C E May 9, 2018 8.2 TO: All Geographic Bureau and Area Commanding Officers FROM: ChiefofDetectives SUBJECT: INVESTIGATIVE RESPONSmILITY FOR HUMAN TRAFFICKING CRIMES - REVISED The purpose of this Notice is to clarify the role of the Human Trafficking Unit (HTU), Detective Support and Vice Division (DSVD), as well as the notification process for geographic Areas to HTU regarding arrests and investigations involving human trafficking related crimes. Human Trafficking is a form of modem day slavery, demonstrated through the exploitation of another's vulnerabilities. It involves the use of force, fraud, or coercion to cause an individual to participate in commercial sex acts or involuntary servitude (not to include sex acts). Any person acts with or without force, fraud, or under 18 years of age induced to perform commercial coercion are identified as Commercially Sexually Exploited Children (CSEC). sex HUMAN TRAFFICKING UNIT'S RESPONSmILITIES. The HTU is responsible for the investigation and/or the coordinated strategies of all human trafficking cases involving minor victims (17 years or younger). In addition, HTU may assume investigative responsibility for the following crimes against a victim of ~ age: • • Victim is kidnapped by being forced into a vehicle and taken to a secondary location for the sole purpose of commercial sex acts; Victim is admitted to a hospital due to injuries caused by a trafficker (pimp) or purchaser (John); • • Victim is transported from another state or country for the purposes of commercial sex acts; or, All cases ofinvoluntary servitude. OFFICER'S RESPONSmILITIES. When requesting HTU response to investigations involving CSEC population, involuntary servitude; or incidents involving a victim who has been kidnapped for commercial sex, admitted to a hospital, or transported across state lines, the following procedure shall be followed: • • • For minor victims, verify the victim's name and date of birth (DOB), which may include Live Scan fingerprint; parents' names and DOBs; and residence address. If the victim is an adult, complete a field interview card. For all victims, query Department resources to detennine if the victim has warrant(s) or is on probation. All Geographic Bureau and Area Commanding Officers Page 2 8.2 • • • Call the Department Operations Center, Communications Division, at (213) 484-6700, and request the on-call HTU supervisor. Provide the HTU supervisor with a brief synopsis ofthe incident, whether there is a trafficker in custody, and all identifying information for the involved victim(s). The HTU will detennine when the Department of Children and Family Services Child Abuse Hotline will be contacted, based on the extent of the investigation. WATCH COMMANDER'S RESPONSmILITIES. When the watch commander reviews an Investigative or Arrest report involving a human trafficking related crime, he/she shall ensure the proper notifications are made and documented appropriately. AREA RECORD'S UNIT RESPONSmILITIES. When an Investigative or Arrest Report involves a human trafficking related crime, personnel from the Area Records Unit will process the report and ensure a copy is forwarded to DSVD, HTIJ.
