Miller PGO 8453.00 “Incident Command” Reevaluation As Necessary 8120.00 Application All Employees Related Forms / Bulletins PURPOSE: The purpose of this policy is to establish the duties, responsibilities and guidelines for department patrol supervisors and the staff duty officer to make notifications in the event of major incidents. DISCUSSION: It is the policy of the department to have a staff duty officer (a representative of the police chief), who is a member of the Senior Staff, available whenever an unusual or major incident occurs within the City of Apopka, or one that involves department personnel. The staff duty officer will monitor the incident to ensure it is handled in accordance with agency General Orders and that proper notifications are made. The staff duty officer is delegated the authority to act on behalf of the Police Chief while serving as the staff duty officer. This authority will remain in force until relieved by a ranking officer. The on-call roster will be updated and distributed in Power DMS monthly by the Investigations Administrative Assistant, or designee. POLICY / PROCEDURE: I. General Policy Guiding On-Call Staff Duty Officers: A. Call Rotation: 1. A staff duty officer shall be “on-call” for a one week rotation cycle. The call rotation shall be seven days in length, beginning at 0800 hours on Monday and continuing until 0759 hours the following Monday. 3. The roster will be published in Power DMS by the investigations administrative assistant, or designee, and will be available to the Communications Center and supervisory members of the department. B. Authority of Staff Duty Officer: 1. The staff duty officer, when acting as such, shall have authority over an equivalent ranking officer until relieved by a superior officer. 2. The staff duty officer may relinquish authority to an equivalent ranking staff officer when such officer accepts said authority and responsibility. C. Responsibility of Staff Duty Officer: 1. The staff duty officer shall make a full assessment of major situations and determine the need for the response of investigative or other support personnel, notification of superiors, and/or recall of field personnel. 2. The staff duty officer shall be responsible for the overall command of the incident and work within the incident command system for all exceptional situations. Exceptional situations are outlined in II.C, below. 3. The staff duty officer shall be available to provide assistance and/or advice twenty-four (24) hours a day. 4. The staff duty officer shall notify and provide continued updates to the Police Chief regarding the details of major incidents, or incidents where the Agency’s liability comes into question or those which may result in heightened community or media interest. II. General Policy Guiding Patrol Supervisors: A. Patrol Sergeant: 1. Patrol Sergeant Duties: a. The patrol sergeant shall monitor the patrol functions of the department on a continual basis. The patrol sergeant shall respond to incidents identified under Section II.C, below, for the purpose of command until relieved by a higher ranking officer. c. The patrol sergeant shall coordinate efforts of patrol units and ensure that the proper response to, and follow-up of incidents within the city are undertaken. 2. Watch Commander (Lieutenant) Notifications: a. The patrol sergeant shall ensure major or unusual incidents are reported to the watch commander immediately or as soon as practical after an incident has been reported. b. The watch commander has ultimate responsibility for his personnel unless relieved by a higher ranking officer. c. In the event the watch commander cannot be notified, the patrol sergeant will notify the on call staff duty officer. B. Watch Commander: 1. Watch Commander Duties: a. The watch commander or acting watch commander shall monitor the patrol functions of the department on a continual basis. b. The watch commander or acting watch commander shall respond to incidents identified under Section II.C, below, for the purpose of command until relieved. c. The watch commander or acting watch commander shall coordinate efforts of patrol units and ensure that the proper response to, and follow-up of, incidents within the city are undertaken. 2. Staff Duty Officer Notification: a. The watch commander shall ensure major or unusual incidents, such as those outlined in section II.C, below, are reported to the staff duty officer for informational purposes, guidance, and assistance. This shall be accomplished immediately or as soon as practical after an incident has been reported. STAFF DUTY OFFICER / WATCH COMMANDER AND MAJOR INCIDENT NOTIFICATION Page 3 of 8 b. In the event the staff duty officer cannot be notified, the watch commander or acting watch commander shall ensure that notification is made to the Police Chief or Deputy Police Chief. C. The staff page or email notifications are intended to ensure the senior staff is aware of an incident or event that does not require immediate notification and should contain, the location of occurrence, suspect information/description, and a brief detail of what occurred. The watch commander should make a notification when they believe there are extenuating circumstances that staff should be aware of. Incidents requiring only a staff page or email notification include, but are not limited to: 1. Robberies or Persons Crimes: a. Commercial robberies – unless there is injury to person or something specific that the watch commander feels should be passed along immediately. 