OFFICE OF THE CHIEF OF POLICE NOTICE 14.5 January 28, 2014 TO: All Department Personnel FROM: Chief of Police SUBJECT: BIASED POLICING COMPLAINT MEDIATION PROGRAM On January 1, 2014, the Department, in conjunction with the City Attorney's Office-Dispute Resolution Program, launched the Biased Policing Complaint Mediation Program, a 36-month pilot. The purpose of this program is to mediate select complaints of Biased Policing as an alternative to the traditional, adversary-oriented investigation procedure. It is hoped this program will strengthen community relations and build a better understanding between the Department and the communities it serves. Mediation is an informal, confidential process in which the complainant and accused employee meet face-to-face, with an impartial mediator, to discuss the alleged misconduct with the goal of arriving at a mutually agreeable resolution. Mediation is another tool in our arsenal to address the very difficult and frequently contentious issue of Biased Policing. Biased Policing and Discourtesy complaints will be eligible for the pilot program. Biased Policing complaints with other allegations of minor misconduct may also be considered. Complaints closed with a "Mediated" disposition are not displayed on TEAMS Reports used for monitoring, performance review, promotion, paygrade advancement, final selection, transfer, disciplinary review, Risk Management Executive Committee profiles or Risk Management Information System thresholds. For the specifics of the program, employees will receive eLearning training thorough the Learning Management System and may view the Biased Policing Complaint Mediation Program I mplementation Plan, which has been posted on the Professional Standards Bureau webpage. Mediation can be a powerful learning experience for both complainants and employees. Through mediation, the Department hopes to impact the way employees communicate and treat people as well as give community members a better understanding of law enforcement practices.
