The entire land measuring about 64 (Sixty Four) Bighas is laying and situate within Dihi Panchannagram Estate under the Division-4, Sub-Division-K, Holding No.120 of the Mouza-Nimakpoktan, South-24- Parganas which is hereinabove called and referred \"the Land\" and is a revenue payee permanently settled land under the Collector South 24- Parganas, Kolkata Khasmahal Section and is governed by the Land Registration Act, 1876 and is permanent hereditary and transferable, hereinafter referred to as \"the Act\". In respect of all the land under the Collector, South 24-Parganas, Kolkata Khasmahal Section, the Bengal Tenancy Act, 1885, the West Bengal Estates Acquisition Act, 1953, the West Bengal Non-Agricultural Tenancy Act, the West Bengal Land Reforms Act, 1955-Section\[1\]\[2, are not applicable and within the exclusion sections of the said Acts. By the word Panchannagram, it means total Fifty Five villages. Those fifty five villages, after the battle of Palasi, were awarded to Lord Clive as Pension by Mirzafar for helping him to conquer the battle in 1757. There are Fifteen Dihis. The Fifty Five villages were known en-block as Dihi Panchannagram. Mouza- Nimakpoktan is within the Dihi-Entally, one of the Fifteen Dihis of the Dihi Panchannagram Estate under the Collector, South 24-Parganas. 3\. The said land is laying and situated on the Southern Bank of Beleghata Canal within Canal South Road No. 1 to 14 & 14-1 and 15 to end as stated in the Bengal Act, III of 1923 corrected upto 1932 from the Book \"List of Streets in The City of Calcutta\" as published by the Corporation of Calcutta in 1933. To show that the land always was/is within the boundary of Calcutta I am referring the said Book (upto 1981). Even in the year of 1932, the said land was within the Calcutta Municipal Corporation. The land is within the Ward No.57 of the Kolkata Municipal Corporation and was always and is always within the boundary of Calcutta. It is found from the list of streets upto 1932. In support of my Client I am annexing the relevant pages of the said Book \"List of Streets in The City of Calcutta\" as \"Annexure-P-2\". 4\. That as per the substance of the Rent Roll Registrar-I, the names of the predecessors-in-interests of the Proprietors/Owners therein were mutated in the Revenue Records in respect of Division-4, Sub-Division- K, Holding-120, Mouza-Nimakpuktan, vide mutation Case No. 987 of 1956-57, Case No.1025 of 1958-59, Case No. 327 of 1960-61 and Case No.481 of 1960-61 respectively. My clients (Sen family of Baharampore, District Murshidabad) were/are the permanent settlees of the land since 1956-57 and Suhasini Sen and others were recorded owners as per the Rent Roll Registrar-I. The Khasmahal land is permanent hereditary and transferable. As such, my client and others who claimed to be the legal heirs of the Registered Proprietors entered into the Rent Roll Register since 1956 and 1957 onwards are the rightful bonafide Owners of the holding as mentioned above. As per the RTI information dated 20.10.2014 in respect of the said holding land, the said land is a permanent settled land in favour of the predecessors-in-interests of the Proprietors/Owners as stated therein. A Copy of the RTI Application dated 10.08.2015 and the Information Memo No. 323/LR/KM dated 20.08.2015 are enclosed herewith as \"Annexure-P-3\". 5\. The Revenue for the entire land were being paid for the year from 1360 B.S. upto 1418-19 B.S on behalf of the predecessors-in-interest to the office of the Collector as per the record in the Rent Roll Register-I, Nimakpuktan Mouza, under the Division-4, Sub-Division-K, Holding No. 120. Under the Land Registration Act, 1876, the Collector of every District preserves a Register showing Mouzas/names of recorded Proprietress/Quantum of the land/quantum of Khajana. My clients are paying Khajana/Revenue to the Collector South 24-Parganas available since 1385 to 1418-19. Now the receiving of Khajans/revenue has been stopped by the office for fixation of revenue. Fact that My clients have originated their title from their predecessor-in-interest will be clear from the other Five mutation cases which was prepared by the Office of the Collector after a hearing for Mutation of names of another place of permanent settled land of my clients and due to fixation of revenue, due to the fact the mutation cases are withheld, otherwise the cases are fit for mutation. The Revenue collection and mutation has been stopped presently for the fixation of revenue by an order of the Competent Authority, as such, Revenue Rent could not be deposited further. Copies of the Status Report vide Memo No.413/LR//KM dated 23.11.2015, List of the Pending Mutation Cases before the Collector, issued by the Additional District Magistrate to the Deputy Secretary to the Govt. of West Bengal, the copy of the Resolution of the Mayor-in- Council being Item No. M-12.8 dated 21.02.2011 in connection with mutation of the Kolkata Khasmahal properties, the Revenue Payment Receipts, are enclosed herewith collectively as \"Annexure-P-4". 