2. Property Issues: a. Multiple burglaries (commercial, residential, or vehicle) where a suspect is in custody or known b. Felony property crimes where immediate investigative assistance is needed or a suspect is in custody c. Incidents involving city or county owned properties (Including major incidents on school properties) d. Incidents involving a burglary or theft of a firearm from a member or from a member of another agency living within the city limits 3. Traffic/Roadway Issues: a. Sustained blockage of a major traffic thoroughfare, intersection, or roadway causing traffic disruption b. Traffic accidents requiring the response of the Traffic Homicide Unit 4. Sex Crimes: a. Sexual abuse cases STAFF DUTY OFFICER / WATCH COMMANDER AND MAJOR INCIDENT NOTIFICATION Page 4 of 8 5. b. Child pornography cases c. Sexual battery cases d. Incidents involving Human Trafficking Destructive Devices or Arsons: a. Any time a suspicious or hazardous device is located b. Bomb threats c. Actual or attempted fire bombings d. Arson or cases where the cause of the fire is not immediately known e. 6. Injury caused by fire or destructive device Drug Investigations: a. When patrol arrests for trafficking in a controlled substance or recovers an amount of a controlled substance considered trafficking b. Whenever $10,000, or more, in U.S. currency is found in a drug area or in a motor vehicle, or is recovered pursuant to a drug arrest c. Whenever a vehicle with secret compartments is discovered d. Whenever at least one (1) pound of cannabis is recovered e. When a detainee/arrestee indicates his or her willingness to assist in a drug investigation f. 7. Contact with clandestine laboratories or indoor grow operations Personnel Issues: a. Crashes involving city vehicles regardless of damage costs or injury D. Incidents requiring mandatory notification of the Staff Duty Officer: 1. Deaths: a. All incidents involving a death require notification to the Staff Duty Officer 2. Serious Injury Cases: a. Serious injury from criminal offenses, including traffic, where hospitalization is required and death is possible STAFF DUTY OFFICER / WATCH COMMANDER AND MAJOR INCIDENT NOTIFICATION Page 5 of 8 b. Shootings, stabbings, or other major violence c. All agency member involved shootings, or serious injury of suspect(s) or public where an agency member is involved d. Injury to a member of the department, or another law enforcement agency, as a result of a criminal act that occurred within the city limits 3. Robberies or Persons Crimes: a. Home-invasion robbery b. Carjacking c. Hostage, barricaded subject(s) and/or major disturbances d. Robbery to a person where there are injuries or large dollar loss e. Kidnapping/abduction or false imprisonment f. Elderly/child abuse cases involving serious neglect or endangerment 4. Missing and/or Endangered Persons: a. Missing persons if the possibility of foul play exists b. Missing persons considered endangered due to their mental or physical status c. Lost or missing children aged twelve and under d. Child over twelve years of age where, in the supervisor’s judgment, alternate resources are needed 5. Personnel Issues: a. Crashes involving city vehicles where there is significant damage costs or significant injury b. All incidents involving alleged criminal acts on the part of a department employee c. Any incident where a City employee is the victim of a serious injury or death d. Accidental discharge of an agency owned/issued firearm e. Any employee exposure incident STAFF DUTY OFFICER / WATCH COMMANDER AND MAJOR INCIDENT NOTIFICATION Page 6 of 8 6. Other: a. Vehicle Apprehensions b. Riots or civil disorder c. Actual or suspected domestic terrorism d. Negative interactions between Apopka personnel and other law enforcement personnel, criminal interactions with other law enforcement personnel, or incidents where law enforcement personnel are suspects or victims of crime (victims as part of their bona fide law enforcement duties, i.e. battery LEO, notwithstanding) e. Any incident that is likely to have local or national media coverage f. Other major incident (not described above) in which the duty supervisor feels they should elicit the assistance of the on-call staff duty officer. E. Incidents requiring mandatory notification of the Police Chief: 1. All incidents involving a homicide a. All agency member involved shootings, or member involved serious injury of a suspect(s) or public where an agency member is involved b. Death or serious injury to a member of the department, c. Death or injury of a member of another law enforcement agency, as a result of a criminal act that occurred within the city limits 2. Hostage, barricaded subject(s) and/or major disturbances 3. All SWAT or Special Unit call outs (other than Criminal Investigations) 4. Kidnapping/abduction where the victim is not immediately located 5. Lost or missing juveniles, aged twelve and under if not immediately located upon completing a cursory search 6. Missing persons where the possibility of foul play exists 7. Any time a hazardous device is located 8. Contact with clandestine laboratories or indoor grow operations STAFF DUTY OFFICER / WATCH COMMANDER AND MAJOR INCIDENT NOTIFICATION Page 7 of 8 9. All incidents involving alleged criminal acts on the part of a department employee 10. Riots or civil disorder a. Actual or suspected domestic terrorism b. Negative interactions between Apopka personnel and other law enforcement personnel, criminal interactions with other law enforcement personnel, or incidents where law enforcement personnel are suspects or victims of crime (victims as part of their bona fide law enforcement duties, i.e. battery LEO, notwithstanding). 11. Any arrest of or filing of charges on a juvenile under the age of 13. 12. Any incident that is likely to have local or national media coverage. 13. Other major incident (not described above) in which the staff duty officer or watch commander believes the Police Chief should be notified. 14. The Police Chief should be notified of all other incidents listed under mandatory staff duty officer notifications by phone or electronic message when appropriate.
