# Kansas City Police Department General Orders Manual ## Repossession - Parties repossessing vehicles are required by RSMo 304.155.11 to report the repossession within **2** hours after the repossession has occurred. - Sworn members will notify the **Intelligence Unit** when responding to a protest, demonstration, or a strike. - When notified of a major incident, the Communications Unit supervisor will: - Notify the Media Unit, - Commander, and the Duty Officer. - Inquiries regarding internal investigations of department personnel will be referred to the **Media Unit**. - The initial responsibility of a sworn member who becomes aware of a situation involving a sniper, armed barricaded person, armed suicidal party or hostage is **the protection of life**. - The personal rifle can be housed in a case and stored in the trunk of a patrol/department vehicle, or in a department approved/installed **rifle rack**. - Sworn members are required to read the **Implied Consent Law** verbatim from the Alcohol Influence Report, D.O.R. Form 2389, to a combative arrestee who refuses to take a chemical test. - The **Accounting Section** will conduct unannounced fixed asset inspections of one (1) to three (3) department elements each month as staffing and workload allows. - If any of the selected fixed assets are not located during the inspection, the element will prepare a memorandum outlining what happened to the property (i.e. lost, stolen, non-documented transfer, out for repairs, in storage etc.). - This memorandum will be forwarded through the chain of command to the **Accounting Section**. - This memorandum, along with a copy of the inspection memorandum, will be retained in the **Accounting Section** according to current written guidelines within the FSU. ## Nonexpendable Equipment - Nonexpendable Equipment - Equipment with a value of $500 or more that is not reasonably expected to be used up or destroyed in normal service and considered to be a fixed asset. - Exceptions to this rule: - All department owned firearms. - Grant equipment with the value of **$____** or more. - Equipment bought through city bond funds with the value of **$____** or more. - Pilferable items (i.e. camcorders, printers, building maintenance equipment, etc.). - Any additional equipment designated by the **Commander.** - All nonexpendable equipment will be assigned an asset number by the **Inventory Control Coordinator** or designee. - The **Kansas City Police Historical Society (KCPHS)** will be contacted to assess the historical value of any property that might have historical significance prior to being disposed of. - A contents insurance policy is purchased **annually** based on the value of department contents. - Each element will designate an **Inventory Member** to conduct an inventory of fixed assets annually during the last month of the calendar year as follows. - A summary memorandum must be signed and attached to each numerical printout and endorsed by the **Division Commander** before returning to the Inventory Control Coordinator. - When directed to do so by the Executive Services Bureau Commander, the **Accounting Section** will remove the item from the department's inventory, after receiving a copy of the memorandum. - The supervisor/commander of the receiving element will notify the Accounting Section within **2** weeks via telephone if the item is delivered and the inventory control number is not received. ## General Procedures - When an officer determines that an Order of Protection has not been served to a respondent the officer will verify existence of the order by contacting the **County** law enforcement agency where the petitioner resided at the time of issuance. - The **Amber Alert** is a cooperative plan between radio/ television stations and local law enforcement. This plan is designed to locate abducted children from the Kansas City area. - A sergeant will respond, if available, on all calls involving a person who exhibits signs of **agitated/excited delirium**. - When the **Communications Unit** receives notification of an alarm activation at a specific address and determines that a police response is authorized, officer(s) will be dispatched to the alarm call. - No person arrested for investigation of a state offense may be detained beyond the **24** hour limit unless a warrant is obtained from the appropriate Associate Circuit Court, within the appropriate time limit. - A person may be declared "**missing"** when their whereabouts are unknown and unexplainable for a period of time that is regarded by knowledgeable parties as highly unusual or suspicious in consideration of the person's behavior patterns, plans, or routines. - The entry should be listed as "Missing/Endangered" to ensure the pickup order remains in NCIC longer than **48** hours. - In the event that the arrest requires extended hospitalization, the Watch II Desk Sergeant of the coordinating division will create a guard duty schedule to commence after **72** hours. This rotation will include Central Patrol, Metro Patrol, and East Patrol Divisions only. The Patrol Bureau will be provided a copy of this schedule. - A department member will contact MPCC or Crimes Against Children as soon as possible. (See section II, C for notification guidelines.) NOTE: To adhere to Federal Guidelines, MPCC must be notified within **2** hours. - Court dates for summons and citations will be set between **twenty-eight and seventy-five** days from the date of arrest. This does not apply to domestic violence cases. - Per the **Interstate Compact** pertaining to juveniles, the department member will call the local family court where the juvenile was found and arrangements for securely detaining the juvenile will be made. - **Personnel Records Section (PRS)** Responsibilities: - On receipt of a request for a new or alternate timekeeper, arrange for training and obtainment of a password for the new or alternate timekeeping member. - Enter new timekeeper information into the designated timekeeping system. - Sworn members have limited authority to act upon civil matters and should contact a supervisor when they are unsure of what action to take. The **Office of General Counsel** should be contacted in instances when a member's position is uncertain. - **Detention Unit** personnel will verify the deserter status of persons arrested with a military desertion charge by contacting the appropriate military branch. - Issues and questions regarding PASS should be directed to the **KCPD PASS Administrator** of the Research and Development Division. - If the sworn member's primary duty firearm is not functioning properly, the sworn member is responsible for taking it to the department gunsmith or **FTTS (Firearms Training and Tactical Section)** armorers. - Any member contacted by the media for interviews in non-emergency situations should notify their supervisor and the **Media** Unit, preferably prior to the interview. - Regional Police Academy entrant officers are required to attend mandatory ride-alongs. Entrant officers may also request voluntary ride-alongs, with approval of the **Training Academy** sergeant. - The **Fiscal Division** retains a limited quantity of emergency credit cards intended for use during critical incidents in which a member may be assigned to a remote location where it is not practical to comply with standard procurement procedures. - All sworn members will qualify **twice** per year with their primary duty firearm and a shotgun under the Firearms Qualification Program. The qualification will include a day and a night fire/low light course for each firearm. - A valid **Type I** permit allows the permittee to determine the alcoholic content of blood from a sample of breath, blood, or urine utilizing standard quantitative chemical analytical methods as approved by the Department of Health. (This permit is held by Kansas City Police Crime Laboratory personnel.) - Receipts from authorized food expenditures will be submitted to the **Fiscal** Division for reimbursement. - A Communications Unit Supervisor will notify the **Office of General Counsel** on all police vehiculars. - Supervisors will ensure the vehicle operator faxes copies of the Form 154 P.D. to the **Fleet Operations Unit, Communications Support Unit, Office of General Counsel**, and the **prior to the end of their shift.** - Preventable vehicular history that falls within the previous **four** year period, which had similar contributing circumstances, will be considered in determining disciplinary actions. - The **Trespass** ordinance is not applicable in landlord/tenant disputes. - If a breach of peace occurs at any time during a Self-Help Repossession, the person repossessing should stop the actions they are taking and obtain a **Replevin Order** to repossess at a later date. - Bond agents or surety recovery agents who wish to surrender a party to the police department must obtain a signed **Recognizance Form** (surrender paper) from Municipal Court. - It is **Department of State's** policy to suspend the operator's license of foreign mission personnel not considered responsible drivers. - An **Area Command Field Force System** will be determined by a division supervisor/commander when an emergency situation can be contained in a small geographical area. - Officers/detectives who find misappropriated property in a pawnshop will contact the **Pawnshop Section** detective and provide that detective with all available information. - Serious injury/fatal vehicular accidents are considered crime scenes. If a vehicular is going to be investigated by the **Traffic Investigation** Section, the scene should be treated like any other crime scene. - The **Domestic Violence Section** will be notified, from the scene, on any incident involving an Order of Protection. - Pursuits are prohibited against the traffic flow of a divided highway unless prior approval is obtained from a supervisor/commander and the operator of the vehicle being pursued is fleeing to avoid a **felony** arrest. - **( )** will not become involved in a pursuit, without approval from the **controlling supervisor/commander** when an arrestee or any other non-department member is a passenger in the police vehicle. - **Probable cause** must exist to connect an item to a specified criminal activity prior to seizure. Proof beyond a reasonable doubt is not necessary. - Department vehicles being used for personal reasons that fall under the status of standby responsibility and call back responsibility will remain within a **_1_ mile radius** of the corporate city limits of Kansas City, Missouri to comply with being immediately available. - The **Commander** of the Records Unit will have final authority relative to any questions in ARS regarding nature of call, offense or report content. - The Return/Receipt for Search Warrant, Form 264 P.D. of seized property shall be delivered to the prosecutor's office in the county where the property was seized within **2** working days of the service of the warrant (RSMo 542.291) to include copies of the following. - Juveniles between the ages of **7 and 15** years old must regularly attend a day school not less than the entire term of the school. Officers are authorized to apprehend a juvenile who is found to be truant from school. - If there is a disagreement between the commander of IAU and the OCC Executive Director (Director) as to the subject matter and scope of an investigation: - The matter will be referred to the **Board** who shall have the power to resolve such disagreements. - (State