Interviews, Statement Taking and Other Considerations** 1. Statements should be obtained from **all** victims and material witnesses as directed by the Reviewing Officer ([RO](#_bookmark48)) during PHASE ONE investigation (see Section 8.2 of [S.O CR 1](https://modgovuk.sharepoint.com/:w:/r/teams/25468/STANDING%20ORDERS%202023/Standing%20Orders%202023%20onward/CRIME%20INTELLIGENCE%20SAFEGUARDING/CRIME/CR%201.docx?d=w350011853bab4f1fbf46f9f09b665858&csf=1&web=1&e=I3dfYk)). 1.2 Statement taking should be complementing in full the principles of PEACE Model Interview Techniques. The notes taken by the interviewing officers during the whole procedure should be retained and treated as unused material. 1.3 To help identify suspect(s) and link crimes, statements must be comprehensive and, depending upon the nature of crime, include the following particulars: - Introduction of Complainant (what he does for a living, how long for etc.) - Facts leading up to the event. - Description of place where incident took place. - When place/property was last seen, and time discovered stolen/damaged. - Description of place/items stolen/damaged (description, times persons are present there, colour, identification marks, make/ brand/ name, value etc.) - The estimated value of stolen/damaged item(s). - Whether there were similar incidents in the past. - Whether consent was given to anyone to enter and take anything from the place. - Detailed description of suspect(s) clothing and physical characteristics (use body map/ Personal Descriptive Forms (SBAP/MIR/05) as an aid) behavioural characteristics exhibited during enactment of crime. - Exact actions taken and words spoken by suspect(s) including gestures/ which hand was used/ accent/ if disguised/ breath odour etc. - Degree of violence used on victim and by what means it was inflicted, including mental harm either to victim or witnesses. - Full description of object/ weapon used to include hand it was held in. - Possible suspects/ differences with anyone. - Actions/ Enquiries by victim after the incident. - Whether urgent medical assistance was required, medical form completed. - Action the complainant needs the police to undertake. 4. Officers recording statement should use blue ink, for the reasons detailed in **paragraph 19.1 of Crime Standing Order**. 5. Availability of witnesses during criminal proceedings is an important element for successful prosecution. Prosecuting Officers should be fully informed as to when witnesses will not be available to attend Court sittings and fix trials and summon witnesses accordingly. For this reason, officers interviewing witnesses and recording statements should enquire with the interviewee for any periods he/she will not be available during the next six months and fill in the relevant table provided in the front page of statement template form (SBAP/INV/12-V). 6. When it is not considered necessary to obtain a statement from a person seen, a record shall be made in the Diary of Action of the case ([[DOA]](#_bookmark35)), detailing the full particulars of the person concerned, date and time seen, a brief account of what the person has said. The RO (Divisional Crime Manager -- [DCM](#DCM) or the Deputy Divisional Crime Manager - [[DDCM]](#DDCM)) will record his decision not to direct statement taking, giving also the rational of his/her decision. 7. []{#_bookmark1.anchor}Review Officers should ensure that established procedures regarding victims of sexual offences are strictly adhered to. In cases of rape, serious sexual offences, Domestic Violence [(][DV)](#_bookmark39) or cases of abuse of children, it is important that interviews of victims are conducted by specially trained officers (see relevant List of Officers trained on Visually Recorded Interviews) and if appropriate be visually recorded as provided by the relevant legislation (**Violence in the Family Ordinance 21/2003** and **Protection of Witnesses Ordinance 4/2005**). Interviews should be conducted in a tactful and sympathetic manner and unless there is overwhelming evidence to the contrary, the allegation will be accepted as genuine. Interviewing Officers should always be dressed in plain clothes when visiting the victim\'s home or place where she/he is known to them. In cases of [DV](#_bookmark39), the interviewing officer should be of the same sex unless the victim otherwise requests, or, where the victim is a minor, the family counsellor does so. In all other cases, best evidence should be the main consideration and therefore the victim should be asked with what sex they would better confide. Male child or young males who have been the victims of sexual offences may be reluctant to confide in female officers and it may be better for a male Officer to conduct the interview. The Cyprus Joint Police Unit ([[CJPU]](#_bookmark28)) suites should be used for statements from the victim. Vulnerable and young victim(s)/material witnesses must be interviewed in the presence of an [[appropriate adult]](#_bookmark24). 