Procedure 602 Chesapeake Fire Department Fire Procedure Manual Copyright Lexipol, LLC 2023/03/25, All Rights Reserved.Published with permission by Chesapeake Fire Department Treatment and Transport of Minors - 1 Treatment and Transport of Minors 602.1 PURPOSE AND SCOPE This document provides guidance to Chesapeake Fire Department members for the treatment and/or transportation of minors. 602.2 PROCEDURE Emergency medical treatment/transportation of minors shall be rendered in accordance with the Code of Virginia § 54.1-2969. For purposes of this protocol, "minor" is defined as a person under eighteen years of age. (a) On the scene where injury or illness exists involving a minor and the injury or illness necessitates immediate care and/or transportation, the appropriate treatment and/or transportation will be provided under the following conditions: (a) If the parent, guardian or person who has custodial care of the minor is present, consent must first be obtained from such person for treatment and/or transportation of the minor. (b) If the parent, guardian or person who has custodial care of the minor is not present, is not available within a reasonable time, and the minor is fourteen (14) year of ages or older and physically capable of giving consent, such consent must first be obtained from the minor for treatment and/or transportation. (c) If the parent, guardian or person who has custodial care of the minor is not present, is not available within a reasonable time, and the minor is less than fourteen (14) years of age or older, and physically incapable of giving consent, appropriate care will be rendered and transportation to the nearest appropriate medical facility provided. (d) If the parent, guardian or person who has custodial care of the minor is not present, is not available within a reasonable time, and the minor is less than fourteen (14) years of age, appropriate care will be rendered and transportation to the nearest appropriate medical facility provided. (b) If the nature of the injury or illness is not one requiring immediate medical attention and the parent, guardian or person with custodial care is not present, reasonable time will be taken to locate the parent, guardian or custodial person. (c) If unable to locate such person within a reasonable time, a minor less than fourteen (14) years of age will be treated and transported to the nearest appropriate medical facility. Minors fourteen (14) years of age or older will be treated and transported upon giving their consent. (d) Emancipated minors should be treated as adults for purposes of consent to treatment and/or transportation. Minors who claim to be emancipated must produce proof of emancipation in the form of a Department of Motor Vehicles Identification Card stating the minor's emancipated status or a copy of a court order declaring the minor to be emancipated. If no proof is produced, the conditions set forth in paragraphs (1) and (2) above shall apply.