statute and state warrant arrests admitted to hospital) Contact the **desk sergeant** of the division in which the hospital is located, when the arresting officers are assigned to the Traffic Division or the Special Operations Division. The **desk sergeant** will assume coordination responsibilities. - when struck, cause a rapid, controlled deflation of a vehicle's tire(s). These devices are installed in Patrol Division vehicles. - Ans: **Tire deflation devices** - When recovered property is needed in court as evidence, the affected member will notify the **Property and Evidence Section** no later than 1200 hours on the day prior to the scheduled court appearance. - Members operating a police vehicle that is involved in a collision involving a pedestrian, another vehicle, or a fixed object are responsible for completing a Police Vehicle Report, Form 154 P.D., whether or not there is actual damage to the police vehicle. Supervisors will ensure the operating member completes the report before their tour of duty ends or as soon a possible in the event the member is injured. The report, even if unapproved, will be faxed to the **Office of General Counsel**. - provide ventilation of a non-breathing adult, child, or infant. The mask eliminates the need for traditional mouth-to-mouth contact in Cardiopulmonary Resuscitation situations (C.P.R.). - Ans: **Laerdal Pocket Mask** - Missing/Runaway juvenile record keeping is performed by the **Crimes Against Children Section** of the Kansas City, Missouri Police Department - **Critical Incident Commander** - The Kansas City, Missouri Police Department Commander, with the rank of **Major** or above, who is responsible for the development and implementation of strategic decisions during critical incidents that require extraordinary measures to protect lives and achieve recovery. - When office furniture is in need of repair or replacement, the **Purchasing** Section will be notified via telephone or email. - Members are to utilize the website www.Drugs.com for assistance with identifying prescription drugs. Contact **DEU** personnel afterward for further instructions. - Any suspect/subject who is struck by a less-lethal extended range impact device will be transported to a **medical facility** for examination, regardless of whether or not the suspect/subject exhibits signs of injury or is under arrest. - Sworn members will be afforded **two (2)** consecutive qualification attempts with the personal rifle, if possible, prior to being enrolled in the remedial firearms program. - The **Medical Examiner's (ME) Office** will be notified and will respond to all confirmed death investigation scenes. - When a member's special assignment is scheduled to extend beyond a **28** day period, the member's immediate supervisor/commander will complete and forward a Form 191 P.D. through the chain of command to the Personnel Records Section, requesting the member's computerized time record be forwarded to the element where the special assignment will occur. - Arrestee's with a State Parole Violation Warrant will be taken to any **County Detention Center** when there are no active felony warrants or felony stop orders for the arrestee issued by this department. - A **"armed/potentially dangerous subject"** computer inquiry response is for officer safety purposes only and, in and of itself, does not provide reasonable suspicion or probable cause. - **Forced entry** is defined as "any entry that is uninvited." - If a person is bitten by a department canine, the officer(s) who requested canine assistance will ensure the person receives medical attention as soon as possible. Information concerning the bite will be incorporated in the narrative of the original offense report taken by the requesting officer(s). The **canine handler** will complete a Response to Resistance, Form 246 P.D., outlining the events leading up to the bite and any pertinent information thereafter. - All non-department members (i.e. vendors, contractors, city employees, city inspectors, and fire inspectors) must have a security profile completed by the **Building Operations** Unit before they are allowed access to any Department facility for non-department functions. - Each **month**, the Watch I Desk Sergeant at the Patrol Stations or Traffic Division and Special Operations Division will have all CEWs downloaded on the unit or division X26 Dataport. - **Strategic Re-Deployment** is a de-escalation technique used when law enforcement officers determine there is time to disengage and re-evaluate a situation and assemble the proper resources, equipment and personnel. The intent of resolving the incident with the lowest potential of injury or death to the general public, law enforcement officers and suspected criminals. - An arrest without a warrant but based on **probable cause** can be made in any public place. - A service member classified as a **deserter** is considered to be a felony offender. - The decision to tow a vehicle will never be made to **penalize** the owner/operator. - The **Bureau** Commander will make the final determination on all vehicular classifications. - If a juvenile is identified as a suspect, all interviews must be conducted with a **parent/legal guardian or attorney** present. - Ride-along participants are not permitted to have cameras or audio recorders/transmitters while on the ride-along, unless they have received prior approval from the **division commander or assistant division commander** and a **Deputy Juvenile Officer**. - Designate the assembly area for the command post and the safest route to the area. Consideration must be given to selecting an area out-of-sight of the perpetrator, close enough to be practical and large enough to park approximately **35** cars and the mobile command