Drivers will also be subject to federal civil penalties of up to $2,750 for each offense. Motor carriers that are found to have allowed their drivers to use hand-held cell phones while operating a CMV face a maximum civil penalty of $11,000 per violation and a 10-point CSA violation. The rule does allow for use of hand-held cell phones if they are used for emergency purposes. In April 2013, NHTSA released voluntary guidelines for vehicle manufacturers to reduce visual-manual distractions, such as commu- nications, entertainment, and navigation devices. The guidelines include recommendations to limit the time a driver must take their eyes off the road to perform any task to two seconds at a time and 12 seconds total. Tackling this issue goes beyond the law. The Network of Employers for Traffic Safety’s 2012 fleet safety benchmark study revealed that the safest fleets have written policies restricting the use of mobile devices and check mobile phone records after a collision, regardless of severity.