6\. That it is pertinent to be mentioned here that the provisions of the Bengal Tenancy Act, 1885, the West Bengal Estate Acquisition Act, 1953 and the West Bengal Land Reforms Act 1955 and the Rules framed thereunder have and had no over ridding effect over the provisions of the Land Registration Act, 1876 and in otherwise the provisions of the West Bengal Estate Acquisition Act, 1953 and the West Bengal Land Reforms Act, 1955 and its allied Rules are not being applicable in the case and within the exclusion of the said Acts since the Estate as described hereinabove is located within the ambit of the Ward Nos. 1 to 100 under the Kolkata Municipal Corporation area and under the Schedule-1 of the Kolkata Municipal Corporation Act, 1980. Accordingly, existence of wrongful R.S, L.R. revenue records in the Office and official information system of the BL. & LRO at Kolkata for the Mouza-Nimakpuktan is illegal and not permissible under the laws. 7\. In this regard, one Letter on behalf of my Client was served through the Learned Advocate Sri Amal Kanti Das on 18.03.2011 to the Principal Secretary, Govt. of West Bengal stating all the facts of such C.S., R.S. and. L.R. Mutation of revenue record. Thereafter, on the basis of the said Letter, the Assistant Secretary to the Govt. of West Bengal, Land and Land Reforms Department, vide its Letter Memo No. 3126-1S dated 11.05.2011 requested the BL and LRO, ATM Kasba to cause an inquiry into the matter and send a detailed report to the Department early. A copy of the said Letters dated 18.03.2011 and 11.05.2011 are enclosed herewith collectively as \"Annexure-P-5\". 8\. In this regard, the Assistant Secretary to the Government of West Bengal vide Memo No. AS-1707/LA/3M-151/11 dated 08.12.2011 informed to the ADM & DL & LRO, office of the Collector, Kolkata Khasmahal Section, Alipore, South 24-Parganas, that he is directed to request him to instruct the BL & LRO, ATM, Kasba, to stop the LR mutation in respect of the land in question with immediate effect and until further order and to send the related papers regarding the land and its jurisdiction of the BL & LRO, ATM, Kasba and to send a report on the classification of the subject land in question to the Department immediately. But it is surprising that no further step has been taken for the cancellation of C.S., R.S., and LR revenue record from the status of the Office record and the official information system from the BL & LRO office and no further report of compliance has been sent to the Deputy Secretary, Land and Land Reforms Department, Government of West Bengal till date in this regard and to my client also. A Copy of the Memo No. 18/5394/BLLRO/ATM/KASBA/11 dated 22.12.2011 is enclosed herewith as \"Annexure-P-7\". 10\. Copy of the Memo dated 04.02.2012 is enclosed herewith as \"Annexure-P-8\". 11\. Ultimately, the Deputy Secretary to the Government of West Bengal, vide its Memo No. 1251/3 GE(M) dated 07.03.2012 passed the Order requesting the District Magistrate and Collector, South 24- Parganas, Kolkata Khas Mahal Section, New Treasury\' Building, 8th Floor, Alipore, Kolkata-700027 to take immediate steps to cancel the C.S., R.S., and L.R, Mutation in respect of Khasmahal land measuring 64 Bighas in Mouza-Nimakpoktan, in respect of the Division-4,Sub- Division-K,Holding-120, District-South 24-Parganas since in respect of Khas Mohal land, the Bengal Tenancy Act, the West Bengal Estate Acquisition Act and the Land Reforms Act 1955 etc. are not applicable and within the excluded Sections of the said Acts. It has also been requested to initiate proceedings under the provisions of the Land Registration Act, 1876 for mutation of the subject land in favor of successor-in-interest of the recorded settlees as per Rent Roll Register-I and send a report of compliance to the Department at the earliest but till date nothing has been done in effect. A Copy of the Order vide Memo No.1251/3M-30/12GE(M) dated 07.03.2012 passed by the Deputy Secretary, obtained from the office of the Collector, Kolkata Khasmahal Section, vide Memo No No.341/LR/KM dated 12.09.2017 issued under the RTI Information is enclosed herewith as \"Annexure-P-9\". 