PROCEDURAL INSTRUCTION 06/12/2024 06/12/2024 24-03 SUBJECT AMENDS Stop Report Data Collection REFERENCE RESCINDS Section 590.650 RSMo PI: 08-02 PI: Computerized Police Information Systems Patrol Procedures *I. INTRODUCTION A. Missouri state law (590.650 RSMo) requires that all law enforcement agencies in the state report specific information to the Attorney General, including, but not limited to, an operator’s race for each vehicle stop made within the state. State funds may be withheld from any agency that does not comply with the state law. B. It is the policy of the Kansas City Missouri Police Department (Department) to respect and protect the rights of individuals while pledging to treat everyone fairly and without favoritism. C. This written directive provides guidelines for the collection and analysis of vehicle stop data as mandated by the Missouri Attorney General’s Office. II. TERMINOLOGY Bias-Based Policing - Circumstances where police actions of a sworn member were substantially based on the race, ethnicity, gender, age, sexual orientation, religious beliefs, disabilities, or national origin of a person, rather than upon lawful and appropriate police procedures. III. POLICY A. The Department expressly prohibits bias-based policing. The Department is committed to observing, upholding and enforcing all laws relating to the individual rights of all citizens. Department members will respect and protect each citizen’s civil rights and comply with all laws relating to these rights. *B. All traffic violations, car checks, and searches/seizures of property by sworn members will be based on a standard of reasonable suspicion, probable cause, or other legal authority. *C. All traffic violations, car checks, and searches/seizures of property based substantially on race, ethnicity, gender, age, sexual orientation, religious beliefs, disabilities, or national origin, rather than upon lawful and appropriate police procedures, are strictly forbidden. 1 *D. Commanders will review stop report data throughout the year and look for patterns that are disproportionate to the officers’ patrol area. *E. In the event a pattern is observed that alerts a commander of potential bias- based policing, the pattern will be reviewed and a determination will be made if training is required. The training will be completed within 90 days of the review. *F. A stop report will not be completed when conducting Department- authorized sobriety/driver’s license checkpoints. *G. Sworn members assigned mobile data computers (MDC’s), desktop computers, or electronic ticketing devices, will use the equipment/software for stop report data collection in accordance with current approved uses for the operation of this equipment/software. Refer to the electronic ticketing training guides, available on the Intranet, for further information. IV. PROCEDURE *A. Any sworn member, while on-duty or while working secondary employment, who initiated a vehicle stop within the city limits of Kansas City, Missouri, will be responsible for completing a vehicle stop report even if a verbal warning was given to the operator. 1. The vehicle stop can be a call-for-service or self-initiated activity, i.e., traffic violation/car check. *2. Only the operator’s information will be collected for the vehicle stop report. a. The race will be noted after visual contact is made. b. Multiple questions may have more than one applicable response. In these cases, mark all that apply. *3. Sworn members will indicate the beat of occurrence where the vehicle was first observed. *4. The sworn member’s assignment indicates the member’s primary assignment at the time of the stop. a. “General Patrol” should be used as a default. b. “Dedicated Traffic Enforcement” should be selected when the sworn member is on a grant-funded traffic enforcement detail or a similar assignment. 2 c. “Special Assignment” is used to capture any assignment with a specific focus such as a gang, drug, or weapons task force. d. In the event a detective conducts a traffic stop related to an investigation, this would qualify as a “Special Assignment.” If the same detective makes a traffic stop simply as a result of witnessing a violation by an unknown individual, this would qualify as “General Patrol.” *5 A sworn member should only select the “No Action” box for the “Result of Stop” question if the sworn member takes no corrective measures of any kind towards the stopped vehicle’s operator, e.g., no citation, warning, or arrest. *6. Sworn members should complete the “Location of Stop” question based upon the location at the time the stopped vehicle’s operator was first signaled to stop, regardless of where the operator stops the vehicle. *B. Prior to the end of their tour-of-duty, sworn members will ensure all stop reports have been submitted.
