempting ordinance defining these).
- Department directors (under mayoral direction) have broad powers over department personnel, administration, and governance, except as restricted by charter or ordinances. Director of Public Safety heads Police and Fire divisions.
- Appointment and removal powers for staff are conditional upon city civil service provisions.
- The Fire Division includes Chief, officers, firefighters, and employees, as defined in ordinances/resolutions.
Suspension Authority
- Fire and Police Chiefs have sole authority to suspend personnel for issues like incompetence, neglect, immorality, habitual drunkenness, disobedience, or just cause.
- Chiefs document suspensions and reasons, submitting them to the Director of Public Safety.
- Investigation and decision (suspension, demotion, dismissal) occurs within five days, with the Director's decision non-appealable (except to Civil Service Commission).
- The Director possesses investigative powers similar to City Council.
Appeals Process
- Personnel penalized by the Director of Public Safety may appeal to the Civil Service Commission.
- Appeals must be filed within ten days.
- The Director forwards all charges and procedures to the Commission.
- The Commission hears appeals within ten days, potentially affirming, disaffirming, or modifying the Director's judgment, making their decision binding.