center. - A record entry in MULES/NCIC without the existence of a signed warrant, provided that the entering agency has probable cause to believe that the person has committed a felony, may attempt to flee to avoid capture, and the agency is in the process of procuring an arrest warrant from a court. - Ans: **Temporary Want** - The arresting sworn member will contact the **Warrant Desk** and provide the state warrant and ORI information from the arrestee's computer entry. (local state warrants) - If the possibility exists that the animal has rabies or has bitten someone, the animal should not be shot in the **brain**. In these cases, the animal should be shot in the chest cavity, directly behind either front leg. - Only sworn members of the **Tactical Response Teams** are authorized to use other extended range impact devices not mentioned within this written directive in compliance with current training practices. - Elements that do not have a department sanctioned petty cash fund, or those elements with an emergency request, may seek the necessary funds from the **Accounting** Section. - The **chemical breath** test is the primary method for determining blood alcohol content (BAC). - A member will be considered to have missed a radio call if they fail to answer the radio after having been called by the dispatcher **3** times. The dispatcher will allow **30** second intervals between calls for a reply. The **Fleet Operations Unit** will forward all damage estimates prepared on police vehicles to the Office of General Counsel. - If the Division Commander marks the box "Initiate Vehicle Accident Package", they will forward a copy of the endorsed Form 154 P.D. to the **Office of General Counsel** who will assemble the Vehicular Accident Package. - When a report is completed involving the accidental serious injury of a person who needs medical treatment (other than a vehicular accident), the Nature of Call will be “**casualty**”. - Sworn members using firearms approved for on or off-duty, plain clothes carry, or specialized duty functions are responsible for cleaning and maintaining the firearms in a **presentable and functional** condition at all times. - If laboratory personnel discover a discrepancy between the listed inventory and the submitted evidence, they shall notify the **Property and Evidence Section** so it may be noted on the original inventory report. - If an officer determines that no court dates are available, the officer will immediately complete and forward an Interdepartment Communication, Form 191 P.D., through their chain of command, to the **Municipal Court Liaison** Officer. - Sworn members will not become involved in repossessions except to the extent necessary to prevent a **breach of the peace**. - The **Data Entry Section** will be responsible for the final approval and transfer of all reports into RMS within **4** calendar days. - A **Crime Scene Investigations Section** supervisor will be contacted when a hazardous material is encountered as evidence and a sample is needed. - If the amount of seized currency is **$10,000** or more, the reporting officer will contact an Asset Forfeiture Squad Detective to determine whether a detective needs to respond to the scene. - A complete inventory of nonexpendable equipment shall be established and maintained by the **FSU (Financial Services Unit)**. - (re: inventory) The signed printout, any memorandum, and the video shall be forwarded through the Inventory Member's chain of command as soon as it is completed. - The printout should be received by the Accounting Section no later than **30** calendar days after receiving the request that the inventory be completed. - The **IAU** will be the primary investigative element on any incident that involves the unintentional discharge of a firearm which does not result in death or a criminal investigation or at the direction of the IAU commander. - Unless otherwise directed by court order, the **commander** of the Executive Services Bureau will be responsible for the disposition of all property seized in accordance with property forfeiture proceedings. - When involved in a police vehicular the supervisor will send all police vehicles to the **Fleet Operations Unit** for inspection and damage estimates. - The dispatcher will inquire if the subject is **10-12** prior to giving back want or warrant information. - To prevent tearing, the capacity of paper sacks shall not exceed **50** pounds. Double bagging some items may be necessary. - Calls received from a bond agent or surety recovery agent requesting police response to a location will only be dispatched when there is a **disturbance**. - A **repossession** is an action in which a creditor reacquires possession of property with the intent to deprive the debtor of any further control over the property. - Any use of an extended range impact device from a extended range impact projectile shotgun will be documented on the online **Response to Resistance** Form. - The **DEU** will be responsible for final disposition of all investigation arrest cases for possession of controlled substances except those cases initiated by the Street Crimes Unit. - The twenty-four hour/twenty-hour rules do not apply to persons arrested for a previously issued **warrant.