The driver refuses to identify himself/herself. Where in the HTA does it state that driving in the Province of Ontario is a privilege? HTA Sec 31 8 Driver’s Licences Why do we have a drivers licence system in Ont.? • To protect the public. • Maintain safety on our highways. • Identify and control poor drivers by way of the demerit point system and other administrative penalties. 9 Currently Issued Licence 10 Currently Issued Licence 11 Updated Licence Introduced Fall 2019 12 Driver’s Licences • Where do we find the classification of drivers licences? – Ontario Regulation 340/94 • Improper Driver’s Licence – Operating a type of vehicle that he or she is not qualified or licenced to operate – 32(1)(3) HTA 13 Driver’s Licence Where is your authority to demand a driver’s licence? • S33(1) HTA • What is reasonable Inspection? • “reasonable inspection” means to hold it, feel it examine it as the legal document that it is. 14 Classes of licences Regulation 340/94 deals with the different classes of licences. Find this table in the Regulation with each of the classes of licences. What are the primary categories? 15 Classification Categories • Weight • Number of Passengers • Motorcycles 16 Weight / Passenger Classes • Primarily weight – A , D and G • Primarily passengers – B, C, E, F • Motorcycles –M 17 Vehicle Weight • Weight of the vehicle alone – Printed on vehicle portion of the permit 18 19 Gross Weight Look up Gross Weight in your HTA. • "gross weight" means the combined weight of vehicle and load; 20 Registered Gross Weight Where is RGW defined for vehicles? • 340/94 section 1(1) Where do we find it on the permit of vehicles? • Printed on plate portion of the permit (owners have to pay a fee - more weight = more money) 21 22 Class “A” • Any combination where the towed vehicle or trailer exceeds a gross weight of 4,600 kilograms • not a bus while carrying passengers. Reg. 340/94 – Table of licences 23 24 Air Brakes “No driver’s licence provides authority to drive a motor vehicle equipped with air brakes unless the licence bears an air brake endorsement.” • Where is this found? • HTA O.Reg 340/94 S. 2(6) • What is that endorsement? • “Z” Endorsement • Offence is HTA S-32(3) 25 A condition R May operate a combination of motor vehicle and towed vehicle which requires a Class A licence, but not allowed to tow more than one trailer, or a trailer with air brakes. O Reg 340/94 Sec 3 26 Example of A condition R Horse trailer with horses: • Trailer weight over 4,600 kgs. • No air brakes Requires minimum Class A condition R. 27 Class “D” • Motor vehicle exceeding 11,000 kilograms gross weight or registered gross weight • Combination of vehicles where combined GW or RGW exceeds 11,000 kg and towed vehicles not over 4,600kg • Not a bus carrying passengers.. – Ontario Regulation 340/94 - Table 28 Class “D” 29 Class “G” • Motor vehicle not exceeding 11,000 kg • Combination of vehicle and trailer where the combined weight does not exceed 11,000kg and towed vehicle not over 4,600 kg • Not a bus carrying passengers, motorcycle or an ambulance ADOUG Acronym 30 ADOUG A – towed vehicle / trailer exceeds 4600Kg D – M/V / combination exceeds >11000Kg. O – Over 11000Kg __________________________11000Kg U – Under (not exceeding) <=11000Kg G – M/V / combination not exceeding 11000Kg 31 Fifth Wheel Class A Exemption O. Reg 340/94 Sec. 4 Recreational Vehicles (RV) weighing more than 4600 kgs can be towed by a fully licenced “G” if: • RV hitched to pick-up by means of fifth wheel. • Pick up truck & RV not equipped with air brakes. • Pick up truck & RV combined do not exceed 11,000 kg. • Additional conditions as detailed in the regulation 32 Fifth Wheel Exemption O. Regulation 340/94 Section 4 33 Combined Weight Truck = 2500kg Trailer = 4000kg Total = 6500kg =G Combined weight is less than 11,000kg and towed weight is less than 4,600kg 34 Combined Weight Truck = 7500kg Trailer = 4000kg Total = 11500kg =D Combined weight is over 11,000kg and towed weight is under 4,600kg. 35 36 Combined Weight Truck = 2500kg Trailer = 5000kg Total = 7500kg =A Towed weight is over 4600kg 37 Licences Based on Passengers 38 Bus What is defined as a bus? • A motor vehicle designed to carry ten or more passengers Where do we find the definition? – 1(1) HTA 39 Class “B” A school purposes bus with a designed seating capacity of more than 24 passengers Ontario Regulation 340/94 - Table 40 41 Class “C” Any bus having a designed seating capacity for more than 24 passengers, but not a school purposes bus. – i.e. Greyhound bus or city transit bus Ontario Regulation 340/94 42 43 Class “E” Any school purposes bus with a designed seating capacity of not more than 24 passengers. Ontario Regulation 340/94 1(1) 44 45 Class “F” • Ambulance • Any bus having a designed seating capacity for not more than 24 passengers, but not a school purposes bus.
