SHERIFF’S POLICY MANUAL 9.2 APPEALS PROCESS: A. For this chapter's purposes concerning the appeals process described herein, employees will be defined as deputy sheriff, deputy sheriff sergeant, deputy sheriff lieutenant, detention deputy, detention sergeant, detention lieutenant, and any other employee covered by a bargaining unit agreement excluding Department of Fire Rescue and Emergency Services employees covered by a bargaining unit agreement. B. All other employees will be deemed managerial, exempt, or confidential and excluded from any appeal rights described in this chapter. In addition, all Department of Fire Rescue and Emergency Services employees covered by a bargaining unit agreement are also excluded. C. The Sheriff or designee retains the exclusive right to determine and administer discipline to managerial, exempt, and confidential employees up to and including termination and to impose all other terms and conditions of employment. 9.2.1 Administrative Appeal Board (AAB): Bargaining Unit Members receiving disciplinary suspension of five days or less shall be entitled to review by the Administrative Appeal Board, unless the right is waived. A. AAB reviews will be conducted in compliance with applicable bargaining unit agreements. B. Record of Proceedings: 1. AAB hearings need not be recorded. 2. AAB will not be open to the public unless required by law. 3. Records of all hearings will be maintained and secured in Internal Affairs in accordance with Florida Statutes. 9.2.2 Arbitration: Disciplinary suspension of six days or greater or disciplinary recommendation of demotion or termination shall be entitled to appeal by arbitration pursuant to BSO policy and collective bargaining union agreements. 9.2 11/05/2009 SHERIFF’S POLICY MANUAL THIS PAGE LEFT INTENTIONALLY BLANK 9.2 11/05/2009