** - Department members should determine if a missing person participates in Care Trak. Care Trak is an electronic tracking device that assists in locating persons who may wander off or elope due to conditions such as autism or dementia. If it is determined that the missing person participates in Care Trak, the department member should notify the on-call **Care Trak** team through the Communications Unit Supervisor from the scene regardless of time of day. - The **purchasing section** will provide each bureau commander with a list of cell phones and pagers assigned to their bureau, by March 31st of each year. - The commander of the **Traffic Investigations** Unit () will work with the commander of the Homicide Unit and assume responsibility as the overall incident commander for any incident that involves a police vehicular accident. - An arrestee will not be subject to a body cavity search unless a supervisor/commander has authorized the search and there is probable cause to believe that the arrestee is concealing: - A weapon, or - There is evidence of the commission of a crime, or - Contraband. - b. The sworn member will obtain written authorization from the appropriate **commander** authorizing the request for the search warrant. - c. The arrestee will be kept under close observation or isolation until a search warrant can be obtained. - If a person's vehicle sustains tire and/or wheel damage as a result of a tire deflation device, members will notify the **Fleet Operations Manager** or their designee from the scene. - During non-business hours members will contact the Communications Unit Supervisor to request notification of the **Fleet Operations Manager** or designee. - Members working off-duty assignments will complete any required offense reports in ARS within **2** hours of ending their off-duty employment. - The **Division** commander will determine the length of time an applicant will not be allowed to participate in the Ride-Along Program. - Sworn members will notify the **Intelligence** Unit when responding to a protest, demonstration, or a strike. - Officers should be aware that the breach of the peace limitation on repossession is only applicable to **self-help repossession** and does not apply where the property is repossessed by judicial action (Replevin Order). - Bond agents and surety recovery agents will be governed by the Missouri **Department of Insurance** but locally they will process and receive their qualifications through their respective county courthouse. - A valid **Type III** permit allows the permittee to operate breath analyzers to determine alcoholic content of blood from a sample of expired (alveolar) air. These permits must be renewed every **2** years. A minimum of **5** tests in the previous 12 months is required. - When an adult has been taken into police custody or is otherwise deprived of their freedom of movement in any significant way, it shall be the duty of the officer initiating custodial questioning to give the **Miranda Warning**. - Preventable vehicular history that falls within the previous **4** year period, which had similar contributing circumstances, will be considered in determining disciplinary actions. - All U.S. currency removed from a detainee, totaling **$250** or more, will be verified by a desk sergeant prior to sealing the detainee's property. - All vehicle pursuits, regardless of the duration, will be entered into the **PBR** on-line system. - The **Asset Forfeiture Squad** will be solely responsible for processing any request to transfer seized property to a federal agency. - Officers will photocopy completed property inventory and supplemental inventory report forms (if applicable) and forward them to the **Records Unit** prior to the end of their tour of duty. - When applicable, available quantities of videotapes, barcode stickers, and hard drives should be checked on a weekly basis by the Watch 2 desk sergeant or division operation sergeant. - Ans: **2** - Detention Unit personnel will verify the deserter status of persons arrested with a military desertion charge by contacting the appropriate military branch. As soon as practical, after all nonmilitary charges have been bonded or disposed of, the subject will be transferred to the custody of the **Jackson County Dept. of Corrections** where the subject will be held for the appropriate military authorities. - Children less than **4** years of age, regardless of weight, will be secured in a child passenger restraint system appropriate for that child. - The **Office of General Counsel** should be consulted for clarification on any legal matters relative to obtaining and executing search warrants prior to the execution of the warrant. - The duty manual will be reviewed for possible revisions yearly. An electronic copy will be forwarded to RADD by **February** 1st of each year - Members should not pass to the **right** of a vehicle in traffic during Code One Operation unless absolutely necessary and should anticipate the possibility of a citizen's vehicle moving to the right in front of the police vehicle. - The department approved on-duty firearm for sworn members will be called their **primary duty firearm**. - A service member classified as **AWOL** will not be arrested for this type of military status. - **DISCONTINUE USE OF AND TURN OFF ALL ELECTRONIC DEVICES WITHIN 100 YARDS (THE LENGTH OF A FOOTBALL FIELD).** Electronic devices may detonate an explosive device. - The **Asset Forfeiture** Squad will be responsible for conducting and coordinating the necessary follow-up investigation only as it pertains to property forfeiture proceedings. - The **transporting** member has the final responsibility to thoroughly search the arrestee before transporting. - If an officer is not available to answer a call within his/her sector in an allotted **4** hours, that call will be dispatched to other sectors for handling. - The **DEU** will be responsible for final disposition of all investigation arrest cases for possession of controlled substances except those cases initiated by the Street Crimes Unit. - The twenty-four hour/twenty-hour rules do not apply to persons arrested for a previously issued **warrant.** - Department members should determine if a missing person participates in Care Trak.