8. In most cases it may be necessary for the victim to rest for a number of hours before a detailed statement is obtained. In the interim, it will suffice for an Officer to obtain details of the incident and description/identity of the offender where known. 9. Subject to approval from the [DCM](#DCM) or the Senior Investigating Officer ([[SIO]](#_bookmark51).) appointed as in-charge of the investigation, it may be appropriate for a first statement to be obtained within 24 hours of the incident. In those cases where a suspect is identified and arrested the same general criteria may apply. 10. Ensure record of first description of suspect(s) is retained for disclosure purposes. 11. []{#_bookmark2.anchor}If victim of assault, arrange medical examination and ensure visible injuries are photographed with and without a scale. The photographic supplement should be attached to the statement of the officer who obtained them. Photographers of the same gender should be used in cases where photographs of injuries on intimate parts of the victim's body will be taken (see list of female Officers trained photographers). A person believed to be the victim of a sexual offence should be medically examined as soon as possible after the offence has been reported. The consent of the victim is required prior to examination. When the complainant is less than 16 years of age, consent in writing should be obtained from a parent or guardian. The victims of serious sexual assaults are to be examined in a Hospital unless a Police Special Medical Suite is available. A female victim should be given the opportunity of being examined by a female doctor whenever this is possible. A female Police Officer will be present during the medical examination. For detailed guidance regarding Medical Examinations of Victims and Use of Experts see Section 6.6 below (Forensic Pathologists and Other Medical Experts). 12. Photographs of abovementioned injuries should also be obtained at a later stage, as to establish the severity of the recorded injuries as well as whether new ones have become visible, i.e. bruising. The photographic supplement should be attached to the statement of the officer who obtained them. 13. According to the circumstances of the case, inform Social Welfare Services and if required arrange referral (see List of Welfare Office Family Counsellors and SAFFA contact details). 14. Ensure that there are follow-up visits to the victim(s) and they are kept fully updated regarding the progress of the investigation/court proceedings. 15. []{#Section1_15.anchor}Consider requesting/arranging counselling and other medical services for potentially traumatised victims/witnesses. 16. []{#_bookmark4.anchor}Ensure pro-active measures taken to identify additional witnesses, e.g.: - Early press conference TV/radio/newspapers/social media. Consider appointing Press Liaison Officer and media strategy. - Road blocks/checks (use of anniversary method -- weekly, monthly, etc.) - Reconstruction of crime. **2.** []{#Section2.anchor}**Victim/Family Liaison Officers** 2.1 Whenever an investigation to any of the following incidents/crimes is initiated, a Family Liaison Officer ([[FLO]](#_bookmark42)) should be appointed by the [SIO](#_bookmark51). dealing with the case: - Murder - Missing person (suspicious circumstances and/or high risk -- i.e. abduction or believed that they have come to harm); - Fatal road collisions; - Mass disaster; - Stranger rape; - Life changing incidents/cases (somebody loses a limb in a serious car crash); 2.2 Appointment of [FLO'](#_bookmark42)s must be conducted through the Family Liaison Coor dinator, ([[FLC]](#_bookmark40)). 1. Detailed guidance reference Family Liaison is found in [S.O SFG 2 -- FAMILY LIAISON](https://modgovuk.sharepoint.com/:w:/r/teams/25468/STANDING%20ORDERS%202023/Standing%20Orders%202023%20onward/CRIME%20INTELLIGENCE%20SAFEGUARDING/SAFEGUARDING/SFG%202.docx?d=w6ef1caf67f13470eb1ab9d46f7153022&csf=1&web=1&e=drIqfy) **3.** []{#Section3.anchor}**Statement of Complaint** 1. Interviews of victims should be conducted in their mother language and whenever necessary with the assistance of an interpreter. Alike all interviews of witnesses and suspects, victims should be interviewed, and statements should be taken from them on the principles of the PEACE Model Interview Techniques. 2. In cases of DV and other serious criminal offences involving a vulnerable complainant / victim, visually recorded interviews should be a serious consideration. The relevant provisions of the **Violence in the Family Ordinance 21/2003** and the **Protection of Witnesses Ordinance 4/2005** should be observed. 3.3 The investigation of cases involving offences relating to Child Abuse and DV should be in line with the provisions and investigative guidelines found in [S.O SFG 1 -- HANDLING OF DOMESTIC VIOLENCE AND CHILD ABUSE INCIDENTS](https://modgovuk.sharepoint.com/:w:/r/teams/25468/STANDING%20ORDERS%202023/Standing%20Orders%202023%20onward/CRIME%20INTELLIGENCE%20SAFEGUARDING/SAFEGUARDING/SFG%201.docx?d=wcac9e6aabfeb43859059d65a5d6cc86a&csf=1&web=1&e=FYdsCH). **4.