The surgeon should gave the order for the nurse to separate the spicemens, since he cant know if any of the specimens were malignant until they get examed in pathology. If the surgeon would have just followed protocol, he could’ve prevented this whole situation. This is the hospital and the staff fault since they should check that all the instruments that are going to be used during surgery work and function. The staff members of the OR are in fault for this, they should have followed protocol and done the procedure how is supposed to be done. They shouldn’t have altered the results of the patient that is iligal.
