In the fiercely competitive Sollywood industry, Raj and Rahul Mehra were legends in their own right. The Mehra brothers grew up in a family deeply rooted in the film industry. Their father was a renowned director, and their mother was a celebrated actress, so it was no surprise that both brothers decided to follow in their parents' footsteps. Raj pursued filmmaking, while Rahul excelled in production and finance. Together, they created a brand that was synonymous with quality cinema, earning them respect and recognition in the industry. 2. The Mehra brothers achieved moderate success with a series of films, but their last major hit was in 2023 with the film "Love Ke Liye Lahore Se L.A." This film starred budding actress Sara Kapoor which became a blockbuster hit, earning over 200 crores within 10 days of its release on January 1, 2023. Despite several rumours that Sara was casted in the film because of her affair with Raj Mehra, the movie was an astounding success and catapulted Sara to fame making her one of the most in-demand actresses in Sollywood. 3. However, the Mehra brothers faced severe financial difficulties after a string of box-office failures that followed. Although they owned significant assets, their financial situation worsened due to mounting debts and failed projects. Their desperate attempts to revive their fortunes led to risky decisions that only worsened their financial instability. 4. During the filming of "Love Ke Liye Lahore Se L.A.," Sara met Ranbir Singh, a well- established actor. Their on-screen chemistry led to a real-life relationship that became a hot topic in the media. Although there were rumors and speculation about Sara's affair with the director, Raj Mehra, she made it clear that she had no interest in working with him again and remained devoted to Ranbir. Their relationship was often in the spotlight, with tabloids speculating about their future together. Despite the public scrutiny, they remained committed to each other, often seen together at industry events and private gatherings. 5. On July 21, 2023, the Mehra brothers faced an abrupt financial downfall due to problems with their latest movie, "Khiladi 6106." The project suffered from overbudget productions, and a copyright infringement case led to a temporary injunction against its release, further exacerbating their financial troubles. This legal battle drained their resources and delayed the film’s release, causing significant losses. The stress of these setbacks began to take a … 4 TRIAL PROPOSITION INTERNAL TRIAL RANKING ROUNDS 2024-2025 toll on their personal and professional lives, leading to increased tensions within their production house. 6. On November 30, 2023, Sara Kapoor announced her new movie, "Dil ki Dastaan," where she would star alongside her boyfriend, Ranbir Singh, as the male lead. The announcement generated significant buzz in the industry. It is at this juncture, that the Mehra brothers made desperate attempts at signing Sara for their upcoming films. 7. A year later, on August 1, 2024, invitations were sent out for a grand release party of "Dil ki Dastaan," to be held on a luxurious cruise ship, the Odyssey. The party was scheduled for August 14, 2024, and was set to be a star-studded event with the who’s who of Sollywood in attendance. The cruise was the talk of the town, with many speculating that it would be a night to remember. 8. The cruise party began at 8:00 PM on August 14, 2024. Throughout the evening, tensions were evident. At around 11:30 PM, Sara was seen having a brief, tense conversation with the Mehra brothers in the ship’s elegant dining area. Sara was later seen walking out of the dining area, visibly distressed. She also had a heated argument with Ranbir Singh near the ship’s exclusive "Celestial Lounge," a secluded and opulent area with restricted access located on the upper deck, at around 12 45 A.M. 9. Sara was last seen heading towards the Celestial Lounge’s private observation deck, which offered panoramic views but was also isolated. Sometime around 2 A.M, the guests who were on the lower deck of the ship heard a loud splash in the water. A frantic search ensued, and her body was discovered in the water at approximately 2:30 AM. The circumstances of her fall remain unclear, leading to widespread speculation. The ship, once a site of celebration, quickly became the focal point of a potential criminal investigation. 