Law in the Philippines focuses on mental health care and services - REPUBLIC ACT No. 11036 - An Act Establishing a National Mental Health Policy for the Purpose of Enhancing the Delivery of Integrated Mental Health Services, Promoting and Protecting the Rights of Persons Utilizing Psychosocial Health Services, Appropriating Funds Therefore and Other Purpose. - This Act shall be known as the "Mental Health Act." Section 2. Declaration of Policy. - The state affirms the basic right of all Filipinos to mental health as well as the fundamental rights of people who require mental health services. - The Mental Health Act of the Philippines, also known as Republic Act No. 11036, was - signed into law on June 21, 2018. It is the first comprehensive mental health legislation in the country's history. The law aims to promote mental health and protect the rights of people with mental health conditions. It also provides a framework for the delivery of integrated mental health services - Key provisions of the Mental Health Act include: Declaration of policy: The state affirms the basic right of all Filipinos to mental health and the fundamental rights of people who require mental health services. Rights of people with mental health conditions: People with mental health conditions have the right to: o Freedom from discrimination o Protection from torture, cruel, inhumane, and degrading treatment o Aftercare and rehabilitation Adequate information about psychosocial and clinical assessments 3. Republic Act 10175 - RA 10175 (Cybercrime Prevention Act of 2012) - Addresses a wide range of cybercrimes, including cyber libel and other offenses that can be linked to bullying behavior conducted through electronic means. - The Philippine Congress enacted Republic Act No. 10175 or “Cybercrime Prevention Act of 2012” which completely address crimes committed against and by means of computer system on 12 September 2012. 4. Republic Act 9155 - Governance of Basic Education Act of 2001, provides the overall framework for principal empowerment by strengthening principal and leadership goals, and local school based management within the context of transparency and local accountability. - AN ACT INSTITUTING A FRAMEWORK OF GOVERNANCE FOR BASIC EDUCATION, ESTABLISHING AUTHORITY AND ACCOUNTABILITY, RENAMING THE DEPARTMENT OF EDUCATION, CULTURE AND SPORTS AS THE DEPARTMENT OF EDUCATION, AND FOR OTHER PURPOSE - What does RA 9155 state about the responsibilities of school heads? It is responsible for ensuring access to basic public health services to all Filipinos through the provision of quality health care and regulation of providers of health goods and services. -PURPOSE. The Department of Health (DOH) is mandated to be the over-all technical authority on health. The major mandate of DOH is to provide national policy direction and develop national plans, technical standards and guidelines on health. 7. The Mental Health Act (Republic Act 11036) was signed into law by President Rodrigo Duterte on June 20, 2018. - 11036 or the Philippine Mental Health Law that aims to enhance the delivery of integrated mental health services in the country. The 36-page new law, which was signed by Duterte on June 20, will also promote and protect the rights of persons using psychiatric, neurologic and psychosocial health services. - Senator Risa Hontiveros, the author and principal sponsor of the bill in the Senate, commended the President, saying that the signing of RA 11036 cements the government's commitment to a more holistic approach to health care. 8. DOH Administrative Order No. 2017-0011 - The DOH shall institutionalize all prior and current efforts, including that of the NVHTF, on viral hepatitis control with this Administrative Order, which hereby provides policies on the prevention and control of viral hepatitis under the National AIDS, STI Prevention, and Control Program (NASPCP) 9. Common barrier to accessing mental health services in the Philippines, - fear of stigmatization, lack of awareness of mental health services, sociocultural scarcity, scarcity of financial support, and lack of geographical accessibility, which limit the patients to utilize mental health services - Despite the perceived decrease in barriers to access and treatment stigma since the Coronavirus disease pandemic (COVID-19) began in 2020, affordability and stigma-related reasons were the top-ranked major barriers to accessing mental health care in the Philippines. - Barriers cited by Filipinos living in the Philippines include financial constraints and inaccessibility of services, whereas overseas Filipinos were hampered by immigration status, lack of health insurance, language difficulty, experience of discrimination and lack of acculturation to host culture 13.