** []{#Section4.anchor}**Liaison with Social Welfare Officers** 1. Welfare Officers may be required to report on juveniles or vulnerable persons involved in offences of Child Abuse or DV. 2. Liaison with Service and [[RoC]](#_bookmark50) Welfare Departments should be arranged when appropriate. 3. Service and [RoC](#_bookmark50) Welfare Departments have their own procedures and rules. Each Welfare Officer has his/her own area of responsibility and call out should be through the District Welfare Office call out list. Guidelines as to when and how the welfare services should be informed in cases of [DV](#_bookmark39) or Child Abuse are detailed in [S.O SFG 1](https://modgovuk.sharepoint.com/:w:/r/teams/25468/STANDING%20ORDERS%202023/Standing%20Orders%202023%20onward/CRIME%20INTELLIGENCE%20SAFEGUARDING/SAFEGUARDING/SFG%201.docx?d=wcac9e6aabfeb43859059d65a5d6cc86a&csf=1&web=1&e=FYdsCH) **5.** []{#Section5.anchor}**Other Practical and Procedural Guidance on Crime Investigation** 1. []{#Section5_1.anchor}[Stealing - Possession of Dutiable Goods] 2. [Investigation of Serious Fraud Cases] -------------------------------------------------- 1. Such cases will normally be those where the following apply: - The facts and/or law references are complicated; - The sum of money at risk is substantial; - There is a significant public interest or concern. 2. Such cases will be immediately referred to the DCM for further instructions. 3. The [[Chief Inspector (O&C)]](#_bookmark27) in consultation with the DCM may appoint an investigation team consisting of investigators with relevant training and experience. 3. [Recording, Counting and Investigation of Offences under the Game and Wild Birds Ordinance 21/2008] --------------------------------------------------------------------------------------------------------------- 4. Offences against the provisions of the **Game and Wild Birds Ordinance 21/2008**, are included in the list of "[Notifiable Criminal Offences](#_bookmark46)" detailed in [S.O CR 12](https://modgovuk.sharepoint.com/:w:/r/teams/25468/STANDING%20ORDERS%202023/Standing%20Orders%202023%20onward/CRIME%20INTELLIGENCE%20SAFEGUARDING/CRIME/CR%2012.docx?d=w8a60b8dd20944596997ef976a3c120ce&csf=1&web=1&e=ZgnVbx). All offences contrary to the said Ordinance are to be investigated by the Community Action Team's investigating officers. 5. On most of the occasions, offences under this Ordinance do not allow high investigation opportunities, simply because the offenders are often operating remotely from the place of the offence (use of mist-nets, lime stick etc.). While ethical recording directs that all crime offences that come to the knowledge of the Police should be recorded as such, offences against the said Ordinance should not be an exception. This should apply even when the investigation of the case comes to a dead end at a very early stage and no further action can be taken for detection, apart from seizure of recovered paraphernalia. 6. It should be emphasised that the policy concerning recording and investigation of offences under this Ordinance does not aim to increase bureaucracy or be to the detriment of other policing priorities. However, it should be made clear that all reasonable investigative opportunities should be taken for detection and the guidelines below should apply on dealing with such offences. Nevertheless, the list below is not exhaustive and other investigative principles not included in the list should also be considered. I. [ Investigation] II. If the investigation ends at a very early stage with mere seizure of exhibits and no further action is intended to be taken, a [DOA](#_bookmark35) [ ] starting with the [DOR](#_bookmark36) entry, followed by subsequent action taken and a submission entry by the [IO](#_bookmark43) and his/her [[LM]](#_bookmark45) should suffice. VI. Investigation Dockets of offences under the Game and Wild Birds Ordinance should be forwarded to the Divisional [[CJU]](#_bookmark29) Sergeant who will peruse the case and make relevant recommendations to the Deputy Div. Com. for its disposal. VII. [Officer's Own Statement of Evidence] **6.** []{#Section6.anchor}**Expert Assistance** 1. []{#Section6_1.anchor}[SBA Police Scene of Crime Officers - (SOCO):] 2. [Ammunition Technician Officer - ([ATO](#_bookmark25)):] -------------------------------------------------------------------- 1. [ATO](#_bookmark25)'s are responsible for: - Clearance of ammunition; - Rendering explosives safe; - Rendering weapons safe; - Rendering safe and examination of suspicious devices. 