10. By 3:30 AM on August 15, 2024, local authorities boarded the cruise ship to begin their investigation. ACP Markhandeya was appointed as the investigating officer immediately. An FIR was registered against Raj and Rahul Mehra based on the initial findings and witness statements. Subsequently, they were arrested. Charges were filed under Section 103, 3(5) r/w 61 of the Bharathiya Nyaya Sanhitha. … 5 TRIAL PROPOSITION INTERNAL TRIAL RANKING ROUNDS 2024-2025 COMMITTAL ORDER IN THE COURT OF THE PRINCIPAL SESSIONS JUDGE, Andhera S.C. Upon arriving at the cruise, I briefly investigated the scene and conducted the Spot Panchnama at 3:30 A.M. The body was sent for post mortem. Seized items were sent for forensic analysis. Witness statements were taken. Upon receipt of the reports and with study of witness statements, it is clear that the accused have committed the crimes they are charged with. The prime accused of the case, Raj Mehra and Rahul Mehra had a strong motive to kill the deceased as they were suffering from severe financial crisis since years and the only way for them to get out of it was to cast the deceased to recover their strong position in the industry. After multiple rejections from the deceased and after the blackmailing, both accused got angry and frustrated and in that fit of rage, they have committed the murder of the deceased by pushing her from the ship. 12. I quickly informed the crew of the ship so that they can pull her up but after they pulled her up, everybody was shocked to see that she was dead. ACP Markandaya under Section 180 of the BNSS I am ACP Markandaya. I am the Investigating Officer for this case. I am currently posted at the Naval Andhera Coastal PS. On the 15th August, 2024, at around 3:00 am., I got a call from the Odyssey about Sara Kapoor's possible demise. On receiving this information, we arrived at the ship dock at around 3:20 am and went up to the cruise ship where the party was held. The body of Sara Kapoor was found floating in the water near the starboard side of the ship at around 2:30 AM by the onboard emergency response team. The last confirmed sighting of Sara was in the Celestial Lounge, a secluded area on the upper deck, at 1:00 AM, where she was with Raj and Rahul Mehra. The spot panchnama was completed at 4:00 AM. We found that the Celestial Lounge area was in disarray, with furniture and items disturbed, suggesting a struggle. The railing near the observation deck was slightly bent and the nearby floor had scuff marks and broken glass. Upon analysing the ship’s railing, it was noted that the height and structure made it unlikely for someone to accidentally fall over it. We recovered a broken wine glass, Sara’s mobile phone, and some items from witness bags, including a letter and a prescription. Nevertheless, after conducting a thorough investigation and reviewing the witness statements, post-mortem results, and forensic science laboratory reports, the evidence suggests that Sara Kapoor’s death was not an accident but a deliberate act. The circumstances and findings point towards a premeditated action to cause harm, and the investigation will continue to identify and hold accountable those responsible for this tragic event. … 37 TRIAL PROPOSITION INTERNAL TRIAL RANKING ROUNDS 2024-2025 PROSECUTION WITNESS STATEMENTS WITNESS STATEMENT OF PROSECUTION WITNESS NO.2 Security Guard Ravi Kumar under Section 180 of the BNSS I, Ravi Kumar, am employed as a security guard aboard the Odyssey. On the night of August 14, 2024, a grand party was hosted on the cruise, attended by various esteemed guests, including the well-known actress, Sara Kapoor. My responsibilities included monitoring the entrance, ensuring the safety of the guests, and maintaining order throughout the event. I was stationed at the main entrance of the cruise from 6:00 PM onwards. The party commenced at approximately 8:00 PM. Guests began arriving around 7:30 PM, and I verified their invitations as they boarded. I remember the actress arriving around 8:15 PM. She was wearing a red gown and appeared to be in good spirits, greeting everyone warmly as she entered. Throughout the evening, I patrolled the main deck and guest areas, ensuring everything remained calm and secure. However, at around midnight, something appeared unusual when Sara Kapoor was observed appearing distressed during her conversations first with the Mehra brothers and then shortly afterward with her boyfriend, Ranbir. I recall that around 1:20 AM, Sara Kapoor was in the Celestial Lounge with Raj and Rahul Mehra. They were