BOCA RATON POLICE SERVICES DEPARTMENT Standard Operating Procedure 46.08 RESPONSE TO CRITICAL INCIDENTS AT BOCA RATON REGIONAL HOSPITAL Revised: September 28, 2020 I. PURPOSE: The purpose of this standard operating procedure is to provide guidelines regarding police services response to in-progress critical incidents at the Boca Raton Regional Hospital (BRRH). II. DEFINITIONS: HIPAA Privacy Rule: The HIPAA Privacy Rule establishes national standards to protect medical records and other personal health information and applies to health plans, health care clearinghouses, and those health care providers that conduct certain health care transactions electronically. The Rule requires appropriate safeguards to protect the privacy of personal health information and sets limits and conditions on the uses and disclosures that may be made of such information without patient authorization. The Rule also gives patient’s rights over their health information, including rights to examine and obtain a copy of their health records, and to request corrections. HIPAA Security Rule: The HIPAA Security Rule establishes national standards to protect electronic personal health information that is created, received, used, or maintained by a covered entity. The Security Rule requires appropriate administrative, physical, and technical safeguards to ensure the confidentiality, integrity, and security of electronic protected health information. III. PROCEDURE: A. INTIAL RESPONSE: 1. During any in-progress critical incident at the Boca Raton Regional Hospital (BRRH), the first responding law enforcement officer (LEO) shall assume the role of incident commander and follow the procedures as specified in Standard Operating Procedure 46.01 Incident Command System (ICS). 2. As soon as practical, the incident commander shall establish a command post. Fire-Rescue and hospital command staff should be present at the command post as they can assist with patient care issues and communicating with hospital employees. B. BRRH ACTIVE SHOOTER POLICY: 1. The BRRH, with input from the Department, has established an active shooter plan. This plan provides hospital staff with direction during an active shooter event. LEOs shall familiarize themselves with the BRRH’s response plan, see Appendix A Active Shooter. C. ACCESS CARDS: 1. BRRH has provided the Department with access cards to all areas of the hospital. 2. Access cards shall be issued and documented in the RMS to supervisors throughout the Department. 3. Only employees who have received training from BRRH security personnel shall be issued an access card. Training shall consist of: a. A briefing from hospital staff b. Familiarization tour of hospital 4. Access cards shall be inspected during line inspections with any deficiencies noted in the notes section of the line inspection. 5. Lost access cards shall be immediately reported to the bureau commander in writing. The bureau commander will then notify the hospital security director. 6. Access cards shall only be used during in-progress critical incidents. 7. Every effort must be made to notify hospital security before making entry to any area of the hospital utilizing the cards. D. REMOTE VIDEO ACCESS: 1. BRRH is able to remotely access hospital security cameras. A member of BRRH command staff or security staff can access the hospital camera network for police assistance during an in-progress critical incident. LEOs must be accompanied by a representative of BRRH before accessing the camera network. 2. Remote access is strictly limited for use during in-progress critical incidents at BRRH. 3. Precautions must be taken to ensure compliance with all HIPAA regulations regarding patient privacy and security when remotely accessing hospital security cameras.
