If the only information that the bus driver had to give you was the license plate number, would you have to identify the motorist if you wanted to lay a charge? 30 Owner may be Charged A: NO! As per section 207(1)HTA, 175(11)meeting or 175(12) overtaking are excluded and owner may be charged. However, if the officer is charging the owner for either of the above noted offences, then offence numbers 175(19) or 175(20) SHALL be cited on the certificate of offence. 31 Owner may be Charged IMPORTANT to Remember: HTA Sec 175 (11) and 175(12) – Driver HTA Sec 175(19) and 175(20) - Owner 32 Distracted Driving 33 Distracted Driving Display Screens HTA 78(1) No person shall drive a motor vehicle on a highway if the display screen of a television, computer or other device in the motor vehicle is visible to the driver 34 Distracted Driving Display Screens 35 EXCEPTIONS TO HTA 78(1) HTA 78(2) – Global positioning device- GPS – Hand-held wireless communication device - cell phone (covered in HTA 78.1) – Logistical transportation tracking device – com. veh. – Collision avoidance systems – back up camera – Instrument gauge or system information of vehicle to driver. 36 EXCEPTIONS TO HTA 78(1) HTA 78(2) The above section does not apply to… 37 EXEMPTION TO HTA 78(1) • • • • Driver of ambulance Fire department vehicle Police department vehicle Other vehicles and drivers prescribed by O.Reg. 366/09 38 CELL PHONES (wireless communication devices) HTA 78.1(1) No person shall drive a m/v on a highway while holding or using a hand-held wireless communication device or other prescribed device that is capable of receiving or transmitting telephone communications, electronic data, mail or text messages. 39 CELL PHONES (wireless communication devices) HTA 78.1(1) 40 Distracted Driving 41 EXCEPTIONS: HTA 78.1(6) Does not apply if driver is calling ambulance, police or fire department emergency services. May use communication device for non-emergency Provided: 1. 2. 3. m/v is off roadway or is lawfully parked on roadway. The m/v is not in motion The m/v is not impeding traffic (All three conditions must be met) 42 ENTERTAINMENT DEVICES HTA 78.1(2) No person shall drive a motor vehicle on a highway while holding or using a hand-held electronic entertainment device or other prescribed device the primary use of which is unrelated to the safe operation of the motor vehicle. 43 EXEMPTIONS FOR HTA 78.1 Hands free devices are OK for cell phones and entertainment devices HTA 78.1(3) Drivers of following vehicles exempt for communication devices only • Ambulance vehicle • Fire department vehicle • Police department vehicle • Other vehicles prescribed by regulations 44 HTA 78.1 Definitions Definition • In this section, • “motor vehicle” includes a street car, motorized snow vehicle, farm tractor, self-propelled implement of husbandry and road-building machine. 45 Increased Penalties: Distracted Driving • As of January 1st, 2019: • Penalties for HTA Sec 78 and 78.1 offences will increase for fully licensed drivers to reflect the seriousness of these offences: • First conviction: $500.00 - $1000.00 fine, 3 day suspension and 3 Demerit Points. • Second conviction (within 5 years): $500.00 - $2000.00 fine, 7 day suspension and 6 Demerit Points. • Third and subsequent convictions (within 5 years): $500.00 - $3000.00 fine, 30 day suspension and 6 Demerit Points. • Similarly, penalties will also increase for novice drivers. 46 And what about….? 47 Distracted Driving 48 Exemptions: Check O.