shouting, although I don’t remember the exact words, but it included phrases like 'facing consequences' and 'wait and watch' at the start. The situation seemed to escalate, but I had to leave the area as it required special access and I wasn’t authorized to stay there. But approximately at 2 am, I heard a loud splash in the seawater. I immediately proceeded to the area, where I found a group of guests shouting at the water. They seemed distressed, and I was informed that Ms. Sara had fallen into the water and was unresponsive. I immediately contacted the cruise's medical team and and alerted the authorities. The cruise was promptly locked down to prevent anyone from leaving until the police arrived. Though this was my first time seeing Sara, who was very approachable and cheerful, I was disturbed by the harsh interactions she had with others, and I am deeply saddened by the tragic events of that evening; I extend my condolences to her family and friends and am committed to assisting the investigation in any way possible to ensure justice is served. … 38 TRIAL PROPOSITION INTERNAL TRIAL RANKING ROUNDS 2024-2025 PROSECUTION WITNESS STATEMENTS WITNESS STATEMENT OF PROSECUTION WITNESS NO.3 Vikram Desai under Section 180 of the BNSS I have been Sara Kapoor’s personal assistant for many years, and in that time, I have seen her go through numerous challenges in her career. Recently, Ms. Sara was under immense stress due to the Mehra brothers, Raj and Rahul. They were pressuring her to star in another film, even though she had made it clear that she didn’t want to be typecast into the same roles. Sara was a dedicated actress who wanted to explore different characters, but the Mehra brothers were relentless, and it was really getting to her. Sara was particularly frustrated with Raj Mehra. She felt manipulated and trapped by their demands, which led to a lot of tension between them. I remember her expressing fear about what might happen if she refused them, given their significant influence in the industry. I could see the toll it was taking on her, both mentally and emotionally. At the party on the cruise ship, I observed Sara in distress. I stayed close by, watching her as best I could, but there was a lot happening that night. The last time I saw Sara, she was with Raj and Rahul Mehra in the Celestial Lounge, engaged in a heated argument. Although I couldn’t hear all the details, it was clear that the confrontation was intense. Due to my position and the restricted access in that area, I couldn’t intervene. Shortly after, I heard a splash, which caused immediate panic. I never imagined it would end like this. Sara was a wonderful person who didn’t deserve the pressure and fear she was living under. … 39 TRIAL PROPOSITION INTERNAL TRIAL RANKING ROUNDS 2024-2025 PROSECUTION WITNESS STATEMENTS WITNESS STATEMENT OF PROSECUTION WITNESS NO.4 Ranbir Singh under Section 180 of the BNSS My name is Ranbir Singh, and I have been an actor in the film industry for several years. I met Sara Kapoor on a film set, and we quickly became a couple. Despite constant media scrutiny, I truly loved Sara and was protective of her, both personally and professionally. In the days leading up to the party, Sara was under immense stress. She often spoke about the Mehra brothers pressurising her to star in their next movie, which she did not want to do. She felt manipulated by them and was very upset about the situation. The pressure from the Mehra brothers only added to her anxiety and frustration. We arrived at the party on the cruise ship together, hoping to relax and resolve some of our personal issues away from the public eye. However, Sara’s distress was evident. There were several heated exchanges between Sara and both Raj and Rahul Mehra. The tension between them was severe, and Sara seemed particularly agitated after each encounter. As the night went on, Sara became increasingly unsteady, likely due to a combination of the chaos in the party and stress. I tried to stay near her, but the crowded and lively atmosphere made it difficult. Despite my efforts to comfort her, she remained agitated and anxious. The last time I saw Sara was around 1 AM, just before she went back to the Celestial Lounge. Feeling guilty for the senseless argument we had earlier due to misunderstandings, I decided to write a love letter to express my feelings. I quietly placed it in her bag, hoping she would notice it later. Afterwards, I waited near the dining area, reflecting on the