2. Save in the case of [[AFO]](#AFO) who are trained to handle and declare safe firearms and ammunition, **under no circumstances** will the Police handle any ammunition or weapons, until [ATO](#_bookmark25) or an [AFO](#AFO) has been consulted and has pronounced the articles safe. Although safety prevails evidence gathering, [AFO](#AFO)'s are trained to handle firearms and ammunition with the least contamination as possible. When circumstances permit, [SOCO](#SOCO)'s will be consulted[. ATO](#_bookmark25) [ ] who is the only authorised person to handle and declare safe explosives, will retain or destroy ammunition and explosives as necessary and in accordance to any investigation needs or evidential value. Unless retention of a weapon in the designated Police Exhibit Stores carries an obvious risk or hazard, exhibit weapons will be kept and dealt with like any other Police exhibit. **No explosives** will be brought to a Police Station. 3. [ATO](#_bookmark25) will be called out through a [MASBAA](#_bookmark44) [ ] form via J3. 3. [Dog Handlers:] --------------------------- 4. []{#Section6_3_1.anchor}Utilisation of SBA Police Dog Handlers should always be a consideration for searching areas where crime has occurred. 5. []{#Section6_3_2.anchor}The British Forces Cyprus and in particular [CJPU](#_bookmark28) have their own sniffer dogs specially trained to search for explosives, weapons and drugs. Utilization of CJPU sniffer dogs in relevant operations should be requested and arranged through JOCC. 4. [Forensic Science Department of Cyprus Police:] ----------------------------------------------------------- 5. [State Lab, Institute of Genetics and Neurology and Fingerprint Bureau:] ------------------------------------------------------------------------------------ 6. Submission of exhibits to these laboratories should be accompanied by the appropriate form (P161 - SBAP/CR/04) and authorised by the DCM or the DDCM. All submissions should be registered with the Forensic Science Department of CyPol HQ. The Divisional SOCO will provide the DCM's with regular returns for submission of exhibits for DNA. The DCM's will apply for these matters a relevant strategic perspective, thus complementing the principles of best evidence in conjunction with budgetary constraints. 6.5.2 A decision for submission of exhibits for forensic examination should be conducted in consultation with the SOCO involved in the case. 7. The Memorandum Of Understanding between SBA Police and CyPol on Forensic Issues ([S.O CR 10](https://modgovuk.sharepoint.com/:w:/r/teams/25468/STANDING%20ORDERS%202023/Standing%20Orders%202023/CRIME%20INTELLIGENCE%20SAFEGUARDING/CRIME/CR%2010.doc?d=wbab8527f0c2949c388fd0b4bfe9537b1&csf=1&web=1&e=53b6cO)), which was signed by the [[CC']](#_bookmark26)s of SBA Police and CyPol on 25/05/2010, provides for the coordination between the two Forces on matters combating crime and in particular submission, examination, storage, removal and destruction of Prints and DNA samples and Profiles for examinations. 6.5.3 The SBA Police liaison point with the director of Forensics of CyPol HQ is the Divisional SOCO. 6. [Forensic Pathologists and Other Medical Experts:] -------------------------------------------------------------- 6.6.1 Call outs of Forensic Pathologists and Other Medical Experts should only be made through the Family Liaison Coordinator ([[FLC]](#_bookmark40)), and in Serious Cases the SIO in charge of the investigation. 8. The circumstances in which the services of a Forensic Pathologist are needed are mainly when death is involved especially in suspicious circumstances. The Forensic Pathologist would be required on most of the occasions, to attend the scene for autopsy and subsequently to conduct a [[PME]](#_bookmark40) on the body. However, on those occasions that there is no suspicion surrounding the death of a person, i.e. expected death of elderly people, the attendance of the Forensic Pathologist for autopsy would not be required. Other incidents that would warrant the services of a Forensic Pathologist are serious Industrial Accidents, serious Sexual Assaults and Assaults GBH, whereby the services of other Medical Experts, such as Gynaecologists and or General Surgeons may also be required. 9. Whenever the services of a Forensic Pathologist at a scene are required, necessary arrangements should be made for its long-term preservation. On most of the occasions, this would become inevitable because of the expected delay in attending the scene. The decision to remove the body to the Mortuary prior to the attendance of the Forensic Pathologist must be made by the IO in consultation with the DCM in consultation with the Divisional SOCO. This should be made by considering the merits in each individual case, the weather conditions and the anticipated time of response of the Forensic Pathologist called out. When a decision is made for the body to be removed to the mortuary before it is viewed by the Forensic Pathologist, the SOCO should record the scene adequately on photos and video. This material should be made available for viewing by the scientist before performing the autopsy. 