At Fath Avenue, the Nissan stopped for the stop sign prior to the intersection. The Nissan turned right onto e/b Fath Avenue and almost struck a black pick up truck on the right front passenger side. The pick up truck was e/b on Fath Ave. at 45 km/h. There is no control at the intersection for e/b Fath Ave. traffic. You stop the Nissan. The driver of the Nissan, Margaret Hollinger identified herself with this valid Ontario drivers licence. Mrs. Hollinger told you she did not see the pick up truck. You charge her with …? 3 4 Objectives • HTA equipment requirements • Seatbelts 5 Helmets - Motorcycle Where does it say in the HTA that a driver must wear a proper helmet on a motorcycle or motor assisted bicycle on a highway? – 104(1) HTA. Where are the standards for helmets identified? – HTA Ont. Reg 610 – Inspection Requirements HTA Sec 82(2) (9) 6 Helmets - Motorcycle Ont. Reg 610 (Exemption October 18, 2018) - For Sikh motorcyclists holding a valid M1,M2,M DL Must be18 years old Be a practicing member of the Sikh religion; and Have unshorn hair on their head; and Habitually wear and, at the time of driving, is wearing a turban 7 Handlebars - Motorcycle Ont. Reg 596 Sec 10 (1) (Amended on July 1st, 2019) No person shall operate upon a highway a motorcycle or motor assisted bicycle equipped with handlebars the uppermost portion of which is higher than the unclad shoulder of the operator while the seat is fully depressed by the operator’s weight. Police Officers should be familiar with M/C helmet and equipment regulations to ensure proper safety protocol. 8 Towing Another Vehicle Is it OK to tow a vehicle that is broken down? 9 Towing If towing a disabled vehicle with a licenced driver in the disabled vehicle, then a tow rope or chain is O.K. Otherwise…Vehicle, Trailer, or other towed object or device must have 2 separate means of attachment. 10 Two Separate Means of Attachment 11 Fifth Wheel Exception 12 Towing more than one Trailer Is this legal? Look it up….. HTA Sec 161 13 Long Combination Vehicles • Pilot project that allows tractor and 2 - 53 foot trailers total distance of 40 metres to drive on restricted roads • Only allowed to operate on MTO approved freeways • i.e.: 401,400,403 QEW etc. 14 Long combination vehicle 15 Long Combination Sticker 16 Long Combination Vehicles • Two Important Points: • LCV- cannot be re-routed from the designated assigned roads • All rules and requirements are listed on the permit, driver to produce. 17 Seat Belts 18 Seat Belts Where do we find the requirement for seatbelts in motor vehicles? 19 Seat Belts HTA Sec 106(2) • Driver • Motor vehicle with seat belt assembly provided • Shall wear complete assembly 20 Seat Belts Q. Can the driver of a motor vehicle being operated on the highway wear the shoulder assembly of the seat belt under their left arm? 21 How To Wear Seat Belt Assembly S106 (5) HTA; A seat belt assembly shall be worn so that, (a) the pelvic restraint is worn firmly against the body and across the hips; (b) the torso restraint, if there is one, is worn closely against the body and over the shoulder and across the chest; (c) the pelvic restraint, and the torso restraint, if there is one, are securely fastened; and (d) no more than one person is wearing the seat belt assembly at any one time. 22 Seat Belts – Passengers Under 16 Q. If the passenger is under 16 and is not wearing the seatbelt, who is responsible? 23 Seat Belts – Passengers over 16 Q. What is the requirement for a passenger of a motor vehicle to wear a seat belt? • Passenger • Motor vehicle • Highway • Shall occupy a seating position with a belt assembly • Shall wear complete assembly 106(3) 24 Seat Belts- Passenger Q. Is a passenger in a motor vehicle required to identify themselves to an officer if they are contravening the seat belt legislation? 25 Seat Belts- Passenger Q. In this section what is considered “reasonable identification”? • giving his or her correct name, date of birth and address is reasonable identification 26 Seat Belts Q. Are there situations when drivers are exempt from wearing a seatbelt? 27 Seat Belts - Exemptions • Exemptions – Driving in reverse – Doctor’s certificate – Persons size – Delivery driver- not exceed 40 km/h 106(6) 28 Passenger Exemption if over 16 – Medical certificate • Unable to wear for medical reasons • Unable to wear due to person’s size 106(7) 29 Seat Belts Q. Are there any other exemptions where the driver or passenger is not required to wear a seatbelt? R. Yes – Ref O Reg 613 30 Seat Belts - Exemptions • Police or Peace Officer ( includes conservation officer) – While transporting a prisoner • Canada Post – Engaged in rural mail delivery • Ambulance – In patient compartment where patient care makes it impractical – OReg 613 (2) (3) (4) (5) 31 Seat Belt - Exemptions • Firefighter – Position behind cab where work performance makes it impractical • Taxicab – Driver while transporting fare – Toddler / infant requirements • Bus / Public Vehicle / Toddler / infant requirements 32 Seatbelts Q.