situation. Shortly after, I heard a loud splash, and chaos ensued as we realized Sara was missing. Her body was later found floating in the water. Sara Kapoor was a dedicated actress facing significant pressure from the Mehra brothers, and on the night of the party, she was clearly under stress. I believe the pressure from the Mehra brothers greatly contributed to her emotional turmoil. Sara was not just a rising star in the film industry but also a person who cared deeply about her craft and her integrity. Her death has deeply affected me, and I am determined to ensure the truth of that night is revealed. … 40 TRIAL PROPOSITION INTERNAL TRIAL RANKING ROUNDS 2024-2025 PROSECUTION WITNESS STATEMENTS WITNESS STATEMENT OF PROSECUTION WITNESS NO.5 Dr. Sudha Mehta under Section 180 of the BNSS My name is Dr. Sudha Mehta, a forensic pathologist at City Hospital in Bombai with over 15 years of experience. I conducted the autopsy on Sara Kapoor following her death on the cruise ship. Upon receiving her body, it was waterlogged, consistent with brief submersion. There were no obvious external injuries, but I noted minor bruising on her arms, legs, and a head injury indicative of blunt force trauma, inconsistent with a simple fall. During the autopsy, I confirmed drowning as the cause of death, with congested lungs filled with fluid. The toxicology report showed high alcohol levels, along with traces of SSRIs like Sertraline and Escitalopram—typically not prescribed together—indicating significant intoxication and sedation. The combination of these substances, especially with alcohol, would have severely impaired her cognitive and motor functions. Additionally, minor bruises on her upper arms and thighs suggested forceful grabbing, while small abrasions on her hands and knees hinted at a possible struggle. Given her intoxicated state, it seems unlikely she could have climbed or fallen over the railing unaided. The combination of high alcohol levels, the presence of sedatives, and the minor bruising all suggest that Sara Kapoor was in a highly vulnerable state at the time of her death. While drowning was the cause of death, the circumstances leading to her falling into the water remain questionable. The level of intoxication, coupled with the sedatives, would have severely impaired her ability to make rational decisions or protect herself. In my professional opinion, the evidence does not entirely support the theory of an accidental fall. The bruising and the condition of the railing suggest that foul play cannot be ruled out. While Sara Kapoor’s death resulted from drowning, it occurred under suspicious circumstances that warrant further investigation. … 41 TRIAL PROPOSITION INTERNAL TRIAL RANKING ROUNDS 2024-2025 DEFENCE WITNESS STATEMENTS WITNESS STATEMENT OF THE ACCUSED NO.1 Raj Mehra under Section 180 of the BNSS My name is Raj Mehra. I have been a filmmaker in the Bollywood industry for many years, with a record of 7 blockbuster films out of 14. I am deeply saddened by the tragic and unexpected death of Sara Kapoor. I have always held Sara in high regard for her professionalism and her contribution to the success of my films. My relationship with Sara Kapoor has always been purely professional. She played a significant role in the success of our last blockbuster film three years ago, and for that, I am immensely grateful. Despite our recent financial struggles, Sara’s talent and dedication to her work were always evident, and I admired her for that. I noticed a significant change in Sara's behavior after she started her relationship with Ranbir Singh. For instance, about a year ago, I had dinner with Sara where she was excessively intoxicated, a behavior that was very uncharacteristic of her. Prior to her relationship with Ranbir, Sara was always composed and maintained her limits, even in social settings. On the night of the unfortunate incident, my brother Rahul and I were focused on convincing Sara to take up a new film project. Given our recent financial difficulties, this movie was crucial for both our careers. We had informed Sara about the project earlier, but we had not received any response from her. When we met Sara at the party, we attempted to discuss the movie with her. However, she was extremely intoxicated and misinterpreted our attempts to convince her as a confrontation. Ranbir Singh, who was protective of Sara, intervened multiple times due to a miscommunication. Ranbir’s protective nature was often perceived as