10. Two Gynaecologists, one at each end, and one General Surgeon based at Limassol have been contracted by the SBA Administration to provide services for Police investigations as detailed above. The two Gynaecologists are Dr Yiannis Kassinis who is based in Larnaca and Dr Nina Pastides who is based in Limassol. The contracted General Surgeon is Dr Paul Pastides who is based in Limassol as detailed below. 11. Two Forensic Pathologists from Greece, Dr Chara Spiliopoullou and Dr Emmanouil Sakelliades, have been also contracted by the Service. They will be contactable at any time and similarly they will respond as soon as possible. As they will be travelling from Greece, their services will be rendered with some delay and this must be taken into consideration by the I.O. of the case, as detailed in paragraph 7.6.3 above. 12. Examinations of victims of Sexual Assaults will be conducted at the private clinics of the above-mentioned scientists. Examinations of victims of GBH may be conducted at the medical institutions where the victim is taken to. The use of sensitive suites, the Police stations or the Service Hospitals as place of examination of victims of violence may be decided by the I.O. on special occasions on the advice of the Divisional SOCO. 13. Whenever for any reason the mortuary at the Service Hospital of Akrotiri is out of service, the respective mortuaries of the RoC at Government Hospitals may be used as an alternative. The use of the RoC Mortuaries is based on a written authority because of necessary arrangements made with the Ministry of Health of the RoC. The above agreement provides only for the use of the installations; therefore, SOCO's attending [PME](#_bookmark47)'s at the RoC Hospitals should make provisions for consumables that will be supplied by RAF Akrotiri Health Centre. The RAF Akrotiri Health Centre will also provide specially trained medical staff to assist the Pathologist during the PME's. As the whole process on those occasions involves the removal of bodies from our Coroner's jurisdiction, in consultation with the Coroner of the RoC, the SBA Coroner should sign a Removal Certificate, thus authorising the removal of the body to the jurisdiction of the Coroner of the RoC where the PME will take place. The latter will sign a PME Order and subsequently a Burial Certificate on those occasions whereby the body will be released after the PME for burial. On those complex cases/occasions whereby further retention of the body by the Police is needed, the Coroner of the ROC will be requested to grant a Removal Certificate, thus authorising the return of the body to the Mortuaries of the Service Hospitals. 7. []{#_bookmark17.anchor}**Other Experts:** Utilization of Local Experts (Psychologists, Vets, etc.) should be authorised by the DCM or any member of the Divisional Senior Command. 8. []{#_bookmark18.anchor}**CJPU** may provide **scene of crime examination** support in complex cases involving a series of crime scenes. After consultation with the Senior Divisional Officer on call, any request should be through the Commanding Officer CJPU or the Duty Room during silent hours. 9. []{#_bookmark19.anchor}**RAF Akrotiri Photographic Section** also provides support. Any request should be through the Commanding Officer or via JOCC during silent hours. 10. The DCM maintains links with the "**National Cri**[]{#Section6_10.anchor}**me Faculty UK**", through which support in all fields of Crime Investigation may be provided. Such support should be normally sought on all occasions where the required expertise is not available locally and can also be provided remotely on a 24-hour basis**.** **7.** []{#Section7.anchor}**Industrial Accidents** 7.1 On receiving notification about an industrial accident taking place within the SBA's, the Divisional [[Duty Officer]](#_bookmark37) should be notified and ensure that the scene is immediately attended, an incident log is initiated, and initial enquiries are carried out. The officers attending should take all necessary steps to save life, secure evidence and preserve the scene of the accident. 7.2 The Respective Area Office should be notified as well as the Labour Office of the RoC who should be invited to investigate unless: - The incident has taken place within military installations or closed camps and there are security issues involved. - The casualties involved are or include members of the Forces, [[UKBC]](#_bookmark55)'s or Dependants. 7.3 The SBA Police has primary jurisdiction and will undertake or continue investigation of those incidents whereby criminal offences (causing death by rash, reckless or dangerous act or other relevant offences), other than offences against the Health and Safety at Work Legislation, are disclosed. 7.4 Any relevant evidential material that has come to the possession of the Police because of the first response at the scene will be handed over to the investigating authority with the approval of the respective [[Div.