12\. The land is within the purview of the Land Registration Act, 1876 and the Estate as described hereinabove is located within the ambit of the Ward Nos. 1 to 100 under the Kolkata Municipal Corporation area and under the Schedule-I of the Kolkata Municipal Corporation Act, 1980. As such, mutation of the land as per the R.S, L.R. Records as shown in the official information system of the BL & L.R.O. are illegal and is not tenable under the laws which are required to be totally stopped and cancelled and my Clients are facing a lot of problems in dealing with their lands within the Division-4, Sub-Divisions-K, Holding No. 120, Mouza-Nimakpoktan under Dihi Panchannagram Estate for mutation of the subject lands in favour of successor-in-interest of recorded settlees as per Rent Roll Register-I under the provisions of the Land Registration Act, 1876 before the Collector, South 24-Parganas. 13\. In this regard, I am demanding justice from all the concerned appropriate authorities of the Kolkata Municipal Corporation, to take the appropriate steps for implementing the said Order (Annexure-P-9) and to pass the appropriate Orders to ensure that no mutation of the concerned land as mentioned hereinafter below of C.S. and R.S., Dag numbers should be allowed corresponding to the land under the Division-4, Sub-Division-K, Holding No. 120 of the Dihi Panchannagram Estate of Mouza-Nimokpoktan since these are illegally and unlawfully and arbitrary on the land of my client measuring 64 Bighas consisting of under the Division-4, Sub-Division-K, Holding No.120, JL No.1,Touzi No.1298/2833, Mouza-Nimakpuktan under the jurisdiction of the Collector, Kolkata Khasmahal Section South24-Parganas and as such, the C.S and R.S and L.R. revenue records are liable to be cancelled under the provisions of the Statutes and should not enter into the record of the concerned Assessment Registrar of Registration. 14\. It is further pertinent to mention here that the land under the Division-4, Sub-Division-K, Holding No-120 has not been acquisitioned by the Land Acquisition Collector, Kolkata as per the RTI Information Memo No. 720-LA dated 11.09.2018. In support of my statement I am annexing the Memo No. 720-LA dated 11.09.2018 for clearance from the First Land Acquisition Collector, Calcutta as \"Annexure-P-10.\" 15\. In this regard, recently for mutation purposes of the part of the un-assessed land of my client in the Holding No.120, an information was sought for by the Assessor-Collector\[South\] of the Kolkata Municipal Corporation on 28.08.2021 and the reply was made by the office of the Collector, Kolkata Khasmahal Section regarding the names of the permanent settlees vide Memo No.220/LR/KM dated 07.09.2021. Copies of the said Memo dated 28.08.2021 and 07.09.2021 showing the names of the recorded owners are annexed as \"Annexure-P-11.\" 16\. But it is a matter of great regret that despite of such clear provisions in the laws and the documents as mentioned above that these areas under the Ward No.57 comprised of the City of Calcutta and was/are not/never the added areas with the City of Calcutta. Accordingly, the C.S and R.S, L.R Dag numbers mutated on the basis of the revenue Record of Rights (Parcha) on the land issued by the BL & LRO Department corresponding to the land under the Division-4, Sub- Division-K, Holding No.120 of Dihi Panchannagram Estate of Mouza- Nimokpoktan of my client are to be declared cancelled as per the \"Annexure-P-9\" above and the earlier mutation thereof should have no effect whatsoever may be under the relevant provision of the laws. For your such activities on your part some persons are so daring that they are filling the water body and raising the illegal constructions without the permission of any Competent Authority with a malafide intention to change the nature and character of the said land for their illegal gain. 17\. That the abovementioned order/directions with all other earlier order/directions are binding upon you and you are under a duty to ensure that the abovementioned decisions are complied with. Further and in any event, as per the provisions of the laws you are under the duty to implement the laws and give effect to the specific provisions of the Acts and to protect the property of my client from interference by unauthorized persons and to stop the mutation on the basis of the C.S., R.S. and L.R., records and ultimately to cancel the concerned C.S, R.S and L.R records and to publish the correct records up-to-date. 18\. Dag Numbers which are to be effected by the cancellation which are corresponding to the total land under the Smart Survey Map of my client measuring 64 Bighas consisting of under Division-4, Sub-Division-K, Holding No.120, J.L.