anger, especially towards Sara. Throughout the night, I interacted with Sara 2-3 times, trying to convey the importance of the movie. Each time, due to her intoxicated state, our conversation was misinterpreted as an argument. After our final attempt to speak with her, we left her to join the main party area, intending to let her enjoy the night. The last time I saw Sara, she appeared to run off to another side of the ship, seemingly wanting some space. … 42 TRIAL PROPOSITION INTERNAL TRIAL RANKING ROUNDS 2024-2025 DEFENCE WITNESS STATEMENTS WITNESS STATEMENT OF THE ACCUSED NO.2 Rahul Mehra under Section 180 of the BNSS My name is Rahul Mehra. I work in the Bollywood industry alongside my brother Raj Mehra. I oversee both filmmaking and financial aspects of our production house. Additionally, I manage financial affairs for other companies, but my primary focus is our production business. I am deeply saddened by the untimely and tragic death of Sara Kapoor, who was not only a professional associate but also a close friend. I have known Sara since the early days of my production career. She auditioned for a role in one of our movies and was a perfect fit, leading to a blockbuster success. Our professional relationship grew into a close friendship as we spent significant time working together. However, after her meteoric rise to fame and her relationship with Ranbir Singh, Sara began to distance herself from the industry and her behaviour changed noticeably. She became more secluded and less involved in the industry, which I believe was influenced by Ranbir’s protective nature. Sara confided in me about her feelings and struggles, and on one occasion, she mentioned being on anti-depressants but quickly changed the subject. On the night of the unfortunate incident, my brother Raj and I intended to discuss a lead role in our new series with Sara. We had already reached out to her but received no response. At the party, we spoke to her 2-3 times at the start and midway of the party, trying to persuade her to accept the role. Sara appeared highly distressed and intoxicated, making it challenging to have a conversation. Ranbir Singh repeatedly interrupted our discussions, insisting that Sara was too intoxicated to make any decisions and accusing us of being overly persuasive. Ranbir’s anger was evident, and his protective nature seemed to escalate the situation. We decided to end the conversation to avoid further conflict and returned to enjoy the party. After our final attempt to talk to Sara, I went to get a drink and rejoined the party in the lounge area. I was unaware of the events unfolding outside. Later, I learned that Sara had fallen overboard and drowned. Witnesses reported hearing her scream, but I did not hear anything as I was inside the lounge area at the time. … 43 TRIAL PROPOSITION INTERNAL TRIAL RANKING ROUNDS 2024-2025 DEFENCE WITNESS STATEMENTS WITNESS STATEMENT OF THE DEFENCE WITNESS NO.1 Amit Singh under Section 180 of the BNSS My name is Amit Singh. I, Amit Singh, am employed as a waiter by Odyssey. I have been working with the company for the past five years and was assigned to serve at the event hosted on the cruise ship on the night of August 15th, 2024. I was responsible for catering to the Celestial Lounge, where many prominent guests including, but not limited to Ms. Sara Kapoor, Mr. Ranbir Singh, Mr. Raj Mehra, and Mr. Rahul Mehra had access. Throughout the evening, I observed Ms. Sara Kapoor drinking heavily. She appeared to be under a great deal of stress and consumed several glasses of wine and other alcoholic beverages within a short period of time. By around 11:00 PM, she seemed visibly intoxicated—her speech was slurred, and she was unsteady on her feet. I noticed Ms. Kapoor engaging in multiple conversations with Mr. Raj Mehra and Mr. Rahul Mehra. While the discussions appeared intense, I did not witness any physical altercation or raised voices between them. Mr. Raj Mehra, in particular, seemed concerned about Ms. Kapoor’s well-being and tried to assist her when she appeared disoriented. Mr. Ranbir Singh, on the other hand, seemed particularly attentive to Ms. Kapoor. I noticed him closely watching her interactions with others, especially with Mr. Raj and Mr. Rahul. At one point, I overheard a conversation between Mr. Ranbir and Mr. Raj that seemed quite tense. Mr. Ranbir appeared to be accusing Mr. Raj of something related to Ms. Kapoor, but the exact details were unclear. After this conversation, Mr. Ranbir appeared more on edge, frequently checking on Ms. Kapoor and intervening when she interacted with others. Ms. Kapoor's behavior became increasingly erratic as the night progressed. I overheard her making several incoherent statements and noticed her stumbling multiple times. At one point, she almost knocked over a table, and I had to intervene to prevent an accident. It was clear that she was not in a stable condition. That was the last time I saw or had an interaction with Ms. Kapoor until the tragedy unfolded. … 44 TRIAL PROPOSITION INTERNAL TRIAL RANKING ROUNDS 2024-2025 DEFENCE WITNESS STATEMENTS WITNESS STATEMENT OF THE DEFENCE WITNESS NO.2 Karan Patel under Section 180 of the BNSS My name is Karan Patel, and I’ve known Raj Mehra since childhood. We grew up like brothers, and Raj is one of the most humble, genuine, and kind-hearted people I know. Despite the pressures of the film industry, Raj has always remained grounded and deeply cares about the people he works with. I’ve managed the finances for the Mehra brothers and witnessed the pressures they’ve faced. Raj, especially, felt the weight of the industry’s unpredictability but never compromised his values or respect for others. He discovered Sara Kapoor during a talent search, saw her potential, and cast her in a leading role, which launched her career. Even after she moved away from his type of films, Raj respected her decision, though it clearly distressed him. He never spoke ill of her and always hoped they might work together again. Throughout the evening, I witnessed Raj and Rahul repeatedly trying to calm Sara down. They were sincerely concerned about her erratic behavior and her excessive drinking. At one point, I saw Raj quietly pull Sara aside, speaking to her in a gentle and supportive manner, trying to understand what was troubling her. Rahul also attempted to talk to her several times, but Sara seemed unresponsive and irritable, brushing off their efforts. By the time the evening reached its peak, Sara was visibly intoxicated. She was stumbling, slurring her words, and appeared to be in a highly emotional state. Although I don’t remember clearly, the last time I ever saw her was standing by the railings all by herself alone with a drink in her hand. … 45 TRIAL PROPOSITION INTERNAL TRIAL RANKING ROUNDS 2024-2025 DEFENCE WITNESS STATEMENTS WITNESS STATEMENT OF THE DEFENCE WITNESS NO.3 Dr. Anjali Sharma under Section 180 of the BNSS My name is Dr. Anjali Sharma. I hold a Ph.D. in Forensic Toxicology. I have been working in this field for 15 years and have analyzed over 1,000 toxicology reports, specializing in cases involving substance influence on human behavior. In this case, I received the toxicology report of Ms. Sara Kapoor for analysis. The toxicology report indicates that Ms. Kapoor had a Blood Alcohol Concentration (BAC) of 0.24%, which is three times the legal limit for operating a vehicle in most jurisdiction. At a BAC of 0.24%, a person typically experiences severe impairment in cognitive and motor functions. This level of intoxication is known to cause confusion, impaired judgment, reduced reaction time, and significant loss of coordination. Individuals with such a high BAC often struggle with balance and may exhibit erratic or emotional behavior. The presence of both Sertraline and Escitalopram in Ms. Kapoor’s system would have compounded the impairment caused by alcohol, further diminishing her capacity to make rational decisions or maintain physical stability. The combined effect of alcohol and diazepam can lead to dizziness, drowsiness, and extreme disorientation. In my opinion, the levels of alcohol and diazepam present in Ms. Kapoor’s system would have severely impaired her cognitive and physical abilities. Given the circumstances described, including witness statements of her unsteady state and emotional distress, it is plausible that Ms. Kapoor was not in full control of her actions. Her impaired judgment and physical instability likely contributed to her tragic fall from the ship’s railing. There are no signs of struggle or foul play indicated by the toxicology findings. … 46 TRIAL PROPOSITION INTERNAL TRIAL RANKING ROUNDS 2024-2025 ANNEXURE- A Sollywood invitees to the party at The Odyssey … 47 TRIAL PROPOSITION INTERNAL TRIAL RANKING ROUNDS 2024-2025 ANNEXURE- B Screenshot of the texts sent by Raj Mehra to Sara ANNEXURE – C … 48 TRIAL PROPOSITION INTERNAL TRIAL RANKING ROUNDS 2024-2025 Ship Registration Certificate … 49 TRIAL PROPOSITION
